PLZ-72-L � RESOLUTION OF THE CITY PLANNING C01•i•1ISSION RECOtfd�iu�DI�IG TO THE CITY COUNCIL THE CHANGE OF ZOt�E FOR 4.69 ACRES LOCATED � ON THE ldE$T SIDE OF BROAD'r:AY, SOUTH OF H STREET, FROh1 C-T AND R-3 TO C-T-P WHEREAS, a duly verified application for a change of zone 4+as filed with the Planning Department by Chula Vista Square - Frank M. Goldberg and tditchell P�. Angus on the 19th day of t•tay, 1972, Document Number PCZ-72-L, and WHEREAS, said application requested that a vacant 3.97 acre parcel located on the west side of the 500 block of Broadway, south of "H" Street, more particularly described in said Document, be reclassified from C-T and R-3 to C-T-P, and , WHEREAS, the Planning Department included for consideration of reclassification to C-T-P a 745' X 150' parcel developed with a bank at the northeast corner of - the applicant's property, located on Broadway in the C-T zone, and a 100' X 100' parcel developed with an 8-unit apartment at the northwest corner on Madison Avenue in the R-3 zone, making the total area under consideration 4.69 acres> and , WHEREAS, Chula Vista Square - Frank M. Goldberg and Mitchell N. Angus sub- mitted a precise plan showing the location of thr:e one-story buildings, one to be used for offices and the other two for retail sales, indicating an expansion drive-thru facilities for Southern California First National Bank, and delineating the parking facility and circulation pattern, and WHEREAS, the Planning Comnission set the time and place for a hearing on said application, and notice of said hearing, together with its purpose, was given by the publication in a newspaper of general circulation in the City at least ten days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. , June 5, 1972, Council Chamber, Civic Center, 276 Fourth Avenue, before the Planning Comnission, and said hearing was thereafter closed. NOW THEREFORE BE IT RESOLVED AS FOLLOl95: ' 7 . From facts presented to the Comnission, the Comnission finds that ' public necessity, convenience, general welfare and good zoning practice require • the change of zone from C-T and R-3 to C-T-P for 4.69 acres located on the west side of Broadway, south of H Street, and approval of the Precise Plan ' ' for development subject to the following conditians: a. The entrance from Madison Avenue shall be clearly marked_ to identify the shopping center, to enable motorists to determine they are / entering private property. Jc S • �' � b. A 6' high�n fence shall be erected on the p�ty line between the apartments to the north. � c. The height of the masonry wall on the south and �aest property lines . shall be coordinated o-iith the adjacent ovmers to determine the actual height. The height of the wall shall be relatively constant, with the differences in height to be based on topography. d. A pedestrian access shall be provided from the south segment of Madison Avenue. e. The south segrt�nt of Madison Avenue shall end in a cul' de sac in � accordance with Enyineering Division recommendations. � f. Future buildings shall maintain a 15' setback an Broadway. g. The applicant shall pursue, viith the adjacent owner to the north, ' - installation of alley type returns for the driveway north of the bank building and the driveway on Madison Avenue at the 40' easement. h. The property shall be landscaped in accordance o-iith the Landscaping Manual of Chula Vista. i. The existing utility lines on the property coinciding with the extension of Madison Avenue shall be undergrounded. j. A coordinated sign program shall be submitted at the time of application for a building permit. k. The zoning walls and fences, the cul de sac on Madison Avenue and the undergrounding of the utilities on the property shall all be accomp7ished during the first phase of development. 1. Redevelopment of the existing apartment building on Madison Avenue, for comnercial purposes, will require the submission of a Precise Plan for Planning Coimnission approval . m. A sewer easement shall be granted to the City of Chula Vista in accordance with the accepted standards of the Engineering Division. 2. The findings of fact in support of said determination are as follows: a. The present R-3 zoning would permit only marginal multiple family development and the proposed expansion of the comnercial will be in keeping with the existing comnercial dimensions in the area. The Precise Plan will insure compatibility of the cortmercial development with adjacent residential areas. S a� � � b.
