' ' Revised 7-20-76 , ORDINANCE NO. 1699 �� � AN ORDINANCE OF THE CITY OF CHULA VISTA IMPOSING A MORATORIUM ON THE ISSUANCE OF BUILDING PERb1ITS �, AND REZONING LOCATED IN THE INCORPORATED AREA OF I THE CITY OF CHULA VISTA BOUNDED BY NAPLES STREET, ' HILLTOP- DRIVE, ORANGE AVENUE AND INDUSTRIAL BLVD. � KNOWN AS A PORTION OF THE CASTLE PARK AREA OF 1 CHULA VISTA R � WHEREAS , the City Council of the City of Chula Vista has � become increasingly concerned with the possible rapid grocath of high density multiple family construction in both the incorporated '� and unincorporated area generally bounded by Naples Street, Hilltop � Drive, Orange Avenue and Industrial Blvd. , and d WHEREAS, said construction as well as an acceleration of rezoning for-high density multiple family construction is producing � what may be an unwarranted congregation o£ high density developments � in that particular area contrary to established policies of the City ', of Chula Vista as expressed in its General Plan, and , WHEREAS, a petition has been received by the City Council of the City of Chula Vista urging a reevalatuion of the existing ! zoning patterns in said area to avoid the concentration of high : density developments in that area, which concern has been previously , expressed by Ordinance No. 1458, adopted on March 27 , 1973 , and WHEREAS , it is now considered essential that construction in the hereinabove designated area be delayed until such time as the General Plan of the City of Chula Vista has been reviewed and modified by the City Council of the City of Chula Vista. � ' NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Chula Vista as follows: SECTION I : That the moratorium on the issuance of all building permits and rezonings for multiple family units (R-3) be , • and the same is hereby adopted for the incorporated area in the City of Chula Vista bounded by Naples Street, Ailltop Drive, Orange Avenue and Industrial Blvd. , generally knocan as a portion of Castle Park, for a period of ninety (90) days from and after the effective date _ of this ordinance, provided, however, that said moratorium shall be removed at such time as the General Plan is amended and zoning brought � in conformity therewith, if such should occur prior to the ninety (90) day period stipulated herein. It is further provided that any ' projects or subdivisions which have been approved by the City Planning Commission or City Council within the last ninety (90) days shall be exempt from the moratorium. SECTION II: This ordinance shall become effective upon its first reading and adoption if passed by at least four (4) affirma- tive votes of the City Council as an interim ordinance and an emergency measure.
