HomeMy WebLinkAboutOrd 1972-1429 � ORDINANCE NO. 1429 AN ORDINANCE OF THE CITY OF CHULA VISTA ESTABLISHING THOSE PROJECTS THAT ARE CATEGORICALLY TRIVIAL AND NON-SIGNIFICANT FOR PURPOSES OF ADMINISTERING THE ENVIRONMENTAL QUALITY CONTROL ACT OF THE STATE OF CALIFORNIA WHEREAS, _in establishing procedures for the implementation of the Environmental Quality Control Act of the State of California, the City Council desires to adopt an ordinance setting forth those projects which will be presumed to be categorically trivial and, therefore, would not require the submission of an environmental impact report prior to approval by the City of Chula Vista. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Chula Vista as follows: � SECTION I : That the following projects shall be deemed to be categorically trivial and the administrative departments issuing permits therefor shall be as follows : I. Planning Department A. Public Projects 1. General Plan review or modifications. 2 . Departmental projects which result in planning reports or recommendations only, and do not lead to construction. B. Private Projects 1. Projects for which an environmental assessment (E.A. ) or environmental impact report (E. I.R. ) has been filed and approved within the last two years. 2 . Rezonings and prezonings which reduce the resi- dential density allowed or reduce the intensity of the land use. 3. Projects which eliminate nonconforming uses or . which upgrade nonconforming uses in cbmpliance with City regulations. 4. Variances which will not result in increased traffic generation, or in increased demand on community services. 5 . Conditional Use Permits, for a change of use within the existing structure where there will be no physical alteration of the site or structure. 6 . Home Occupation Permits, for occupations carried on entirely within the dwelling unit and not involving any manufacturing processes. 7. Zoning Permits, for any requests which do not involve a change in the permitted use of the structure or site. 8.. Additions to and remodeling or repair of existing single family dwelling units. � ' - 1 - 9. Remodeling or repair of existing multi-family dwelling units, commercial, industrial or institutional establishments, which does not involve additions to existing structures. 10. Signs which conform to the Zoning Ordinance. 11. Parcel maps which do not involve construction (for example, the deeding of a lot to another owner) . 12. Fences, walls, or retaining walls. 13. Landscaping projects in any zone. 14. Permits for the construction of a new detached single family residential structure to be built in the urbanized area west of Interstate 805 to Interstate 5 , provided that the owner of the lot upon which construction is to occur owns no contiguous undeveloped property. II. Public Works Department � A. Public Projects 1. Maintenance or repair of existing equipment and facilities , including but not limited to, roads, streets and alleys, sewers, drainage facilities, and landscaping. 2. City contracts for public works projects which do not exceed $20 ,000. B. Private Projects 1. Curb and sidewalk permits. 2. Sewer connection orders. 3. Permit to store material in street. 4 . Encroachment permits. 5. Driveway painting permits. 6 . Tree plantings or removals. 7 . Undergrounding of utilities which are installed only to serve property which does not require the extension of utility transmission lines. 8. General street construction permit for one and two family dwellings and for street construction when done with approved building permits, cate- gorically exempted permits or when required by the City for private development for which an environmental assessment has been prepared. 9. Permits for moving extra width loads or for overload vehicles. 10 . Grading permits when the average cut or fill is less than 3 ' , no cut or fill is in excess of 10 ' and total graded area is less than 1/2 acre or less than 2 , 000 cubic yards. 11. Drainage pezmits for local drainage which is defined as draining an area of less than 100 acres. _ 14. Emergency measures taken by the Public Works Department to protect persons and property in Chula Vista. III. Building and Inspection Department A. Public Projects - Not Applicable B. Private Projects 1. Plumbing permits. 2. Electrical permits. 3. Mechanical permits. 4 . Miscellaneous: a. Swimming pools. b. Patios c. Permits or entitlements which are incidental to projects which are exempt from the environ- mental review process or for which an E.A. or E. I.R, has been approved. d. Permits or entiticments on projects for which an E.A, or E. I .R. has been approved within the last two years. IV. Parks and Recreation Department A. Public Projects 1. Landscaping projects which do not involve con- struction of capital improvements. 2 . Maintenance or contracts for maintenance of existing parks and recreational facilities. 3. Recreation programs using existing facilities. B. Private Projects - Not Applicable V. Purchasing Department A. Public Projects 1. City contracts for the purchase. of supplies and materials. B. Private Projects - Not Applicable VI. Finance Department A. Public Projects - Not Applicable •. - 3 - ��� 1 B. Private Projects 1. Business licenses , provided that the associated land uses have, if required, been properly approved through the environmental review process. 2. Dog licenses. 3. Garage sales. VII. General Permits or Entitlements A. Public Projects B. Private Projects 1. Parade permits. SECTION II : This ordinance shall take effect and be in full force on the thirty-first day from and after its approval.
