YIFHF.HEAS, �n Setion was brought in the Superior Couz�t of the 3tate oP Californie
in and 3or the ;County of San Diego ,being &0;6?569 ,by the Bank of Italy Hational
Trnst and Sa.vinga dasociation,a national banking association,Plaintiff ve,
City of Chula vista,a municipal corporation,Defendant ,wherein plsitttiff sought
to quiet title in it .Yree Prom ell tax liena of said CitB,to certain lands in
said City,later deecribed,against which there exiated tag liena of said City
Sn the snm oY �;4889.24 original tasee and �I828.90 penalties thereon and �
further to quiet title in plsintifP to certairu:!str�,eeaementa and rights oP
way in and belonging to defendant :
dND YIHI:REASae compromise of said action has baen made ,which said City Council
coneidera and declarea to be for the best intereata of said City,whereby plain-
tiff waives and abandone all claims to said streets,easementa and rights of way
and agrees to and has paid the amoant to defendant of said original tagea and
the defenda.nt agrees to and hae waived and remitted the amount of aaid penalty
on said teaea end a Decree of sa�d Court �a has been entered in accordance
with said compromise aettlement of said action;a copy oY the complaittt ,answer
and Court Decree therein is hereto attached,referred to for more particular
description and made a part hereoY.
THEREFORE,SAID City Couttcil does hereby suthorize and instruct the City Clerk
of said City of Chule Vista to cancel and remit oY record the said amount oY
�I828.90,City of Chule Vista tax penaltiea againat said lands and to not col-
lect the same;and said City Council does hereby accept ,approve ,ratlYy and con-
firm said compromise settl�ment of said action.
Pasaed.adopted and approved by the City Council of the City of Chula Viata,
CaliYornie this 5th,day of Auguat ,Z930,by the following vote ,to wit:
