W"HEREAS, on Aueust 8, 1978; the Cit�� Council. bv Resolution No. 9221. adopted
Council Policy No. 478-01 (Policv) to establish the Traffic Signal Fee (Fee) to regulate an
equitable contribution b}� private de��elopers of residential, commercial and industrial uses in the
financine and/or installation of traffic sisnals on public streets tiithin the City: and
V�'HEREAS. the Cit}� t���ice updated Council Polic}� \'o. 478-01 to adjust the amount of
the Fee from �7.00 to �23.00 per ��ehicular trip: on b4arch 23. 1993 �;�ith Resolution No. ]7048:
and on?�'ovember li. 2001. with Resolution No. 2001-38�: and
A'HEREAS. presently, the amount of the Fee is �34.27 per ��ehicular trip, and any new
development project within the City that eenerates an increase in number of trips based on its
current land use is subject to the Fee. With the adoption of Resolution I�'o. 2001-38>, the fee is
automatically adjusted every }�eaz based upon the Eneineerins I`'e�+� Record 20 Cim Construction

l�'HEREAS, the only development projects esempt aze on-site recreational or sen�ice
facilities. includine but not limited to cabanas, clubhouses, s�vimmina pools. and meeting rooms
that are open to the public; and
l�'HEREAS. Citv staff recommends that Section 7 of Policv No. 478-01 be revised to
exempt development uses ��ith characteristics or activities as a principal use of land; generallv
described as "Communin�-Purpose Facilities;" as defined in Chula Vista A4unicipal Code Section
19.04.0»; so that the Fee mirrors the same exemptions of the Public Facility Development
Impact Fee (DIF), the Westem Transportation DIF and the Eastem Transponation DIF (Chula
Vista Municipa] Code Section's 3.�0.100, 3.�4.070 and 3.».100 respectivel}�); and
WHEREAS. 516.3�8 was collected in Fiscal Year 2013/2014 from the YMCA for the Fee:
and
\�'HEREAS, the 1'A4CA qualifies for an esemption under the development use as
Communim-Purpose Facilit��, and funds collected are requested to be refunded under this
exemption.

Vista does hereb� approve the re��isions proposed by Cit�� staff to Council Polic}� No. 478-01, as
shoN�n on Exhibit "A." which is attached hereto and incorporated herein bv this reference as if
set forth in full; and appropriate �16,3�8 to the Other Expenses categorv of the Traffic Sienal
Fund.

PLRPOSE
To establish a policy for participa[ion by private developers for the fmancine and/or installation of vaffic
sienals on public sveets within the Cin�of Chula�'ista.
BACKGROUT'D
New de<<elopmenu, whether residential, commercial. or industriaL generate additional traffic �vhich results in
increased coneestion or safety hazards at various street intersections tluouehout the Ciw. The installation of
vaffic si�als is sometimes necessan•in order to accommodate the safe and efficient flow of��ehicular tr�c.
The Cin� has in the pas[ required de��elopers to participate in the cost of si�alization N�hich directl�• impacted
a major individual development. Lesser de��elopments, howe��er, were not required to patticipate. The s��stem
w�as inherently inequitable.
This polic�� provides for proportionate convibution b}� all private developments eeneratine significant traffic
to�vazd the projected traffic si�al needs of the City. It is che intent of the City Council in establishine this
polic}� that all development rede��elopment remodeling or other activin� w�hich w•il] resuli in a ]ong-term
INCREASE in the number of vehicle vips upon the Cin's s��scem of sveeu shall be subject to the vaffic simal
char�e. That charee shall be based on upon the net II�'CRE.ASE in number of trips eenerated by any specific
site, and shall NOT indude trips eenerated at such site under previous or cuaent usaee.
STATEDgNI OF POLICI'
1. All ❑ew� private residential, commercial or industrial de��elopment as described belou� shall, as a
condition of buildine permit issuance (or approval of a rezonine action relati��e to creation of ne�r
mobile home spaces); pay a traffic signal charge for additional trips eenerated as authorized by
ordinance of the Cin� Council, and in such amount per additional vip as stipulated bc Cin� Council
resolution from tune to time. The base charee is initially set at S23.00 per a��eraee weekda}�daih�trip.
Trips eenerated by current propem� usage or verifiable prior usaee shall be eacluded in determinine
the total chazee, which shall be based on additional trips eenerated at the site under the new use. For
the purposes of this policy; ��erifiable prior usaee shall be the last l:nown usaee of the propem«�ithin'
fi��e (5)��ears of the date of application for development approval if said propem� is currendy vacant.
In rhe event that the propem has been vacant for more than five (5) .�ears; no erclusions will be me
made reeardless of propem�usage more than fi��e(5)years in the put.
2. Remodeline (enlar�ine; alterine, repairine or improvina and/or replacement) of ezistin2 residential
de��elopment is e�empt from the traffic sienal chaz�e except �vhere and to the e�tent additional
residential dwelline units are crea[ed.

3. Structural, occupancy, or use modifications to existing commercial or indusvial developments which
are projected to increase the a��eraee daily traffic eenerated relati��e to the total development site by
2% or more shall be subject to pa��ment of the traffic sienal char�e to the extent of the projected
mcrease in traffic. Traffic volume determinations�projections for current and future traffic at the site "
shall be made b�� the Cih� Engineer ��,fio shall be required as a condition of approval to an}� action
formally permittine a strucrural, or occupancy, or use modification to an existing commercial or
i nd ustri a l/deve I opm ent.
4. Noh��ithstandino any other provisions of this policy, no private development shall pa} the traffic sienal �
charge more than once for a si��en ]eve] of traffic peneration. Where ADDITIONAL ttips are
generated relati��e to a previousl}' de��eloped propem�, the traffic signal charae will be applied onh�to
the ADDiTIOI�'AL units and/or vips generated.
5. An}� private de��elopment N�hich has been required to install a traffic si�nal shall eet credit for the cost
of that installation in computine traffic signal charees for subsequent development w�ithin the
boundaries of that private development.
6. The traffic sienal charee shall be based on the vehicular trip generation rate for the applicable land use
category as sho���n per the latest 'Brief Guide of Vehicular Traffic Generation Rates for the Sari
Diego Reeion", w�hich is published by San Diego Association of Governments (SANDAG). Traffic
eeneration rates for land uses not addressed by the SAT�`DAG guide shall be determined usine the
latest ITE Trip Generation book or as approved by the Cip�Engineer.
7. Development Projects Ezempt from the Fee:
Development Projects that have the follo�ving qualifications can be eaempt from the Traffic Signa]
Fee:
a. No additional charee ���ill be required of residential developments for on-site recreational or
sen�ice faciLties (cabanas, clubhouses. swunming pools, meeting rooms, etc.) unless such
facilities are open to the public. An}� such public facilities shall pay a charge based on the
total acreaee of the facility indudine parkine areas and a��ehicular trip rate of 200 per acre.
b. De�-elopmenc projects designated as "Conununity-Purpose Facilities , as defined in
CVD4C 19.04.055.
8. For all privare developments, the traffic signal charge shall be computed by multiph-ing [he new

construction.
]0. The Cin� may require that a de�-eloper whose project creates an immediate need for si�alization (per
�ti•arrant system specified in C.\'. Code Section 10.24.070) undertal:e to install such si�alization
subject to future reimbursement from the Traffic Si�al Fund. Reimbursement of a developer to the
eatent that their constrvction cost (includin� design) eaceeds his traffic simal charge shall ha��e first
call on the Traffic Sional Fund. No interest shall accumulate on the amount to be reimbursed. -
Reimbursement for anv ai��en installation shall commence onlv�•hen and if funds are a��ailable in the
Traffic Simal Fund and N�hen all pnor date reimbursement commivnenu have been satisfied in full.
11. M}� private de��elopment w�hich installs a traffic si�al that is not required b�� the Cim or dces not
meet vaffic sienal u�arrants as specified in Chula Vista Code Section ]0.2�.070, ma� not be eiven anv
credit for the costs of the simal aoainst theu required va�c sienal fee. The Cin�reserves the rioht to
gdDt crediu if it concludes afrer performing an appropriate enoineerino anal}�sis, the cost of such .
analysis bein2 bome by the de��eloper, that the signal �vill provide sienificant benefit to the eeneral
public. Such consideration b}' the City will onl�� be provided if the signal is installed on a public
street; or streeu, and am� credit «•ill be prorated based on the affected approaches to the intersection
owned b�� the City. Example, an iniersection �vith a private sveet on one approach and t��o
approaches owmed bv the Cin� �vill be potentiall�� elieible for a credit not to esceed nvo-thirds of the
cost of the sienals.
The City w�ill not pro��ide reimbursements for any costs incurred bv a de��eloper for a signal not
required b}�the Cip�nor meetine traffic signal warrants.
12. The Cin�may ad��ance funds to the Traffic Si2nal Fund or provide funds for vaffic si�al installation
�rhich funds shall be subject to reimbursement in the same manner as provided herein for a de��eloper.
