DATED I, � RESOLUTION PCZ-72-E � RESOLUTION'Of THE CITY PLANNING COMMISSIO"J RECOPu4EDING TO THE CITY COUWCIL THE CfIAfdGE OF ZONE FOR APPROXIPiATELY 2.15 ACRES IN THE 200 aLOCK tJORTH SIDE OF PALOhiAR FR0�1 R-3 to C-C-P I WHEREAS, a duly verified application for a change of zone was filed with the Planning Department by 6art Corporation and County Properties on the 28th day of February, 1972, Document tJo. PCZ-72-E, and WHEREAS, said application .requested that approximately 2. 15 acres fronting on Palomar Street, east of Third Avenue, more particularly described in said Document, be reclassified from R-3 to C-C-P, and 4JHEREAS, Bart Corporation and County Properties submitted a Precise Plan incorporating the development of this property with a 3.9 acre parcel adjacent on the north and having frontage on Third Avenue and Kennedy Street, and WHEREAS, the Planning Commission set the time and place for a hearing on said application, and notice of said hearing, together �aith its purpose, eias . given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and 6!H[REAS, a hearing �aas held at said time and place, namely 7:00 p.m. , April 3, 1972, Council Chamber, Civic Cenier, before the Planning Commission, and said hearing was thereafter closed. NOId THEREFORE BE IT RESOLVED AS FOLL04J5: � 1 . From facts presented to the Cortmission, the Commission finds that public necessity, convenience, general �•relfare and good. zoning practice require the change of zone from R-3 (multiple family residential ) to C-C-P (central �commercial with precise plan) for 2.15 acres in the 200 block en the north side of Palomar. The� Commission further finds that the Precise Plan submitted by Bart�Corporation for commercial development of this property together with the i 3.9 acres adjacent to the north meets the requirements specified in the "P" Modifying District and the Planning Commission approved said plan. 2. The findings of fact in support of said determination are as follows: a. The increase in depth of the present conmercial zoning area is consistent 4+ith the General Plan's goal and objective to�aard elimin- atio� of strip commercial zonin9 and the expansion of existing commercial centers. b. The attachment of the "P" Modifying District to the C-C zoning and development in accordance with the Precise Plan submitted • will .insure compatibility with adjacent areas and uses. � � ' . . � � . 3. The Planning Corrunission recommends to the City Council that said � zone change be granted. 4. That this resolution be transmitted, along with the application to the City Council , and a copy of tnis resolution shall be transmitted to the applicant.
