HomeMy WebLinkAboutOrd 1976-1709 Ordinance No. 1709 � ORDINANCE rao. i�o9 I � AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING ZONING ' MAP OR DiAPS ESTABLISHED BY SECTION 19 . 18. 010 OF THE CHULA VISTA MUNICIPAI, CODE, PREZONING AND REZONIPIG THAT CERTAIN ` PROPERTY LOCATED ON THE SOUTH SIDE OF "L" STREET BETWEEN FOURTH AND FIFTH AVENUES FP.OM R-1, R-2 AND R-3-G-P TO R-3-P-14, AND CERTIFYING THE NEGATZVE DECLARATION � WHEREAS, a notice of the proposed negative declaration on the prezoning and rezoning of that certain property located on the south side'�of "L" Street between Fourth and Fifth Avenues from R-1, R-2 and R-3-G-P to R-3-P-14 was given in accordance with the Environ- mental Review Policy, and � WHEREAS , the Environmental Review Committee found that " this project would have no possible significant impact on the environ- ment and forwarded the attached Negative Declaration, IS-76-63, to the City Council of the City of Chula Vista for their consideration, and ' WHEREAS , said Negative Declaration has been available to r agencies having jurisdiction by law, all responsible agencies , and to the public for an adequate period of time for their review and comment, and WHEREAS , the information contained in said negative declar- ation has been considered by the City Council of the City of Chula - Vista prior to its action on the discretionary item before the City Council. NOW, TxEREFORE, the City Council of the City of Chula Vista finds as follows : 1. That the City Council of the City of Chula Vista adopts as its record of this finding of no possible significant impact the � Council agenda statement on this agenda item and all of the attach- ments. thereto. 2. That the City Council of the City of Chula Vista finds in accordance with the recommendation of the Environmental Review Committee and the attached Negative Declaration that the proposed � prezoning and rezoning will not have any possible significant impact on the environment, and the attached Negative Declaration, incorporated herein by reference as if set forth fully, has been prepared in accor- - dance with the California Environmental Quality Act of 1970 , as amended. 3. That the Environmental Review Coordinator is hereby � authorized and directed to file said Negative Declaration with the County Clerk of the County of San Diego subsequent to the prepara- tion of a notice of determination on this project. The City Council of the City of Chula Vista does hereby ordain as £ollows: SECTION Z : That the Zoning Map or P4aps established by Section 19 . 18. 010 of the Chula Vista Municipal Code be hereby amended by adding thereto the following zoning changes: That that certain property consisting of approximately 8. 4 � acres, located on the south side of "L" Street between Fourth and Fifth Avenues be, and the same is hereby prezoned and rezoned from R-1 , R-2 and R-3-G-P to R-3-P-14 in accordance with Planning Commission Resolu- tion No. PCZ-76-L, adopted on the 13th day of September, 1976 , as amended by the following precise plan development standards and guide- lines : - 1 - (1) Maximum building height - Two story, not to exceed 35 feet. (2) Setbacks* - Front and exterior sideyards - 25 feet for one and two. story structures and parking areas . I! � - Rear yard - Single story structures - 15 feet � Two story structures - 35 feet - Side yard - One story structure - 8 feet Two story adjacent to R-1 zone-35 ft. � Two story adjacent to R-3 zone-10 ft. *Single story carports may have zero side and rear yard set- backs . All other accessory buildings shall maintain the required setbacks . ' � (3) The above standards are considered desirable guidelines � which may be increased or decreased on the basis of the following design factor of any proposed project: � a) Orientation of buildings with regard to the property line . T b) Location of windows. ! c) Length of building frontage along a given property line. d) Location and type of structure on the adjacent lot. (4) Usable Open Space � a) 700 sq. ft. of usable open space per unit to be apportioned into private and common open space as follows : Ground floor units - 300 sq. ft. private open space per unit. Second story units - 100 sq. ft. private open space ' � per unit. Remainder as common usable open space . b) Yards abutting a street do not qualify as usable open space . � c) Redevelopment of lots under 10, 000 sq. ft. in area shall be encouraged through combination of adjacent lots and removal of existing structures . Intensification of the development on individual lots under 10, 000 sq. ft. through the addition of a second � dwelling unit shall be prohibited; however, it may be ' permitted provided the architectural treatment of the two units is matched and the site plan provides an integrated complex with offstreet parking and usable open space properly relating to the units. In order to provide proper architectural matching, the existing • structure may also be required to be modified. SECTION II : That any and all ordinances heretofore adopted by the City Council of the City of Chula Vista concerning zoning of said property be, and the same are hereby rescinded insofar as the provisions therein conflict with this ordinance .
