HomeMy WebLinkAboutOrd 1972-1414 . . , : ORDINANCE NO. 1414 AN ORDINANCE OF THE CITY OF CHULA VZSTA AI�SENDING SECTZON 33 .950 F OF CHAPTER 33 OF THE CHULA VISTA CITY CODE RELATING TO THE CONTROL OF POLITICAL SIGNS The City Council of the City of Chula Vista does ordain as follows : SECTION I : That Section 33. 950� F of Chapter 33 of the �hula Vista City Code be, and the same is hereby amended to read as follows: Sec. 33 .950 . Special Provisions Applying to Signs. F. Political Sign, Control of. 1. Purpose and Intent. It is the intent of this sub- section to exempt political signs from the regulations of this chapter relative to the placement of outdoor advertising signs in all zones of the City, and to thereby encourage participation by the electorate in political activity during the period of political campaigns, but to permit such uses subject to regu- lations that will assure that political signs will be located, constructed and removed in a manner so as to assure the public safety and general welfare and to avoid the creation of a public nuisance caused by the unstinted proliferation of political advertising which would be offensive to the senses and would interfere with the comfort and enjoyment of life or property. It is the purpose of the Council, in adopting this chapter to provide such regulations as will contribute to the public safety and general welfare and insure the right of political expression to all members of the community. 2 . Political Signs Permitted; Subjeet to Regulations. Notwithstanding any other provisions of this chapter, political signs are permitted in any zone listed in the City subject to the following regulations : (a) No political sign shall be located in any agricultural or residential zone in the City (A, R-E , R-1, R-2 and R-3 zones) unless they shall conform to the following regulations : No sign may exceed four (4) square feet in area. Double-faced signs as defined in this chapter may be permitted. Said signs must be posted at least ten feet (10 ' ) from the front property line; pro- vided, further, that in the case of corner lots, said signs must be placed at least ten feet (10' ) from the property lines of the intersecting streets and said signs shall be located at least five feet (5' ) from side property lines. No sign shall exceed three and one-half feet (3-1/2 ' ) in height in the front set- back area, and such signs shall not exceed six feet (6 ' ) in height in any area unless said sign is attached flush to any building. The measurement shall be taken from the ground level to the top of said sign. (b) . No political sign shall be located in any commercial or industrial zone in the City unless they shall conform to the following regulations : No sign may exceed twelve (12) square feet in area. Double-faced signs as defined in this chapter may be permitted. (c) The following regulations shall apply to political signs located in any zone : Political signs may be posted in any zone not more than thirty (30) days prior to the date of an election and shall be removed within ten (10) days immediately thereafter. (d) Procedure for the approval of political signs- (1) The Zoning Enforcement Officer shall notify the following of the political sign requirements as provided herein: Local election - Candidates for local or county office - Chairmen of campaign committees for or against any measure appearing on the ballot for a local or county election State or national office - Candidate for state or national of- fice and/or their local campaign committee chairmen - State chairmen and/or local chair- men of campaign committees for or against any measure appearing on the ballot for statewide election (2) Prior to the posting of any political sign, the candidate , the chairman of a campaign com- mittee or any other person designated by the candidate or chairman who is responsible for the posting of said signs , shall obtain a political sign permit. The permit , on a form prescribed by the Planning Commission , shall include the name , address and phone nisnber of the candidate or campaign chairman and any per- son responsible for the posting of signs , the date on which posting shall commence, the ap- proximate number of signs to be posted, the size of signs to be used and the date which the signs are to be removed. The permit shall be signed by the candidate , chairman or person responsible for the posting of said signs. - 2 - J . . (3) The Zonir.g �nforcement Officer is hereby authorized, after giving 5 days notice to the person or persons who signed the sign permit, • to remove any political signs that do not con- form to the standards herein provided. If the o�aner or occupant of tlie property on whieh the sign is located is presented, the Zoning Enforce- ment Officer shall inform him of the intention to remove the sign and the possibility of the charges for removal of said sign. SECTION ZI : This ordinance shall ta}:e effect and be in �full ' force on the thirty-first day £rom and after its passage and approval.
