AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING
ZONING MAP OR MAPS ESTABLISHED BY SECTION 19 . 18 .010
� OF THE CHULA VISTA MUNICIPAL CODE, REZONING THAT
CERTAIN PROPERTY AT THE WESTERLY TERMINUS OF SEAVALE,
NORTH OF THIRD AVEPdUE EXTENSION FROM R-3 TO R-1, AND
CERTIFYING THE NEGATIVE DECLARATZON
� WHEREAS , a notice of the proposed negative declaration on
the• rezoning of that certain property located at the westerly termi-
nus of Seavale, north of Third Avenue Extension from R-3 to R-1 was
given in accordance caith the Environmental Review Policy, and
WHEREAS , the Environmental Review Committee £ound that
� this project would have no possible significant impact on the environ-
ment and forwarded the attached Negative Declaration, IS-76-46 , to
the City Council of the City of Chula Vista for their consideration,
and
� WHEREAS, said Negative Declaration has been available to
agencies having jurisdiction by law, all responsible agencies, and
to the public for an adeguate period of time for their review and
comment, and
WHEREAS, the information contained in said negative declar-
ation has been considered by the City Council of the City of Chula
Vista prior to its action on the discretionary item before the City
Council.
PIOW, THEREFORE, the City Council of the City of Chula Vista
£inds as follows : �
l. That the City Council of the City of Chula Vista adopts
as its record of this finding of no possible significant impact the
Council agenda statement on this agenda item and all of the attach-
ments thereto.
2. That the City Council of the City of Chula Vista finds
in accordance with the recommendation of the Environmental Review
� Committee and the attached Negative Declaration that the proposed
rezoning will not have any possible significant impact on the environ-
ment, and the attached Negative Declaration, incorporated herein by
reference as if set forth fully, has been prepared in accordance with
the California Environmental Quality Act of 1970 , as amended.
3. That the Environmental Review Coordinator is hereby
authorized and directed to file said Negative Declaration with the
County Clerk of the County of San Diego subsequent to the prepara-
tion of a notice of determination on this project.
NOW, THEREFORE, the City Council of the City of Chula Vista
� does further find as the basis for rezoning from R-3 to R-1 as follows :
1. Based on land form, existing development and adjacency,
the subject single family enclave represents a •loaical extension o£
the adjoining sound, orderly, and stable R-1 single £amily neighbor-
hood. Severe slopes within and adjacent to the site provide a natural
separation from the incompatibly zoned areas to the north, south and
west. '

2 . Although presently sound and orderly, the subject single
I family enclave and adjoining single family neighborhood must exist in
a state of chronic jeopardy of multiple family incursions and their
erosive impact. The proposed rezoning would insure the preservation
of a desirable single family neighborhood and spare it the possibility
, of a lengthy period of disruption and decline which has characterized
other older R-3 single family residential neighborhoods.
3. The application of the R-1 zoning district regulations
to this property would implement the policies of the General Plan as
they relate to the preservation and enhancement of existing, sound
, residential areas. The proposed rezoning is compatible with the
General Plan designation of "High Density Residential - 13-26 dwelling
units per acre . " During the next General Plan review session, consid-
eration will be given to amending the General Plan to change some high
density designations to medium density.
The City Council of the City of Chula Vista does hereby
ordain as follows :
SECTION I : That the Zoning Map or Maps established by
Section 19 . 18 . 010 of the Chula Vista Municipal Code be hereby amended
by adding thereto the following zoning changes:
� That that certain property consisting of approximately
1. 45 acres, located at the westerly terminus of Seavale , north of
Third Avenue Extension be, and the same is hereby rezoned from R-3
to R-1 pursuant to the provisions set forth in Section 19 . 12. 020
governing the rezoning of property.
SECTION II : That any and all ordinances heretofore adopted
by the City Council of the City of Chula Vista concerning zoning of
said property be, and the same are hereby rescinded insofar as the
provisions therein conflict with this ordinance.
SECTION III : This ordinance shall take effect and be in
force on the thirty-first day from and after its passage and approval.
