ORDINANCE NO. 1498
AN ORDINANCE OF THE CITY OF CHULA VISTA_ AMENDING
CHAPTER 5 , ARTICLE 2 , SECTION 5 . 206 , AND CHAPTER 6 ,
ARTICLE 3 , SECTION 6 . 302 OF THE CHULA VISTA CITY
CODE RELATING TO LICENSE REQUIREMENT FOR AUCTIONEERS
AND REQUIRENIENTS FOR CONDUCT OF AUCTIONS
The City Council of the City of Chula Vista does ordain
as follows :
SECTION I : That Chapter 5 , Article 2 , Section 5 . 206 ,
subparagraph 3 of the Chula Vista City Code be, and the same is hereby
amended to read as follows:
Sec. 5 . 206 . Attendance of Police Officer.
3. Reimbursement of City. The person whose merchandise
is being sold at public auction or the operator of any auction
house shall reimburse the City an amount egual to the salary
and incidental costs of any on-duty policeman assuming such
duties, payable in advance, for each day such member of the
Police Department is in attendance at such public auction.
SECTION II: That Chapter 6 , Article 3 , Section 6 . 302 ,
subparagraphs A and B of the Chu1a Vista City Code be, and the same
are hereby amended to read as follows:
Sec. 6 . 302 . Auctions and Auctioneers.
A. License Requirements. Zt shall be unlati�ful for any
person, either for himself or as agent, clerk or employee,
• or for any other person, within the corporate limits of
the City to engage in or carry on the pursuit, trade,
occupation, employment or business of auctioneer, or to
hold any auction or auction sales or to operate or to
maintain any auction house, unless he shall first obtain
a license therefor as required by the provisions of this
chapter. No license shall be granted to a public auctioneer,
nor shall a Class A license be granted, unless it shall
appear that the applicant is a person of good moral character
and reputation as determined by the investigation provided
herein, and such application must be accompanied by a bond.
B. AppZications; GeneraZZy. License applications shall
be verified under oath. In addition thereto, each applicant
shall specify the location of his last place of business ,
and the name and character of such business , length of time
he was engaged therein, and the names and addresses of three
(3) persons as references .
SECTION III : This ordinance shall take effect and be in
full force on the thirty-first day from and after its adoption.
