HomeMy WebLinkAboutOrd 1972-1409 �, ! . : , • ' • ' � . . - , � ORDINANCE N0. 1409 AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING SECTIONS 22.201 , 22.202 AND 22.315 AND REPEALING SECTIONS 22:203, 22.204 AND 22.316 OF CHAPTER 22 OF THE CHULA VISTA CITY CODE, AND ADOPTING THE 1971 EDITION OF THE NATIONAL ELECTRICAL CODE AS PUBLISHED BY THE NATIONAL FIRE PROTECTION ASSOCIATION. �2 THE CITY COUNCIL Of THE CITY OF CHULA VISTA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION I . That Section 22.201 , 22.202 and 22.315 of Chapter 22 of the Chula Vista City Code be, and the same is hereby amended to read as follows: Section 22.201 . ADOPTION OF NATIONAL ELECTRICAL CODE. There is hereby adopted by the City of Chula Vista for the purpose of pre- scribing regulations governing the installation, repair, operation and maintenance of all electric wiring and electrical apparatus of any nature whatsoever whether inside or outside of any building and issuance of permits and providing for the inspection thereof, that certain code known as the National Electrical Code as published by the National Fire Protection Association, being particularly the 1971 Edition thereof, and the whole thereof, three copies of which code are on file in the Office of the City Clerk of the City of Chula Vista. Section 22.202. REPEAL OF SECTIONS FROM CITY CODE. Sections 22.203, 22.204 and 22.316 of Chapter 22 of the City Code are hereby repealed. Section 22.315. MATERIALS. ' 1 . GENERALLY. All electrical materials, devices, appliances and equipment installed or used shall be in conformity with the provisions of this chapter and with the approved standards for safety to life and property. Previously used materials shall not be reused in any work without the written approval , obtained in advance, from the Director of Building and Housing. 2. APPROVAL. Listing or labeling as conforming to the standards of the Under- �writer's Laboratories, Inc. , of the United States Bureau of Standards or other similar institution of recognized standing, shall be prima facie evidence of conformity with the approved standards for safety to life and property. No electrical material , appliances or equipment that does not comply with this section shall be offered for sale or sold within the City of Chula Vista. SECTION II. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional , such decision shall not affect the validity of the remaining portions of this ordinance, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional . SECTION III. A violation of any provision or the failure to comply with any of the � requirements of this ordinance constitutes a misdemeanor. Any person convicted of such violation or such failure shall be punishable by a fine of not more than five hundred dollars ($500.00) or by imprisonment in the County jail for a period of not more than six (6) months or by both such fine and imprisonment. SECTION IV. This ordinance shall take effect and be in full force on the thirty- first day from and after its passage and approval .
