This office has been retained bv the Bella Sol HOA in reeard to certain aspects of
the proposed construction of a parkine structure; lighted to���er and loop road before the
Council on Tuesday. Of critical importance is the staff recommendation to Council that
the project is exempt from the requirements of CEQA. Our re��ie��� has concluded that
csanet likely be suppo*ied. Ho�ve��er, �ve cannot full�� analyze this because the reports
upon �vhich staff is relyin� have not been made public despite the fact that the hearin� is
scheduled for tomorro�v.
Specificall}�, late in the da�� last Thursday, staff released re��ised documents that
purported to address the CEQA e�emption position of staff. Reference is made in those
documents to t�co "technical letters" upon �ahich staff relies hea��il}�, which reports
apparently ���ere finished and dated only tha[ same day, April 10. Ho���ever. to our
kno���ledge, the reports �vere not attached or othen��ise made available to the public. The
Clerk`s office confirmed to m�� client that it did not ha��e those documents either. r1nd, to
make matters �rorse. the Cit�� offices weie, of course. dosed last Frida��.

This office is representing the Bella Sol Homeo���ners Association, the residents
oC which li��e immediatel�� to the northeast of the proposed parking strucmre and to��er
and adjacent to a ponion of the proposed loop road. CEQA requirements ha��e not been
met for this project and the Council should not proceed until the}� are met. The short
��ersion of the problems ���ith the staff conclusion that the project is e�empt from CEQA
is as follo��s:
Code of'Regulations Sections 15300.2: Exceptions to Categorical Esemptions.
Staff has based this conclusion on the provisions of section 1�332 of the State
CEQA Guidelines (Cal Code of Re�ulations; sections 1�000. et. seq.), referred to as `�the
infill exemption." Ho���e��er, the official comments to that section pro��ide: "Application
of this Section, as all categorical ezemptions, is limited by the factors described in section
1>300.2." At least h�o of the limitations in section 1�300.2 are applicable in this matter
and aze deemed to be exceptions to the "infill ezemption":
"(b) Cumula[ive Impact: All esemptions for these classes are inapplicable �vhen
the cumulati��e impact of successive projects of the same type in the same place, o��er
[ime. is sianificant."

1'ou ���ill hear from manv neiahbors of the possibilitti� of impacts due to noise and
air quality from the location of the loop road ���ith thousands of trips per day no��� located
next to the residential nei�hborhood. And. ��ou ��ill hear about their concerns reeazdin�
shado���ine from a structure that is desiened to be nearl�� three times the heieht allowed in
this zone and located to the south�vest of their homes. 1'ou �i�ill also hear about concerns
of noise from car alarms in this concrete structure to be located rieht above their homes
and from the noise created by locatine the ele��ator equipment in the air rather than on the
eround ���ithin the hospital property. Impacts from the liehting of the to�ver are additional
concerns to these residents. CEQA requires that these impacts be studied and alternative
desiens be considered such as construction ���ithin a reasonable de��iation from the heisht
of the e�isting buildines and locating the equipment on the eround to eliminate this huee
to�ver. �
Both of these provisions of section 1�300.2 are applicable as the impacts from the
development of the hospital campus is most certainl�� cumulative. Funher. althoueh the
uniqueness of this project is obvious, the "uniqueness" referenced in subsection (c) is
expressh� ackno��ledged by Cin� staff in the revised Ordinance laneuaee: "The intent of
the precise plan. as described in CV�4C 19.�6.041. is to allo��� reeulatory flexibility in
instances �vhere the site has :u7iqire n�n�ibutes cutd re9uires specrn(hancllutg."
(Ordinance, p.3, lines 7-9). The infill e�emption may not be relied upon ��hen either of
these cases presents itself, as here.
Inapplicabilih• of Section 15332.
The De��elopment Services A9emo of April 10 is also in error in that it concludes
that the project is consistent ���ith the General Plan and the applicable Zonine Ordinances.
The current zonine applicable to this propert�� allo���s onl}� 4� feet in heieht. Thus, ��hen
the rezaiing and eeneral plan studies ���ere completed; that is «�hat ���as studied, not the
proposed 120 feet..The use of the Precise Plan �ehicle to circumvent doine CEQA
smdies is not sustainable under the la�v. 7he ��ariations �vith the zone, such as the heieht,
must be studied for the ��arious potential impacts. Sec[ion 1�332 requires that the '`infill
developmenr' stricth� comply �cith the existing (not proposed) zonine to qualifv for the

\�'hat is required by CEQA is that these possiblv significant impacts be studied
under the directions provided b}� the Code. \'either staff, the public nor the Council can
tell at this staee ���hether the design proposed is appropriate until these potential impacts
are fully ��etted in the CEQA process. This is not a "technical" objection to the process
implemented at this point. This is the �va}� ��e eet to the real crux of ho«�this e�tremely
imposine proposal should be handled by the Council. Studies done in compliance ���ith
CEQA �vill provide guidance to the Council and the public. Thev may alle��iate concerns
or they gi��e direction to desien altemati��es that �vill reduce the impacts.

Dear Mayor Cox,
I am a long time resident of Chula Vista (lived in Otay Ranch and now living in Sunbow). I moved into the Bella Sol
community of Sunbow in 2003. I am the original owner of my home. I chose living in Bella Sol because it's secluded,
safe and quiet. I have a relatively young family. I am a single mom to 3 kids (14,4 and a newborn). Upon hearing that a
parking structure will be built near my home which will include a loop road next to the western border of Bella Sol, I was
not happy. IYs enough that I have accepted the noises from the ambulances that drive by, the sounds of cars off of
Telegraph Canyon road and the occasional helicopter landing to transport patients to the hospital. These were concerns
that I have taken into co�sideration before accepting buying the home. However, I didn't think that a loop road would
be built which will bring in traffic, more noise and random people to a parking structure adjacent to my home. Has
there been an environmental impact analysis of this proposed structure? Do the citizens/homeowners around the
neighborhood have a say on whether this structure can be built? Shouldn't we have to vote on this? After all, we are
paying properiy taxes, we live near the construction site, we will have to deal with the influx of traffic and people
coming in and out of the parking structure. In addition, the parking structure will look over our homes and possibly
invade privacy. I love the community I live in. I don't want to have to pack up my belongings and find another place to
live should having the parking structure located adjacent to our community disrupt our lives. I just feel like we, as
homeowners, should have a say. I know I'm just one person...but I feel that sometimes governments give in to the"big
companies" instead of listening to the little people like myself.

I am a rzsident of the Bzlla Sol community which encompasses 108 homes in the Sunbo�v communirv. The
pazkin� strucmre and loop road «ill be on the southw�estem and westem borders of Bella SoL Since both thz
parkinQ structure and road are on a hill approximately 40 feet above our communiri�, the� will be ��isiblz to most
if not ali of the homes in the Bella Sol comples.
I am not opposed to Sharp increasin� its parking and improving vehicle circulation tiithin theu campus. I am
concemed that this project possess szveral envuonmental risks to thz Bella Sol residences ���hich need to be
smdied and considered beforz approvin� this project. These risks have not yet been quantified becausz
the pazkinQ structure and loop road �vere made exempt from havina an environmental rzvie�v. The follo�tiina
�ras the rational receive in the Planning Commission AQenda Statement (PC.4S) for the absencz of an
environmental review:
"Ihe Development Services Director has revie«�ed the proposed project for compliance with the California
En��uonmentai Qualiry Act (CEQA) and has determined that the project qualifies for Class 32 cate�orical
e.remption pursuant to the Section 1�332 (In-Fill Development Project) of the statz CEQA Guidelines. Thus;
no furchzr envuonmen[al review is necessarv."
Given thz pazkine structure's hei�ht; close protimin'; 2=F hour illumination and southwzstem location,
the environmental impacu of shadowine of homes, inhibitina the effecti�eness of solaz panels; car alazm
noise, light spillage; and visual obstructions need to be studied and quantified.
R%ith thz parkine structure; Sharp «�ill increase iu pazkins spaces to 2,3�4. Sharp estunated in the PCAS; that
approtima[eh �0 percent of the vehicles �vill use the nzw�l�� constructed loop road. Given the pazkin� spaces
and Sharp's usage estunatzs; it would be a reasonable assumpcion that there «ill now bz thousands of cars per
��zek that will travel on the newl� constructed loop road on Bzlla Sol's western border. This amount of traffic

On Tuesdav; please requue that an environmental smdv be done on both the proposed parkinQ strucnue and

This letter report provides an analysis of the potential traffic noise impacts of the Sharp Chula Vista
Parking Garage and Loop Road Project (project) in compliance with City of Chula Vista Noise
Compatibility Guidelines.
BACKGROUND
Noise is typically defined as unwanted sound. Sound pressure magnitude is measured and quantified
using a logarithmic ratio of pressures, the scale of which gives the level of sound in decibels (d8). To
account for the pitch of sounds and the corresponding sensitivity of human hearing to them, the raw
sound pressure level is adjusted with an A-weighting scheme based.on frequency that is stated in units
of decibels (dBA). For example, the typical A-weighted noise level of a jet fly over at 1,000 feet is 110
dBA, a commercial area with heavy traffic at 300 feet is 60 dBA, and inside a library is 30 dBA (Caltrans
1998).
A given level of noise would be more or less tolerable depending on the sound level, duration of
exposure, character of the noise sources,time of day during which the noise is experienced, and activity
affected by the noise. For example, noise that occurs at night tends to be more disturbing than that
which occurs during the day because sleep has the potential to be disturbed. In consideration of these
factors, different measures of noise exposure have been developed to quantify the extent of the effects
anticipated from these activities. Equivalent Energy level (Leq) is the average acoustical or sound
energy content of noise, measured during a prescribed period, such as 15 minutes cr 1 hour. The
Community Noise Equivalent Level (CNEL) is the average equivalent A-weighted sound level over a 24-
hour period. This measurement applies weights to noise levels during evening and nighttime hours :o
compensate for the increased disturbance response of people at those times. CNEL is the equivalent
sound level for a 24-hour period with a +5 dBA weighting applied to all sound occurring between
7:00 p.m. and 10:00 p.m. and a +10 dBA weighting applied to all sound occurring between 10:00 p.m.
and 7:00 a.m.
The decibel level of a sound decreases (or attenuates) exponentially as the distance from the source of
that sound increases. For a single point source such as a piece of inechanical equipment, the sound

level normaily decreases by about 6 dBA for each doubling of distance from the source. Sound that
originates from a linear, or "line" source such as a heavily traveled traffic corridor, attenuates by
approximately 3 dBA per doubling of distance, provided that the surrounding site conditions lack ground
effects or obstacles that either scatter or reflect noise. Other contributing factors that affect sound
reception include meteorological conditions, natural topography, and the presence of manmade
obstacles such as buildings and sound barriers.
REGULATORYSETTING
The Environmental Element of the Chula Vista General Plan contains goals and policies related to
environmental noise in Section 3.5, Noise. The General Plan defines noise sensitive land uses (NSLU) as
residences, schools, hospitals, librarles, parks, and places of worship. To establish the compatibility of
various land uses with exterior noise levels, the City uses CNEL in its planning guidelines. Table 5.5-1
illustrates Chula Vista's exterior land use noise compatibility guidelines. Shading in this ta61e represents
the maximum noise level considered compatible for each land use category.These guidelines reflect[he
levels of noise exposure that are generally considered to be compatible with various types of land uses.
The City of Chula Vista states that these guidelines are to be used at the land use planning stage, for ,_
noise impact assessments,and to determine mitigation requirements for developmen[proposals.

An impact would occur if project-generated traffic would result in roadway noise that exceeds 65 d6A
CNEL,which is the most conservative noise compatibility guideline.
POTENTIAL NOISE IMPACT
The maximum average daily trips (ADT) expecYed on the proposed loop road is 4,000 ADT (LLG 2014�.
Traffic noise that would result from this ADT is assessed using standard noise modeling equations
adapted from the FHWA noise prediction model. The estimates are conservative because the model
does not take into account buildings or topography that would provide noise attenuation. The model

takes into account roadway width, vehicle mix, speed limit, and ADT. The loop road would have a
posted speed limit of 25 miles per hour and a maximum median width of 11 feet. The loop road would
generate a noise level of approximately 58 dBA at 50 feet from the roadway centerline. Therefore, the
project would not result in roadway noise that exceeds 65 dBA CNEL and would not exceed the Cit�/s
Noise Compatibility Guidelines for sensitive land uses. Model output is provided in Attachment A.

My dear Council Member Rudy Ramirez:
I hope this finds you well.
I just now learned of a critical issue that will be coming up for a decision this afternoon.
My home and the 107 other homes in our quiet sunny neighborhood will be devalued and our quality of life destroyed if
the Sharp campus beside our residential community of Bella Sol is allowed to have the residential zoning laws changed
to allow Sharp to erect a looming 120 foot parking superstructure over our homes situated on the lower part of the hill.
Mayor Cox,the people of Chula Vista have zoning laws precisely to keep this kind of bellicose expansion from
happening. We have zones for work, industry, and government, but we also have RESIDENTIAL zones.
Sharp knows this and Sharp knew this when they built a small campus in a RESIDENTIAL area with the provision that
their highest strudures were not to exceed 45 feet.
But now, Sharp wants to change the zoning laws they accepted so they can continue to increase their customer and
client base and I dare say, profits, regardless of how detrimental to their neighbors this might be.
Rules and laws are there to protect private citizens like you and me, not so they can be flaunted when it suits a big
company like Sharp seeking to expand its operations. Of what use is the protection of laws if they can be overturned by
an entity like Sharp?
What about the people of Chula Vista like the Bella Sol residents around Sharp whose 108 homes will lose their values
once the shadow by day of the 120 foot Sharp superstructure obscures the sky and air quality? The structure will cast
not only a shadow on our community by day, but will also light up the night with a 3 storey high floodlight illumination
tower by night.
We will lose the quality of life that we have worked so hard for to achieve. And that is wrong.
What about the health of the 108 families living here once the smoke of 2,142 vehicles daily in and out of the garage
strudure starts wafting into our homes?(While it is a 714 car garage superstructure, clients will be driving in and out
throughout the day.)
We worked very hard to have the homes and neighborhood that we have now—the clean fresh air, the blue sky,the
quiet stillness of the day and balmy afternoons,the dark starry nights that provide rest and solace in the evening.
Closing our windows to suffocate inside is bad for our health. Trying to shut our ears from the sound of engines and
vehicles transiting by is not an option. Having passersby and motorists able to look down into our homes from the
parking structure above is an outright violation of our privacy. And to have our nights lit and taken away by the glare of
the parking garage light tower? No!
Right now, my neighbors, my son,and I walk confidently whenever we want with assuredness,ease and safety around
our neighborhood, and to and from the parks, grocery store and pharmacy just up the hill and around the bend from our

9"community. This is what we worked hard for and bought into. If Sharp is allowed to violate current zoning laws by
having them changed, we will lose that security and safety.
If Sharp wants to build a big campus,they should do it in a zone SPECIFICALLY designated for such a purpose. We have
schools and business zones nearby.
Sharp cannot and must NOT be allowed to go through with their intent to increase their current campus NOR should
zoning laws be changed to accommodate Sharp's expansion.
Sharp is more than welcome to stay and serve in Chula Vista and if they wish to expand,they should—but in an area
originally and properly designated for such purposes.
I and my neighbors SHARPLY oppose Sharp's expansion beside our homes for the reasons so stated above.

Thank you for your time, your empathy, and your willingness to listen to my��r��n��tp��s�H
extended surface parking project at 752 and 754 Medical Center Road, Ch�T�i�hE�}fh��jy;�� :
Council meeting on April 15, 2014. Especially, the challenge I have with my unit being so close �
the back of the medical building located at 752 Medical Center Road. �
The main reason I attended the City Council meeting was to get a clear answer on.if there
would or would not be a road/driveway/walkway behind my patio wail linking the two �
surface parking lots currently under construction. I tried to be proactive by going in person
to Sharp hospital builders trailer, and to the City of Chula Vista Planning Dept. where I spoke to
Mr. Bautista and Mr. Steichen. I also reached out and connected via telephone with Mr. Matt
Teichner when he returned from his vacation. I have been given different answers to my
question. I clearly asked Mr. Teichner during our telephone conversation -- i¢ttiere would be a
road/driveway looping the two parking lots together and his response was "no this is happening
across the street on the hospital side of Medical Center Road" . That the area I was discussing
wouid be a landscaped area.
I contacted the City of Chula Vista Planning department a second time with two questions, 1) is
there a road/driveway/walkway behind my patio wall and how many feet does anything need to
be away from my residence. (See attached email response from Mr. Bautista. Mr. Bautista
forwarded my second question to Mr. Steichen and he informed me Sft from my building is the
answer due to the type of zone the Medical building has at this time. I was grateful to receive a
copy of the plans from Mr. Bautista via email. Upon reading over the plans it appeared to me
there would be a road/driveway/walkway, lighting, and security cameras. But I still did not have
a clear answer to my question on the road/driveway/walkway. Therefore, I decided to come
before the City Council for an answer and asked the question again last night.
When City Council addressed my cjuestion to staff, Mr. Steichen shut down my question by
stating this project was not on the agenda and did not answer the most important question I had
been seeking answered. No member of Sharp staff or their team of experts offered an answer
although they were available and ready to answer every type of question with regards to the
parking structure. In my opinion the surface parking lots are all part of the Sharp Master Project
being done in phases. The meeting proceeded and I appreciate the members of City Council
requesting Sharp to be a Good Neighbor and keep the immediate neighbors informed which
they agreed to do albeit too late for this project. The female speaker from Sharp (Pat, I think as
I did not catch her name) told City Council she would like to talk to me after the meeting.
Post meeting Pat,(?) did not address me as she left Council Chambers. Sharp already had
what they needed from Council to move forward. As I was leaving I reached out and asked Mr.
Velez, CEO of Sharp Chula Vista if he could give me a few minutes of his time. He was very
gracious and allowed me to talk to him in the hallway. Mr. Matt Teichner joined the
conversation, and at one point !Iw Pat (?) from Sharp came over and indicated Matt Teichner,
Senior Project Manager was the contact for questions and she left without speaking to me
directly. During this conversation, I was finally able to get the answer to the question, and the
answer confirmed my fear and biggest concern. Yes, there will be a driveway linking the two
parking lots where people can drive from one to another. I was devastated to finally hear this
news. During the conversation with Mr. Velez and Mr. Teichner, I felt Mr. Teichner was flippant
in his responses to me especially with respect to Sharp communicating with the homeowners
who share the property line. His response was "they are not the government and they don't has'¢
my telephone to contact me to let me know what was going on" and laid the responsibility on the
City of Chula Vista by stating they depend on the City of Chula Vista to let residents know. Mr.
Teichner stated this project located at 752 and 754 was discussed at the Public meetings which
leads me to believe it is part of Sharp Master Project and not an independent project. Mr. Velez
said he was aware letters were mailed to residents and I showed him the copies I had that only
discuss the project at 751, the letters did not mention any projects at 752 and 754 or I would
have attended the meetings. (attached for your review).
The residents from Caminito Valiente did not have an opportunity to voice their opinions due to
the fact, they were not aware of any project so close to their shared property line that would
have a long term impact. Mr. Matt Teichner stated, I will be separated by a 6ft wall, and the
noise of the cars will be no more than the front of my home and travelling 25 miles per hour. My
response some people and some vehicles are taller than 6ft. Privacy issues, security, vehicle
emissions, and noise immediately came to mind. I am not comfortable letting my 15 months old
grandchild who lives in my home play outdoors in the patio knowing vehicles will be driving on
the other side of the patio wall. I asked both Mr. Velez and Mr. Teichner if they could not have
cars go through this tight area and rather route them in and out to the parking lots from Medical
Center Road. They gave me reasons I do not understand why it is not possible including
electrical and water. I disagreed as I feel it is possible. There is no point at this time for me to
go fuRher into a "they said, she said" scenario.
I am a homeowner and do not have a team on experts on every topic or subject related to these
projects. I clearly see and understand the larger picture on how this expansion of parking
supports the community and was willing to work through the inconvenience of the trucks,
bobcats until completion of the surface parking lots thinking it was short term and not long term.
I feel let down by all parties involved. I feel this issue was worked around by not fully disclosing
the addresses of the projects and allowing residents a voice. It should not have taken so much
of my time and energy to get a clear answer on my question. I feel the information I received
from both parties that this was a "grading permit" and that does not need residents to be
informed was not fully disclosing the long term impact of the project on homeowners. I am very
disappointed my constant communication and request for an answer on one question the
road/driveway issue was not answered until late last night.
Had staff or the team from Sharp answered the question last night at the City Council meeting, I
would have had an oppoRunity to ask the members of City Council to request Sharp submit a

Change Order for the expansion of the surface parking lots located at 752 and 754 Medical
Center Road and eliminate the driveway behind my patio wali.
I do not know if the members of City Counal were aware cars would be driving between the
extended parking lots of 752 and 754 Medical Center Road or the long term impact this would
have on homeowners of Caminito Valiente. From the email from Mr. Bautista, it appears they
may not. The impact or inconvenience to homeowners of this project is not as described — a
shoR term project related inconvenience. In reality it is a short term construction inconvenience
with a long term impact so close to residential property.
I am inviting any member of the City Council to meet me at my property for a site visit. I
respectfully request the members of City Council review the drawing I handed out at the
meeting and the attachments I have included with this letter. I feel you will have a great
understanding of my concerns and why I came to the meeting to seek yo�rhelp.

I'm writing to you to voice out my family's concern about the propose extension of Sharp Chula Vista parking lot, in
Bella Sol community.Our house is located next to the proposed parking lot. I am a nurse, and i work night shift, and
hearing the noise from the construction wili be a great disturbance to my sleep. I had a bad experience already a couple
of weeks ago when they were drilling in the proposed project, waking me up in the middle of sleep.This resulted to lack
of sleep and may affect my health and also myjob performance.The noise that the construction will make greatly
worries me. I proposed that the hospital compensate to the hassle the construction of the parking lot will make not only

A. THAT THE PROJECT IS CONSISTAI�'T V�'ITH THE APPLICABLE
GENERAL PLAN DESIGNATIO\ AI�'D ALL APPLICABLE GE\'ERAL PLAi\'
POLICIES AS �i'ELL AS ��'ITH APPLICABLE ZOI�'II�'G DESIGNATIO\'S
AI`'D REGULATIONS.
The Chula Vista General Plan desienation for the site is Public and Quasi-Public
(PQ). Accordine to General Plan Chapter �, Section 4.9.6 (Page LUT-54), the PQ
designation depicts e�isting areas used by schools, churches, and hospitals.
Because the site has a General Plan desienation of PQ, the existing medical
facility is acl:nowledeed and e�pressly allo«ed in the General Plan. The C-O zone
allo���s medical offices and clinics. Hospitals are allo�+�ed on the site, and
elsewhere within the Cin�, as an Undassified Use (CVMC 19.�4). The project is
allo�ti�ed as an ancillarv use for the medical center; since it ���ill provide park:ing
and impro��ed vehiculaz access sen�ing the allowed medical center use.
The project indudes the request for a precise plan to allo��� a height that is in
excess of the ma�imum alloN�ed heieht of 45 feet for the C-0 Zone. Because the
zone in �+�hich the project is located is C-O-P, a precise plan may be applied to the
site H�ith City Council approvaL According to CVMC Section 19.�6.040, the
requirements specified in the precise plan shall take precedence o��er the othen��ise
applicable regulations of the underl��ins zone. In this particulaz case. the applicant
is askine to maintain a heieht of 120 feet. ���here 4� feet is othern�ise allo�;�ed. The
intent of the precise plan�as described in CVMC Section 19.�6.041; is to allow
reeulatory flexibility in instances ���here the site has unique attributes and requires
special handling. The site has been utilized as a medical center since the 1970's.
The COP zoning desienation ���as applied to the site in 1990; H�hen the zonins �+�as
changed from residential (R1H). Because the uses allo���ed in the C-O zone «�ere
compatible ���ith the esiting use of the site, the C-O zone �vas chosen as the most
appropriate zoning desienation for the site at the time that it N�as rezoned. Because
the CO zone has a height requirement of 4� feet ma�imum, fle�ibility in zonine
���as needed at the time that the site ���as rezoned in 1990. since the site maintained

structures (hospital to�vers) in escess of 4� feet. The "P ` modifier ��as applied to
the site resulting in a C-O-P Zone, acl:no��ledging the special chazacteristics of
the site and the need for flesibilin� be��ond the requirements of the C-O zone.
Consistent ��ith this intent, the applicant is requesting a precise plan to allo�v a
n-pe of facility (pazkine structure) that is normall�� associated N�ith a medical
center.
B. THAT THE PROPOSED DEVELOPMENT OCCURS V�'ITHIN CITY LIMITS
OI�' A PROEJCT SITE THAT IS NO MORE THAI�' FNE ACRES
SUBSTAt�'TIALLY SURROLTi�'DED BY URBAI�' USES.
The site is located within the Chula of Vista cin� limits. The project site; ���hich
consists of a parkine structure and loop road; is less than � acres in size. The total
project site is approximately 1.� acres. The project is surrounded b��urban uses on
all sides. Surrounding uses consist of inedical uses, a veteran's home, and
residential de��elopment.
C. THAT THE PROJECT SITE HAS NO VALUE AS HABITAT FOR
ENDAI�'GERED. RARE OR THREATENED SPECIES.
The project site consists of a eraded and developed pad; which includes
commercial landscapine that does not include flora nor fauna habitat. ThereFore;
the site has no ��alue as habitat for endaneered; rare or threatened species.
D. THAT APPROVAL OF THE PROJECT WOULD NOT RESULT 11�' ANY
SIGNFICANT EFFECTS RELATII�G TO TRAFFIC; \'OISE, AIR QUALITY,
OR �'�'ATER QUALITY.
The parking earage does not eenerate additional traffic on the site. All on site
traffic can be attributed to esistine traffic generatins uses on the site. such as the
hospital and medical offices. As such, the project will not result in am� sienificant
effects relating to traffic. Because there �i�ould not be any increase in traffic due to
the project; there would also not be any significant ad�erse air qualit�� or noise
effects due to the pazking Qazaoe and loop road. The parking gazage and loop road
�vill arguabl�� improve any existing air quality or noise effects attributable to the
medical facilin-, since omsite circulation ti�ill be impro��ed resultine in less on-site
vaffic coneestion. A technical letter prepared b�� LLG Eneineers. dated April ]0:
2014 states that there aze no traffic impacts associated �vith the project; and that
the loop road provides good access to the parking structure. A technical letter
dated April 10, 2014 prepared b�� Atkins; states that there would be no adverse
noise impacts associated �cith the project. The project is required to compl�� ���ith
all City of Chula Vista ���ater qualitv requirements. and a ��'ater Qualih� Technical
Report has been prepared for the project. The Wa[er Qualit�� Technical Report;

� and requuements outlined therein, is in conformance ���ith all standards required
by the Ciri�`s Land Development Section. The project ���ill be required to compl}�
w�ith all ���ater quality requirements outlined in the \�'ater Quality Technical
Report, as �vell as the Cin� of Chula Vista`s Municipal Storm Water Permit; and
as such, the project �ti�ill not result in an}� sienificant effects to ���ater qualiri�.
E. THAT THE SITE CAI�' BE ADEQUATLEY SERVED BY ALL REQUIRED
UTILITIES AND PUBLIC SERVICES.
The existina medical center site is currentl}� sen�ed b}� all required public utilities
and sen�ices. The parking structure would result in no additional demand for
additional public utilities/sen�ices, and will be sen�ed ���ith existing utilities and
sen�ices such as electricih�, �vater, and public safet��.
IIL DESIGN REVIE�Y FINDINGS/APPROVAL
A. THAT THE PROPOSED DEVELOPMEI�rT. AS COI�rDITIONED. IS
CO\'SISTENT WZTH THE DEVELOPMENT REGULATIONS OF THE COP.
OFFICE COMMERCIAL WITH PRECISE PLAN OVERLAY ZONE.
The proposed project complies ���th all development standards of the COP zone
�»th the e�ception of building height which is beine requested to increase from a
ma�imum of 45 feet to 120 feet in conjunction with a Precise Plan approval for this
Project.
B. THE DESIGN FEATURES OF THE PROPOSED DEVELOPMEI�TT ARE
COI�'SISTENT WITH. AI`TD ARE A COST EFFECTNE METHOD OF
SATISFYING THE CITY OF CHULA VISTA DESIGN GUIDELII�ES AI�'D THE
CITY OF CHULA VISTA DESIGI�' MAi\TUAL AI�TD LANDSCAPE MANUAL.
The project is in compliance with the Commercial Guidelines of Chapter III of the
City Design Manual in that it complies �vith the Site Plannine desien guidelines
for compatibilit}�, building placement and screenins, It also complies ���ith the
Architectural desien euidelines for compatibilit��, scale/building fa�ade and roof
articulation and materials and colors.
The ne�i� parking garage is strateeicall}� located in the center of the medical center
campus to provide additional parkine to the overall campus to support the acute
caze facilities; as well as the outpatient facilities. The orientation of the parking
structure itself is placed to alien �+�ith the other lazeer scale buildings nearby. The
colors and materials are consistent ��ith the adjacent builidines on the medical
campus in order to full�� inte�rate it ���ith the hospital. Bufferine and/or screenine
to reduce the ��isual impact of the pazkine struciure on the neighborino residential

lo���er floors of the parking structure�Desian features have been incorporated that
attempi to minimize the massi��eness of the structure, resulting in the visual

desi�ned to be 6�% open to the surroundine environment.
I IV.� APPROVAL OF DESIGN REVIE��' PEI2A'IIT
Based on the findings abo��e, the Cin� Council approves the Design Review Permit, as
sho��n in proiect �lans on file in the Office of the Cin� Clerk. subject to the conditions set
forth beloH�:
A. The following shall be accomplished to the satisfaction of the Ciri�, prior to issuance of
building permits, unless otherN�ise specified.
Plannine:
1. Prior to, or in conjunction �+�ith the submittal of plans for the building permit; pay all
applicable fees, including any unpaid balances of permit processing fees for deposit
account DQ-1762.
2. The colors and materials specified on the buildine plans must be consistent �vith the
colors and materials shoNm on the site plan and materials board appro��ed by the City
Council on April 8, 2014, or as subsequently modified per their direction.
3. All ground mounted utilitv appurtenances such as transformers, AC condensers, etc.; shall
be located out of public ��ie«� and adequatel}� screened throueh the use of a combination
of concrete or masonrv�valls; bermine; and/or landscapine to the satisfaction of the City.
4. A eraffiti resistant treatment shall be specified for first floor and building surfaces. This
shall be noted for any building and ���all plans and shall be re��ie�+�ed and appro��ed by the
Director of Development Sen�ices prior to the issuance of buildin� permits. Additionall}�,
the project shall conform to Section 9.20.0» of the CVMC resazdine graffiti control.
�. Prior to issuance of buildine or grading permits, �i�hiche��er occurs first, a photometric
study shall be submitted for revie��� and approval by the Director of Development
Sen�ices that indicates there shall be no light spillage be}�ond the propem� lines of the
project site.
Land Development Enaineerin�/L.andscape Architecture Di��ision
6. Applicant shall pa}�the following fees:

7. Prior to issuance of buildine pemvts. applicant shall indicate on the site plan an

8. Prior to issuance of �rading permits, the submitted eradine plans shall indude the
follo���ina:
a. Indication as to ho�ti� runoff from the slope will be diverted from the proposed retaining
«�all on the north side of the project.
b. The rounding of proposed slope ���ith the natural slope in order to avoid any
concentrated flo«�.
9. Prior to issuance of grading permits_ applicant shall aeree to the follo���ing:
a. That final sizine of the V�'ater Qualin� BMP's shall be determined durine the gradino
permit process.
b. That all drainage facilities shall be pri��ately maintained.
t0. Prior to issuance of grading or buildine permits permit (���hichever occurs first), applicant
must submit complete Landscape Improvement Plans for approval to the City of Chula
Vista that comply ���ith Chapter 20.12 of the Ciry of Chula Vista Municipal Code,
Landscape A4anuaL and Design ManuaL The title sheet of the dra���ines shall contain a
signed statement by the landscape azchitect as follo���s:
"I am familiaz ���ith and aeree to comply �+ith the requirements of the landscape
improvement plans as described in Chapter 20.12 of the City of Chula Vista Municipal
Code. I have prepazed these plans in compliance «�ith those reeulations. I certifi� that the
plan implements the resulations to provide efficient �vater use.�'
The plans must also demonstrate the parkine garase and utiliri� loop road are adequatel}�
screened through the use of plantine material. y
Buildine:
11. Plans shall compl�� ���ith Title 24 and 20li Califomia Buildine Code (CBC); Califomia
n4echanical Code (CMC). Califomia Plumbing Code (CPC), Califomia Electric Code
(CEC); California Green Buildine Standazds Code (CalGreen) and 2008 Califomia
Energy Code.

Fire:
12. Prior to issuance of building permits, applicant shall perform a fire service studv that
includes a hydraulic �i-ater flo«� anal��sis. The analysis shall sho��� the actual flow and
pressure for all hydrant and and riser stubs. A higher demand or �vorst case scenario
should be used in the flo�� anal�-sis to avoid upgrades to the fire sen�ice loop. The Hazen
V�'illiams formula shall be used in the determination of these flo��s and pressures. The

13. This permit shall become ��oid and ineffective if not used or extended bv April 1, 2017, in
accordance „�ith Section 19.14.600 of the Municipal Code.
14. All landscape and hardscape improvements shall be installed and maintained in
accordance �i�ith the approved landscape plan.
1�. Approval of this request shall not �vai��e compliance n�ith all sections of Title 19 of the
Municipal Code, and other applicable City Ordinances in effect at the time of buildine
permit issuance.
16. The Propem� O«�ner and Applicant shall and do agree to indemnifi-. protect, defend and
hold harmless Cit��, its Cit�� Council members, officers; employees and representatives,
from and aeainst am- and all liabilities; losses, damages, demands, claims and costs,
including court costs and attorne��'s fees (collectively, liabilities) incurred by the Ciro
arisin�. directly or indirectly. from (a) Cin�'s appro��al and issuance of this Desien
Revie�i� Permit and (b) City s approval or issuance of any other permit or action, whether
discretionary or non-discretionan�, in connection �;�ith the use contemplated on the Project
Site. The Property O��mer and Applicant shall acl:no�vledse their agreement to this
provision by ezecutine a cop�� of this Design Revie�v Permit ���here indicated belo���. The
Propem- O«mers and Applicant`s compliance with this pro��ision shall be bindine on any
and all of the Propem� O��mer's and Applicant's successors and assiens. This condition
may be modified by the Zoning Administrator subject to input from the Cih� Attome}�.
Prior to the issuance of any permits required by the Cit}� of Chula Vista for the use of the
subject propem� in reliance upon this appro��al, the Applicant/Representative and propem
o�i�ner shall e�ecute this document b}� mal;ine a true copy of this resolution and siening
both this original letter and the true copy on the lines provided belo��; said esecution
indicatins that the Applicant/Representative and Propem� O��roer have each read;

I �V. CONSEQUENCE OF FAILURE OF CO\�ITIONS
If any of the foreoing conditions fail to occur; or if they aze, b�� their terms, to be
implemented andymaintained over time, and any of such conditions fail to be so
implemented and maintained accordins to the their terms. the City shall have the right to
revoke or modifi� all approvals herein �anted. deny or fiuther condition issuance of futwe
building permits, dem�, revoke or further condition all cenificates of occupancy issued
under the authority of approvals herein granted, instimted and prosecute litieate or compel
their compliance or seek damaees for their violations. No ��ested ri2hts are gained b��
Applicant or successor in inrerest by the Ciri approval of this Resolution.
I VI. INVALIDITI'; AUTOMATIC REVOCATION
It is the intention of the Ciri� Council that its adoption of this Resolution is dependent upon
enforceabiliri� of each and everv term pro��ision and condition herein stated; and that in the
event that any one or more terms; provisions or conditions aze determined by the Court of
competent jurisdiction to be in��alid, illeeal or unenforceable, if the ciry so determines in its
sole discretion. this resolution shall be deemed to be re��oked and no further in force or in
effect ab initio.
