AN ORDINANCE OF THE CITY OF CHULA VISTA ADOPTING
INTERIM PROCEDURES FOR FILING AND PROCESSING OF
ENVIRONMENTAL IDIPACT REPORTS
WHEREAS, the City of Chula Vista, as well as all other
municipalities , have, as a result of the Supreme Court decision in
the case of Friends of Mammoth v. Board of Supervisors of Mono
Count , and t e ailure of t e Legislature to provide su stantive
guidelines for the processing of environmental impact reports for
private projects as required by said decision, been forced to evolve
in the most expeditious manner, a program of evaluating and judging
the environmental impact of all projects, and
WHEREAS, there are a substantial number of private projects
presently being delayed because of the lack of procedures and guide-
lines for such evaluation.
NOV7, THEREFORE , it is the desire of the City Council of the
City of Chula Vista to establish an interim procedure by emergency
ordinance to be adopted by a 4/5 vote of the City Council , to read
as follows:
Section 1. Purpose and Zntent .
It is the purpose of the City Council in adopting this
emergency ordinance to establish on an interim basis , pro-
cedures for the processing of environmental impact reports.
Recognizing that changes will necessarily be made based
upon both legislative directive and experience with pro-
cedures locally adopted. It is the intent of the Council
to expedite the processing of private projects , which have
presently been delayed because of the lack of such pro-
cedures.
Section 2 . Environmental Review Committee Established.
There is hereby established an Environmental Review Com-
mittee composed of the following primary and alternate
members :

Said committee shall have the power and duty to review and
evaluate the environmental impact of all projects both
public and private in the City of Chula Vista. The com-
mittee shall approve forms and reporting formats as well as
the total environmental review procedure.

Section 3 . Environmental Review Coordinator Established.
There is hereby established the position of Environmental
Review Coordinator, who shall act as a staff support for
the Environmental Review Committee and whose powers and
duties would be as follows :
1. Operating systems and procedures control-coordination.
2. Project status monitoring.
3. Orientation of Departmental Counter Review staff as
to categorically trivial classifications.
4 . Control of fees and deposits collected, including
cost records.
5. Follow-up on appeals.
6. Follow-up on public and Environmental Control Com-
mission notices.
7. Assist or advise anyone as to complaints on the
system or on the processing of any project.
8. Prepare agenda, materials, and write up findings
for the Environmental Review Committee (ERC) .
9 . Personally analyze and coordinate analysis of the
draft EIR with the ERC, the public, the Environmental
Control Commission , the Planning Commission, outside
agencies, and consultants.
10. Draft the finished EIR.
11. Coordinate City processing efforts with counter-
parts in other agencies.
12. Keep abreast of legal changes and/or requirements
af£ecting the City.
13 . Consult with the City Manager on all matters of
unique circumstances or major significance for
administrative direction.
Section 4. Environmental Forms and Reports Required.
A. Categorically Trivial.
The City Council shall , after conducting a public hearing,
from time to time establish categorically trivial listings
of projects, which projects shall be considered as exempt
from the environmental review process in order to produce
a more efficient operation of this system.
B. Environmental Assessment Form.
Zncluded in the system procedure is an Environmental
Assessment Form (EAF) which can also serve, if appropriate,
as a "negative declaration" regarding environmental impact.
This will serve to describe the project in terms of environ-
mental impact by problem identity, and applicability for a
"categorically trivial" classification.

C. Environmental Impact Report.
To simplify development of an Environmental Impact
Report by the City, an Environmental Zmpact Report format
shall be developed and approved by the Environmental Review
Committee and supplied to applicants to assist in the pre-
paration of the draft which will conform on the basis of
the City' s Environmental Impact Report.
Section 5. Environmental Form and Report - Fees
Established.
In order to defray the coordination and analysis costs
incurred by the City, the following fees are hereby
established:
A. Filing of Environmental Assessment Form $ 50
B. Filing of Environmental Impact Report (draft) $200
C. Major projects , i.e. , Sports World, would be re-
� guired to pay, in addition, a deposit to cover the
estimated costs of extended staff services. These
charges against a deposit would be per records of
direct City costs incurred with a minimum fee being
the basic $200 amount.
Section 6 . This ordinance shall become effective upon its
first reading and adoption if passed by at least four (4) affirmative
votes of the City Council as an interim ordinance and an emergency
measure.
