HomeMy WebLinkAboutOrd 1972-1434 I ORDINANCE NO. 1434 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADDING TO CHAPTER 18 OF THE CHULA VISTA CITY CODE A NEW SECTION 18. 73 RELATING TO THE LICENSING OF ALL PERSONS ENGAGED IN THE BUSINESS OF SELLING SUBSCRIPTIONS FOR PAY TELEVISION The City Council of the City of Chula Vista does hereby ordain as follows : SECTION I : That Chapter 18 of the Chula Vista City Code is hereby amended by adding thereto a new Section 18.73 to read as follows : Sec. 18 . 73 Pay Television - Licensing Fees. All persons engaged in the business of transmitting by means of the lease of a frequency or frequencies from the grantee or grantees of Community Antenna Television Systems or cable systems, a signal providing a television picture to subscribers thereof for the payment of a fee, shall obtain a business license in accordance with the requirements of this Chapter. Such persons engaged in the business known as "pay television" , whether they have a fixed place of busin- ess within the City of Chula Vista or not, must obtain such a business license. Such persons conducting, managing or carrying on such pay television businesses shall pay a license fee of two hundred fifty dollars per annum and, in addition thereto, shall pay the sum of five percent of the total gross receipts derived from the operation of said business in each calendar year or portion thereof during the period for which they are licensed. Checks for all such payments, in addition to the basic license fee, shall be made pay- able to the Director of Finance of the City of Chula Vista and shall be submitted to him semi-annually on each February first and August first. Each payment shall be accompanied by a statement, in duplicate, verified by the lessee, or by a general officer or other duly authorized representative of the lessee, showing in such form and detail as the City Manager may require from time to time the facts material to determination of the amount due. �The City at all times shall have the right to compel an audit of any and all books and financial records of the lessee for the purpose of determining the gross receipts of the lessee derived from the operation of his business within the City of Chula Vista. SECTION II : A violation of any provision or the failure to comply with any of the requirements of this ordinance shall constitute a misdemeanor. Any person convicted of such violation or such failure shall be punishable by a fine of not more than $500.00 or by imprison- ment in the County jail for a period of not more than six months, or by both such fine and imprisonment. SECTION IZI : This ordinance shall take effect and be in full force on the thirty-first day from and after its passage and approval. Presented by Approved as to form by � , � . Georg D.
