RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA WAIVING THE
FORMAL BIDDING PROCESS AND AWARDING CONTRACT TO THE R.B. CLARK
GROUP AND AQUATIC DESIGN SYSTEMS TO CONSTRUCT THE CLAPPER RAIL
EXHIBIT AT THE CHULA VISTA NATURE CENTER
WHEREAS, the Light-footed Clapper Rail is the most endangered species found in San
Diego and one of the most endangered in California; and
WHEREAS, the only viable population of Light-footed Clapper Rails in San Diego Bay
occurs in Chula Vista within the Sweetwater Marsh National Wildlife Refuge; and
WHEREAS, the U.S. Fish and Wildlife Service has asked the Chula Vista Nature Center
to become the only institution in the world to exhibit the Light-footed Clapper Rail; and
WHEREAS, the Chula Vista Nature Center has received grants and donations to fund
the exhibit and none of the money is from the City of Chula Vista; and
WHEREAS, the Board of Directors of the Bayfront Conservancy Trust has approved the
exhibit construction and directed staff to complete the work as soon as possible; and
WHEREAS, the California Coastal Commission and U.S. Fish and Wildlife Service have
permitted and approved the exhibit construction; and
WHEREAS, the construction work is highly specialized and sensitive and few
companies have the expertise to perform; and
WHEREAS, bids were requested from qualified contractors; and
WHEREAS, the low bid was from R. B. Clark Group; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista
does hereby waive the formal bidding process contained in Chula Vista Municipal Code
Chapter 2.56.
BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does
hereby award a contract to R. B. Clark Group (known as Document No. CO95-188, a copy
of which is on file in the office of the City Clerk) in the amount of $114,300 for Phase I
construction of the Clapper Rail Exhibit at the Chula Vista Nature Center.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista is hereby
authorized and directed to execute said contract for and on .~;u~half of the Bayfront
