AN ORDINANCE OF THE CITY OF CHULA VISTA �1MENDING SECTION
34.201 OF ARTICLE 2 OF CHAPTER 34 OF THE CHULA VISTA CITY
CODE RELATZNG TO THE UNDERGROUNDING OF PUBLIC UTILITIES
FOR ALL NEW STRUCTURES IN THE CITY OF CHULA VISTA
WHEREAS, the City Council of the City of Chula Vista has
heretofore adopted requirements for the undergrounding of public
utilities in residential and commercial zones for all new structures
to be so undergrounded within the existing boundaries of such new
developments, and
WIIEREAS, it is now apparent that in addition to said resi-
dential and commercial zones, developments in industrial zones , which
under the existing ordinances of the City, are not required to under-
ground public facilities should also make an equal contribution to
the problems of health, safety and general welfare and visual pollution,
and
WHEREAS, industrial development projects are presently being
contemplated which, in the absence of legislation prohibiting overhead
utilities and requiring the undergrounding of said utilities , will
materially affect said health, safety and general welfare and visual
pollution qualities of the community unless the City Council acts upon
such matters as an emergency measure.
NOW, THEREFORE, the City Council of the City of Chula Vista
does hereby determine to adopt the necessary ordinance to impose
regulations upon industrial as well as residential and commercial
zones .
SECTION I : That Section 34 ,201 of Article 2 of Chapter 34
of the Chula Vista City Code be, and the same is hereby amended to
read as follows :
Sec. 34 . 201. Undergrounding Requirements.
All structures or buildings constructed in residential,
commercial or industrial zones in the City of Chula Vista
shall , within the exterior boundary lines of such property,
have all electrical, communication, C.A.T.V, and similar
distribution, service wires , and/or cables placed under-
ground. The owner is responsible for complying with the
requirements of this article and shall make the necessary
arrangements with each of the serving utilities for the
installation of such facilities.
SECTION IZ : This ordinance shall become effective upon its
first reading and adoption if passed by at least four (4) affirmative
votes of the City Council as an emergency measure.
