PCM-73 RESOLUTION OF THE CITY PLAtJNING COMt•IISSION RECO��u•1EfvDING TO THE CITY COUtJCIL A REVISION TO THE GEtJERAL PLAN FOR APPROXII�IATELY ONE ACRE LOCATED AT 215 BAY BOULEVARD WHEREAS, the City of Chula Vista has an adopted General Plan, and 4�HEREAS, State laYr requires that zone designations of property conform to the General Plan, and � k'HEREAS, Haugh/Richards/l•leber requested consideration of a change in the General Plan to accommodate a rezoning from I to C-V-P for approximately one acre located at 215 Bay Boulevard, and � WHERFAS, the Planning Commission set the time and place for a hearing to consider revision of the General Plan, and notice of said hearing, together with its purpose, �aas given by the publication in a ne�aspaper of general circulation - in the City at least 10 days prior to the date of said hearing, and 4lHEREAS, a hearing �•�as held at said time and place, namely 7:00 p.m. , May 7 and May Zl , 19.'3 in the Council Chamber, Civic Center, before the Planning Commission and said hearing �•ias thereafter closed. NOW THEREFORE BE IT RESOLVED AS FOLL041S: • 1 . From facts presented to the Cortanission, the Commission finds that public necessity, convenience and general �aelfare require the adoption of an amendment to the General Plan to change from Industrial to Visitor Cormiercial the designa- tion for approximately one acre located at 215 Bay Boulevard. 2. Findings of fact in support of said determination are as follows: a.The proposed amendment to the General Plan is in conformance with the Bayfront Plan submitted by consultant Sedway/Cooke. b. The site is located adjacent to the freeway interchange at a major entrance to the City and is well suited for visitor co�mnercial use. 3. • The Planning Commission recorronends to the City Council that said amend- ment to the General Plan be adopted. 4. That this resolution be transmitted �o the City Council . The parking lot shall be depressed to an elevation which will allow for proper drainage of the property. h. The architecture, including materials, colors. and signing shall be submitted and approved by the Commission and Council before the issuance of a building permit. . i . All existing and proposed utility lines and structures onsite (including area within the public right of way to the center line of E Street and Bay Boulevard) shall be placed underground. j. The applicant shall submit drawings based upon field surveys showing a practical method of sewering the area in which the site is located. k. Driveway access to the site shall be of the alley approach type. 1 . Adjacent street frontages are to be fully improved to current City . standards. 2. PCZ-73-I � _ RESOLUTION OF THE CITY PLANNIP�G COFiMISSION REC0��1P1ENDING TO THE CITY COUNCIL THE CHANGE OF ZONE FOR APPROXI��TELY ONE ACRE LOCATED AT 215 BAY 60ULEVARD FROI4 I TO C-V-P WHEREAS, a duly verified application for a change of zone was filed with . the Planning Department by Haugh/Richards/l•leber, A. I .A. for Harding Campbell , owner, on April 6, 1973, Document No. PCZ-73-I , and WHEREAS, said application requested that one acre located at 215 West Bay Boulevard be reclassified from I (Industrial ) to C-V-P ( Visitor Commercial subject to a Precise Plan), and � WHEREAS, the Planning Commission set the time and place for a hearing on said application, and notice of said hearing, together aiith_ its purpose; was i given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing �aas held at said time and place, namely 7:00 p.m. , May 7, 1973 and May 21 , 1973, in the Council Chamber, Civic Center, before the Planning Commission, and said hearing was thereafter closed. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1 . From facts presented to the Cormnission, the Comnission finds that public necessity, convenience, general �•ielfare and goed zoning practice require that the moratorium restricting rezoning and development of property within the Bayfront Study area be lifted for subject property, and the zone designation be changed from I to C-V-P, with a Precise Plan to be submitted which shall conform to the following guidelines : a. There shall be no direct access to E Street from the property. �b. A 4-foot high landscaping berm (minimum 15 feet in width) shall be . provided along the E Street and Bay Blvd. frontages. c. The height of the building shall be limited to 28 ft. d. There shall be no business identification signs permitted that are intended to be vie�aed by motorists on Interstate 5. e. Signs on the building shall be located at a height no greater than 12 feet and shall occupy less than 5% of the building facade on which it is placed. � f. A freestanding sign on Bay Blvd, shall not exceed 8 feet in height or 8 feet in length and shall not have a surface on any one side larger than 32 sq. ft. �i� �
