RE"LOrIZNG TI�11T CliI2TAIt1 PRGPERTY LUCIIT�D AT �62 "K" STItE�T FRO.^I R-3-G-U AND C-T-D `PO C-T-P The City Council o� the City of Chula Vista does hereby ordain as follows : SECTION I : That the Zoning Diap or Maps , established by Section 33. 40� of the Chula Vista City Code be hereby amended by adding thereto the following zoning changes : That tha*_ certain property ].ocated at 562 "K" Street presently zoned R-3-G-D and. C-T-D be, and the same is hereby rezoned to C-T-P in accordance caith conditions imposed by Planning Com,:.ission Resolu�ion No . PCZ-72-D, adopted on the 20th day of �:arch, 1972 pursuant to the provisions set forth in Section 33 . 1201 governing the r.ezoning of property . � In addition to those conditions imposed by said resolution, the City Council rea,uires the follo�aing concepts be incorporated into the design control and precise plans adopted by this ordinance: a) A solid nasonry wall six fee.. (6 ' ) high shall be constructed along the northerly line of the easterly 125 ' of the property and the proposed masonry wall along the easLerly line shall be raise3 to a height of eight feet (8 ' ) . b) Landscaoing shall be orovided alona the northerly wall of the property in a manner approved by the � Planning Department to insure a more aesthetic and � pleasing vista for the surrounding residential neighborhood . c) The new service buildings shall be , insofar as ' possible, reoriented so that they shall open to the south only . d) Detailed construction plans , including landscaping features , shall be presented to the City Council for approval _prior to the issuance of any building permits . SECTION II : That any and all ordinances heretofore adopted b}> the City Cou�lcil of the City of Chula Vista concerning zoning of said property be, and the same are hereby repealed insofar as the grovisions therein conflict with this ordinance . SECTIOV III : This ordinance shall take effect and be in force on the thirty-first day from and- after its passage and approval . I � • • RESOLUTION N0. PCZ-72-D � , RESOLUTION OF THE CITY PLANNING COh1MISSION RECOMMEt�DING � . TO THE CITY COUNCIL THE CHAtJGE OF ZOIJE FOR 562 K STREET . FROM R-3-G AND C-T-D TO C-T-P WHEREAS, a duly verified application for a change of zone was filed with the Planning Department on 3rd day of March, 1972, Document Number PCZ-72-D, and . WHEREAS, said application requested that the property located at • 562 K Street, more particularly described in said Document, be reclassified from R-3-G and C-T-D zone to C-T-P zone, and - WHEREAS, the Planning Comnission set the time and ptace for a hearing on said application, and notice of said hearing, together with its purpose, was given by the publication in a newspaper of general circulation in the City at least ten days prior to the date of said hearing, and - - WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. , March 20, 1972, Council Chamber, Civic Center, before the Planning Commission, and said hearing was thereafter closed. � t�OW THEREFORE BE IT RESOLVED AS FOLLOWS: l. From facts presented to the Cortunission, the Canmission finds that public necessity, convenience, general welfare and good zoning practice require the change of zone from R-3-G and C-T-D to C-T-P for property located at 562 K Street as delineated on� attached plat, and the change of setback from 15 feet and 10 feet adjacent to K Street to 0. Development of the property shall be in accord- ance with the Precise Plan approved by the Planning Commission and on file in the Planning Department. � i2. The findings of fact in support of said determination are as follows: a. Good zoning practice requires the deepening of existing com- mercial usage to minimize the drawbacks of strip comnercial develop- ment and promote the clustering of commercial uses. The "P" ihbdifying District assures.control of the intended use which will - become a better buffer between adjacent uses than currently exists. b. This change is in conformance with the General Plan since it encourages the deepening of existing strip canmercial development as recommended in the Plan. This chan9e will satisfy the Plan's recoimnendation for increasing the efficiency of existing commercial uses. ' -1- \ �� � . � 3. The Ptanning Cortmission recorrmends to the City Council that said ' reclassification be granted. 4. That this resolution be transmitted, along with the application to the City Council, and a copy of this resolution shall be transmitted to the applicant.
