HomeMy WebLinkAboutOrd 1972-1386I ORDINANCE N0. 1386 AN ORDINANCE OF THE CITY OF CHULA VISTA AFIENDING SECTION 22.325 OF CHAPTER 22 OF THE CHULA VISTA CITY CODE RELATING TO ELECTRICAL FEES. THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, DOES ORDAIN AS FOLL041S: SECTION I . That Section 22.325 of Chapter 22 of the Chula Vista City Code be, and the same is hereby amended to read as follows: Section 22.325. FEES FOR PERMITS AND INSPECTIONS. A. FEES; GENERALLY. The fees prescribed in this section shall be paid to the City of Chula Vista for each electrical installation for which a permit is required by this section and must be paid before any such permit is issued, except as here- inafter provided. Whenever it shall be necessary to make an extra inspection trip because the applicant for any permit gives an incorrect address or wrong location in obtaining a permit required by this article, an additional fee of tvro dollars ($2.00) shall be paid for correcting the address of the location given in such permit. For each inspection trip made necessary by reason of deficient or defective work, a fee of three dollars (�3.00) MAY be required to be paid by the permittee. B. PERMIT FEE. There shall be a fee of two dollars ($2.00) for each permit issued, which fee is not refundable, in addition to the fees set forth in this section. C. FEE SCHEDULE FOR ISSUING EACH PERMIT � 2.00 New construction, for each ampere of main service, switch, fuse or breaker .25 New service on existing building, for each ampere of increase in main service, switch , fuse or breaker ,25 Remodel , alteration, no change in service, for each ampere of increase .25 Temporary service up to and including 200 amp. 5.00 Temporary service over 200 amp. , per 100 amp. 10.00 Minimum permit fee 5.00 * NOTE: ampere rate shall apply to the secondary side of the transformer or transformers. In addition to any other penalty provided in this Code for violations thereof, any person who has done electrical work without a permit as required by this section, � or who has caused any such work to be done without a permit, may be required to pay a fee of ten dollars ($10.00) in addition to the regular permit fee for inspection of such work. - SECTION II . If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional , such decision shall not affect the validity of the remaining portions of this ordinance, irrespective of the fact that any one or more sections, subsections, sentences , clauses or phrases be declared unconstitutional . SECTION III . A violation of any provision or the failure to comply with any of the requirements of this ordinance constitutes a misdemeanor. Any person convicted of such violation or such failure shall be punishable by a fine of not more than five `� hundred dollars (5500.00) or by imprisonment in the County jail for a period of not more than six (6) months or by both such fine and imprisonment. SECTION IV. This ordinance shall take effect and be in full force on the thirty-first day fr.om and after its passage and approval . RESOLUTION N0. 37 RESOLUTION OF THE CITY BOARD OF APPEALS RECOP1MENDING TO THE CITY COUNCIL THE ADOPTION OF AN ORDINANCE AMENDING SECTION 22.325 OF CHAPTER 22 OF THE CITY CODE RELATING TO ELECTRICAL FEES IdHEREAS, in keeping with the mandate of the City Council to obtain uniformity of codes throughout San Diego County, and WHEREAS, the present method of computing electrical permit fees is complicated and costly both to the City and the contractors , and IJHEREAS, the National Electrical Contractors ' Association appealed to the San Diego Chapter of International Conference of Building Officials to simplify the method of determining electrical fees , and WHEREAS, electrical permit fees have remained at the same level since May 1969, and WHEREAS, the Board of Appeals held a hearing on Monday, January 10, 1972, NOW THEREFORE BE IT RESOLVED AS fOLLOWS: 1 . From facts presented to the Board of Appeals, the Board finds that the necessity for a simplified method of establishing fees and promoting uniformity is beneficial to both the City and the electrical contractors. 2. The Board of Appeals recortmends to the City Council that said amendment to Chapter 22 of the City Code be adopted. PASSED AND APPROVED BY THE CITY BOARD OF APPEALS OF CHULA VISTA, CALIFORNIA, this lOth day of January, 1971 , by the following vote to-wit: AYES: Members Welsh, Ramm, Johnson, Offerman, Rayburn and Riba NOES: None ABSENT: Member Baity (Proposed Ordinance attached) � �
