PCZ-73-K \ RESOLUTION OF THE CITY PLANNING CONMISSION RECOMME�JDING TO \ THE CITY COUNCIL A CHANGE Itd ZOfVING FROM R-1 AND C-T TO C-T-P FOR PROPERTY AT 658-664 BROAD!•!AY WHEREAS, a duly verified application for a change of zone �aas filed with the Planning Department by Jon D. Beaman on July 17, 1973, Document No. PCZ-73-K, and IJHEREAS, said application. requested a change in zone for a strip of property measuring 8' x 1_20' located at the rear of 658-664 aroadway from R-1 to C-T-P, and WHEREAS, the Planning Department included for consideration the attachment of the "P" Precise Plan tAodifying District to the existing 60' x 120' C-T zoned area fronting on Broadviay, and - . IJHE�EAS, the Planning Commission set the time and place for a hearing on said application, and notice of said hearing, together with its purpose, rras given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WNEREAS, a hearing was held at said time and place, namely 7:00 p.m. , August S, 1973, Council Chamber, Civic Center, before the Planning Cortenission and said hearing was thereafter closed. . NOW THEREFORE BE IT RESOLVED AS FOLLOWS: , 1 . From facts presented to the Commission, the Com�nission finds that public • necessity, convenience, general welfare and good zoning practice require the change o� zone from R-1 and C-T to C-T-P for property measuring 68' x 120' located at 658-665 Broadaiay, based upon the submission of a precise plan which shall include the follo�aing: a. Orientation and access to the property shall be to Broadway only. No vehicular access shall be permitted to East Manor Drive, either for custo�;.ers or service vehicles. - b. A zoning wall shall be constructed at the rear of the property, along the western boundary of the 8 ft. strip. c. A 14 ft. exit only drive�aay shall be provided adjacent to the north property line. Since the building enjoys a zero setback, proper sight distance for cars exiting from this driveway shall be reviewed and approv:d by the City Traffic Engineer prior to the issuance of a building permit_for � the structure. � d. Details of signs and landscaping (including,street trees) shall be subinitted at the time building permits are requested. \ , e. The building area shall relate to the number of offstreet parking � spaces provided. f. A �plan to refurbish the existing dwellings at 659 and 663 E. htanor Drive (adjacent to the rezoned property) shall be submitted to the Planning � Department for revieo-i and implementation. 2. The change of zone shall be null and void if a precise plan for develop- ment is not submitted �•�ithin orie year after approval by the City Council . If no precise plan for development is received within one year, the Planning Commission shall set a public hearing to consider rezoning the 8 ft. strip back to R-1 . 3. The findings of fact in 'support of said determination are as folloo-�s: a. The existing C-T zoning depth of 60 feet is not adequate for the . construction of a commercial facility with the required offstreet parking imposed by tfie City. b. The inclusion of the "P" Precise Plan Modifying District on the total comnercial development will provide adequate control of buildirg locations to insure that the general welfare of adjoining residences is protected. , . . c. The General Plan of the City of Chula Vista does not specify an exact dimension for comnercial depth in this area; the General Plan designates this area of Broadway for commercial purposes and this change would be in basic conformance with that plan. 4. The Planning Commission recomnends to the City Council that said changes be granted. � • 5. That this resolution be transmitted, along with the application to the City Council , and a copy of this resolution shall be transmitted to the applicant.
