INTRODUCTION
The Applicant has submitted a Planned Sign Program application for approval of new monument
signs, banners, directional signs, wall graphics, stylon signs, and the replacement of the existing
tower sign with a digital display sign, for the Chula Vista Center located at 555 Broadway. The
Planned Sign Program is intended to provide additional signage for the shopping center to
increase customer awareness of the different stores and shops and possibly increase revenue to
the Center. The site is located within the Urban Core Specific Plan, UC- 6/UC -7 zone (see
Locator Map, Attachment 1).
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed project for compliance with
the California Environmental Quality Act and has determined that the project qualifies for a
Class 11 Categorical Exemption pursuant to Section 15311 (Accessory Structures) of the State
CEQA Guidelines. Although this project does indeed meet CEQA Guidelines Section 15311,
the Development Services Director also had the Applicant conduct a lighting analysis for the
proposed digital tower display, pursuant to CEQA Guidelines Section 15300.2, in order to
quantify the lighting effects of the digital display and prevent light spill onto adjacent properties.
The lighting study, prepared by Daktronics dated October 29, 2013, shows no lighting impacts
on adjacent properties. In addition, restrictions for the digital tower display are required in the
Planning Commission Resolution for this project.
RECOMMENDATION:
That the Planning Commission adopt Resolution PSP -13 -09 approving the proposed Planned
Sign Program, based on the findings and subject to the conditions contained therein.

In 1993 the Design Review Committee approved the Planned Sign Program, PSP -93 -03 for the
Chula Vista Center. On November 26, 2013, the Applicant submitted a revised Planned Sign
Program requesting additional monument signs, banners, directional signs, wall graphics, stylon
signs, and the replacement of the existing tower sign with a digital display sign.
As discussed in the report, the proposed monument signs are not in compliance with the City's
sign regulations in regard to the size, height, location, and number of signs. In addition, CVMC
Chapter 19.60 does not address banners, directional signs, wall graphics, or stylon signs.
Pursuant to Chula Vista Municipal Code (CVMC) Section 19.60.050J, a Planned Sign Program
can be submitted for review and approval by the Planning Commission to allow deviations from
sign regulations.
DISCUSSION:
Project Site Characteristics:
The approximately 55 -acre project site is located in the northwestern portion of Chula Vista, and
occupied by the Chula Vista Center shopping mall with retail shops and restaurants. The site is
bordered on the north, west, and a portion of the south along Broadway by commercial retail,
and single - family detached homes located along the south and east, and a portion of commercial
retail located along H Street to the east (Attachment 1, Locator Map).
Project Description
The overall proposal consists of adding new monument signs, banners, directional signs, wall
graphics, stylon signs, and the replacement of the existing tower sign with a digital display sign,
located throughout the Chula Vista Center on approximately 55- acres. The different proposed
sign types are shown in Attachment 4, Planned Sign Program and listed below:
• Six (6) monument signs
• Twenty -one (21) thematic banners
• Three (3) vehicular directional signs
• Four (4) stylon signs
• Five (5) wall graphics
• One (1) digital tower display sign
Monument Signs
Several monument signs would be placed along the street frontage to provide additional signage
for tenants. The Applicant is proposing four different types of monument signs, for a total of six
(6) monument signs. Double faced multi -tenant monument (Sign Type M1) would be placed in
two different locations, one adjacent to the easterly driveway entrance along East H Street and
another along the westerly driveway entrance along East H Street. The monument sign would
consist of approximately seven (7) tenant signs, the name of the shopping center, and a curved
wall. The proposed height of the sign is 20 -ft. with a total square footage of approximately 160
sq. ft. The attached curved wall height will be approximately 6 -ft.

Secondary monument signs (Type M2) would be placed in two different locations, one adjacent
to the northern driveway entrance and one adjacent to the southern driveway along Broadway.
The secondary monument signs would consist of approximately four (4) tenant signs with the
name of the shopping center. The proposed height of the signs is 12 -ft. with a total square
footage of approximately 96 sq. ft.
A Tertiary monument sign (Type M3.1) would be placed adjacent to the second westerly
driveway entrance off of I Street, next to the parking structure. The tertiary monument sign
would consist of approximately three (3) tenant signs. The proposed height of the sign is 7 -ft.
with a total square footage of approximately 35 sq. ft.
A second tertiary monument sign (Type M3.2) would be placed at the main entrance off of I
Street at the easterly driveway. The tertiary monument sign would consist of approximately three
(3) tenant signs, but would also include an extended wall with shopping center name. The
proposed height of the sign is 7 -ft. with a total square footage of approximately 35 sq. ft. The
attached wall height will be approximately 3 -ft.
Thematic Banners
Thematic banners would be placed along both entrances on East H Street, and also adjacent to
the right -of -way along Broadway. A total of six (6) banners would be sporadically placed along
the eastern driveway entrance along East H Street, a total of eight (8) along the western driveway
along East H Street, and seven (7) along Broadway. The banners will either be attached to the
existing light poles within the designated areas or attached to new 22 -ft. poles. The banners
would identify the shopping center name as well as the name of businesses within the center. The
banners attached to the poles will be 12 -ft. in height with a maximum square footage of
approximately 36 sq. ft.
Vehicular Directional Sign
Vehicular directional signs would be added in three different locations, noting the location or
direction of stores. Vehicular directional signs would be placed near the end of the eastern
driveway entrance off of East H Street, one at the northern driveway entrance off of Broadway,
and one located on the easterly driveway along I Street, adjacent to the right -of -way. The
proposed height varies from 4 to 8 feet with a maximum square footage of approximately 40 sq.
ft.
Stylon Signs
Stylon signs would be placed in four (4) different locations at the primary pedestrian entries to
the shopping center, adjacent to the stores. The stylon signs are proposed to display lifestyle,
business ID, or graphics for the shopping center. The structures would be 17 -ft in height and
consist of three panels in a triangular shape. The stylon sign attached to the poles will be 8 -ft. in
height with approximately a total square footage of 40 sq. ft. One side of the panel would consist
of the shopping center name and approximately twelve (12) tenant signs, another with a display
cabinet, shopping center sign, and picture, while the other displaying a possible graphic from one
of the stores.

Wall graphics would be placed in five (5) different locations throughout the shopping center. The
various locations include a wall graphic along the westerly wall of the parking garage,
Burlington Coat Factory's alley, Macy's alley, CVS Pharmacy entrance, and at the main
southern entrance to the mall along I Street adjacent to the circular drop off area. A typical wall
graphic would be 18 -ft. x 18 -ft. with a total square footage of approximately 35 sq. ft., and
consist of a digitally printed graphic with an aluminum frame. The graphic may include the
shopping center name, various tenant names, and picture and graphics related to the stores and
shops within the shopping center.
Digital Tower Display Sign
The existing tower sign, which contains the "Chula Vista Center" signage for the shopping
center along the northwestern edge of the building, is proposed to be replaced with a digital
tower display. The existing structure is approximately 72 -ft. in total height with signage at
approximately 55 -ft. in height with a total square footage of 350 sq. ft. No other changes will
occur to the tower structure. Different messages would appear throughout the day on the digital
display regarding the various businesses within the shopping center. The different messages
would not occur more frequently than every eight (8) seconds and would not have moving
images on the screen. There will also be no flashing, blinking, or moving lights. The digital
tower display shall be turned off no later than 10:00 p.m. each day.
ANALYSIS:
Compliance with Chula Vista Municipal Code and Urban Core Specific Plan
As described below, the proposed monument signs are not in compliance with the City's sign
regulations in regard to the size, height, location, and number of signs. In addition, CVMC
Chapter 19.60 does not address permanent banners, directional signs, wall graphics, or stylon
signs. However, per CVMC Section 19.60.050J, a Planned Sign Program can be submitted for
review and approval by the Planning Commission to allow deviations to the sign regulations.
The following summarizes the Planned Sign Program proposed variation from the sign code for
each type of proposed signage.
Monument Signs
Pursuant to the Urban Core Specific Plan and CVMC Section 19.60.540 (CC Zone provisions),
corner parcels containing five acres or more shall be allowed one (1) low profile ground
monument sign along each street frontage on a major or collector street. The sign shall have a
maximum height of eight (8) feet and maximum sign area of 50 square feet.
The Applicant is proposing two (2) primary monument signs along East H Street, two (2)
secondary monument signs along Broadway, and two (2) tertiary signs along I Street. The signs
would exceed the zoning requirement of one (1) sign along each street frontage. However, the
signage would meet the minimum 500 -ft. distance between signage on a corner parcel and major
street. The primary and secondary monument signs would also exceed the maximum allowed
height of 8 -ft., and maximum allowable sign area of 50 square -feet. The primary monument
signs would be 20 -ft in height with an approximate sign area of 160 square -feet. The secondary
monument signs would be 12 -ft. in height with an approximate sign area of 96 square -feet.

Pursuant to CVMC Section 19.60.050J, a Planned Sign Program can be submitted for review and
approval by the Planning Commission, to allow deviations to the applicable regulations. The
applicant is requesting that a sign program be approved to allow the deviations from sign code
requirements for monument signs as described above.
The proposed signs are in compliance with the Urban Core Specific Plan design guidelines,
Chapter VII, Design Guidelines, Urban Core District, Section E.9. The monument signs provide
the same or similar design materials and colors located on the existing tower sign. In accordance
with the USCP Design Guidelines, the placement of signs should provide visual clues to business
locations and affect the design integrity of the entire building. The signs are placed along the
street and throughout the site to provide signage for the different business. Per the USCP Design
Guidelines, signs should be consistent with the proportion and scale of building elements within
the facade. The additional height and overall size of the monument signs are in proportion to the
large scale of the shopping center that is situated on an approximately 55 acre site.
According to the Applicant, the shopping center is lacking signage for vehicles driving by the
site and people are not aware of all of the stores and shops located in the center. Additional
signage throughout the shopping center and at the main entrances can increase customers
awareness of the different stores and shops and possibly increase revenue to the Center. Due to
the size of the shopping center, staff concurs that the center could benefit from the addition of
these signs. The materials and colors of the signs are compatible with the building colors of the
shopping center. Staff recommends the additional signs be allowed, and that the signage
locations be approved as depicted in the sign program.
Thematic Banners, Vehicular Directional Sign, Stylon Signs, and Wall Graphics
The Urban Core Specific Plan and CVMC Section 19.60.540 (CC Zone provisions) do not have
regulations concerning these types of signs. Therefore, in order to place the various banners,
signs, and wall graphics throughout the site, a Planned Sign Program is required. According to
the Applicant, the addition of the signs will further help both the vehicular traffic and pedestrians
walking up to and around the mall to find the various stores and shops located at the shopping
center. Due to the size of the shopping center, staff concurs that the center could benefit from the
addition of these signs.
The proposed signs are in compliance with the Urban Core Specific Plan design guidelines,
Chapter VII, Design Guidelines, Urban Core District, Section E.9, whereas the placement of
signs should provide visual clues to business locations and affect the design integrity of the
entire building. The signs are placed at pedestrian and vehicle entrances throughout the site to
provide signage for the different business. In accordance with the USCP Design Guidelines,
signs should be consistent with the proportion and scale of building elements within the facade.
The various signs are in proportion to the large scale of the shopping center building that
expands over an approximant 55 acre site. Staff recommends the additional signs be allowed, and
that the signage locations be approved as depicted in the sign program.
Digital Tower Display Sign
The Urban Core Specific Plan and CVMC Section 19.60.540 (CC Zone provisions) do not have
regulations concerning this type of sign. However, as described above, Chula Vista Municipal
Code Section 19.60.050J allows a planned sign program when approved by the Planning
Commission or the City Council to modify the sign requirements. Approval of the subject

Planned Sign Program by the Planning Commission would establish site specific sign
regulations, which signs will have to comply with. The sign does not meet the definition of a
billboard sign per CVMC Section 19.60.060, since the sign will not display off -site commercial
messages and is not a principal use on the site. In accordance with Condition No. 5 of the
Planning Commission Resolution, the digital display shall not provide signage or advertising for
any business not located within the Chula Vista Center.
The existing tower sign, which contains the "Chula Vista Center" signage for the shopping
center along the northwestern edge of the building, is proposed to be replaced with a digital
tower display. No other changes will occur to the tower structure. The existing structure is

modification will be made to the overall height or width of the tower structure. The sign is in
proportion to the large scale of the shopping center building that expands over an approximantly
55 acre site. Staff recommends the digital display sign to be allowed, and that the signage
location be approved as depicted in the sign program.
CONCLUSION
Staff recommends that the Planning Commission approve the design and location of the
proposed signs, as depicted in the Chula Vista Center planned sign program, subject to
conditions noted in the attached Resolution
DECISION -MAKER CONFLICTS
Staff has reviewed the property holdings of the Planning Commission members and has found no
property holdings within 500 feet of the boundaries of the property, which is the subject of this
action. Staff is not independently aware, nor has staff been informed by any City
Councilmember, of any other fact that may constitute a basis for a decision maker conflict of
interest in this matter.
FISCAL IMPACT
The application fees and processing costs are paid for by the Applicant

RESOLUTION OF THE CITY OF CHULA VISTA PLANNING
COMMISSION APPROVING A PLANNED SIGN PROGRAM, PSP -13 -09
TO APPROVE NEW MONUMENT SIGNS, BANNERS, DIRECTIONAL
SIGNS, WALL GRAPHICS, STYLON SIGNS, AND THE
REPLACEMENT OF THE EXISTING TOWER SIGN WITH A DIGITAL
DISPLAY SIGN FOR THE CHULA VISTA CENTER ON AN
APPROXIMATELY 55 -ACRE SITE LOCATED AT 555 BROADWAY.
APPLICANT: BLEIER INDUSTRIES, LTD
WHEREAS, on November 26, 2013, a duly verified application for a Planned Sign
Program was filed with the City of Chula Vista Development Services Department by Bleier
Industries, LTD ( "Applicant'); and
WHEREAS, the application requests approval of a Planned Sign Program to approve new
monument signs, banners, directional signs, wall graphics, stylon signs, and the replacement of
the existing tower sign with a digital display sign for the Chula Vista Center on approximate 55-
acres ( "Project'); and
WHEREAS, the area of land that is the subject of this Resolution is an existing parcel
located at 555 Broadway ( "Project Site "); and
WHEREAS, the Director of Development Services has reviewed the proposed project for
compliance with the California Environmental Quality Act and has determined that the project
qualifies for a Class 11 Categorical Exemption pursuant to Section 15311 (Accessory Structures)
of the State CEQA Guidelines; and
WHEREAS, the Director of Development Services set the time and place for a hearing
on the Planned Sign Program application, and notice of the hearing, together with its purpose,
was given by its publication in a newspaper of general circulation in the City, and its mailing to
property owners and residents within 500 feet of the exterior boundaries of the property at least
10 days prior to the hearing; and
WHEREAS, the hearing was held at the time and place as advertised, namely February
12, 2014 at 6:00 p.m. in the Council Chambers, 276 Fourth Avenue, before the Planning
Commission and the hearing was thereafter closed.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Chula Vista does hereby make the following findings:
1. That the proposed project, as conditioned, is consistent with the sign guidelines adopted
for the Urban Core Specific Plan and the Chula Vista Municipal Code.
The majority of the proposed signs are not in conformance with Chula Vista Municipal Code
(CVMC) Chapter 19.60. In addition, CVMC Chapter 19.60 does not address banners,

directional signs, wall graphics, or stylon signs. However, CVMC Section 19.60.050J allows
a planned sign program when approved by the Planning Commission or the City Council, to
modify the rules as to the sign size, height, illumination, spacing, orientation or other non -
communicative aspects of signs. In accordance with CVMC Section 19.60.050J, approval of
the Planned Sign Program by the Planning Commission would establish site specific sign
regulations with regard to such regulatory aspects of signs as sign size, height, spacing,
location, and total number of signs. All signs placed on site will be required to conform with
the approved sign program. All signs are in compliance with the Urban Core Specific Plan
(UCSP) design guidelines, Chapter VII, Design Guidelines, Urban Core District, Section E.9
in terms of sign design, compatibility, and placement.
2. The project, as conditioned, is consistent with the design guidelines approved for the
Urban Core Specific Plan.
The proposed monument signs, banners, directional signs, wall graphics, stylon signs, and
the replacement of the existing tower sign with a digital display sign are consistent with the
design guidelines of the UCSP. The proposed signs are in compliance with the UCSP design
guidelines, Chapter VII, Design Guidelines, Urban Core District, Section E.9. Sign colors
and materials are compatible with the existing building colors and materials of the Chula
Vista Center. In accordance with the USCP Design Guidelines, signs should provide visual
clues to business locations and not adversely affect the design integrity of existing buildings.
The signs are effectively placed along the public right -of -way and throughout the site to
provide locational clues for the different business, and are complementary to the design of
the center. Per the USCP Design Guidelines, signs should be consistent with the proportion
and scale of building elements within the facade. The additional height and overall size of the
signs are in proportion to the large scale of the shopping center that is located on an
approximant 55 acre site.
BE IT FURTHER RESOLVED that the Planning Commission, based on the findings above,
hereby approves the Planned Sign Program subject to the following conditions:
The following shall be accomplished to the satisfaction of the Development Services
Director, or designee, prior to issuance of building permits, unless otherwise specified:
Development Planning Division
1. Prior to, or in conjunction with the issuance of the first building permit, pay all
applicable fees, including any unpaid balances of permit processing fees for deposit
account DQ -1764.
2. Obtain approval of a sign permit, and a building permit if required by the Director of
Development Services, for each sign approved in the Planned Sign Program. Signs shall
comply with the approved sign program, and all applicable provisions of the Building
Code.

3. Freestanding sign locations must conform to City of Chula Vista site distance
requirements in accordance with the CVMC.
4. All signs must be placed within private property, unless an encroachment permit is
obtained from the Engineering Department for any signs located within the right of way.
5. The digital tower display shall adhere to the exterior lighting standards and the Lighting
Analysis prepared by Daktronics, dated October 29, 2013 to prevent any light spill onto
adjacent commercial or residential properties. Details for said lighting shall be included
in the architectural plans and shall be reviewed and approved to the satisfaction of the
Director of Development Services, prior to the issuance of the building permit.
6. The digital tower display shall be turned off no later than 10:00 p.m. each day.
7. The digital tower display shall not display flashing images, scintillation or lights of
varying intensity in accordance with CVMC Chapter 19.60. Digital display shall only
provide signage for on -site business. Digital display shall not provide signage or
advertising for any business not located within the Chula Vista Center.
Landscape Architecture Division
8. Where feasible, all existing plant material and irrigation should be protected in place.
Any plant material and irrigation damaged during demolition and /or construction of this
Planned Sign Program must be replaced in like kind (minimum) to the satisfaction of the
City of Chula Vista's Landscape Inspector.
II. The following on -going conditions shall apply to the Project Site as long as it relies on
this approval:
1. Signage shall be installed in accordance with the Planned Sign Program. Additional
signage requires an amendment of the approved Planned Sign Program.
2. Approval of the Planned Sign Program shall not waive compliance with any Sections
of Title 19 of the CVMC, and all other applicable laws and regulations in effect at the
time of building permit issuance.
3. The Property Owner and Applicant shall and do agree to indemnify, protect, defend
and hold harmless the City, its City Council members, officers, employees and
representatives, from and against any and all liabilities, losses, damages, demands,
claims and costs, including court costs and attorney's fees (collectively, liabilities)
incurred by the City arising, directly or indirectly, from (a) City's approval of this
Planned Sign Program and (b) City's approval or issuance of any other permit or
action, whether discretionary or non - discretionary, in connection with the use
contemplated on the Project Site. The Property Owner and Applicant shall
acknowledge their agreement to this provision by executing a copy of this Resolution
where indicated below. The Property Owner's and Applicant's compliance with this

provision shall be binding on any and all of the Property Owner's and Applicant's
successors and assigns.
4. This Planned Sign Program shall become void and ineffective if not utilized within
three years from the effective date thereof, in accordance with Section 19.14.260 of
the CVMC. Failure to comply with any conditions of approval shall cause this permit
to be reviewed by the City for additional conditions or revocation.
III. EXECUTION OF RESOLUTION OF APPROVAL
The Property Owner and Applicant shall execute this document signing on the lines
provided below, indicating that the Property Owner and Applicant have each read,
understood and agreed to the conditions contained herein, and will implement same. Upon
execution, this document shall be recorded with the County Recorder of the County of San
Diego. Failure to sign the document shall indicate the Property Owner /Applicant's desire
that the project, and the corresponding application for building permits and /or a business
license, be held in abeyance without approval.

IV. GOVERNMENT CODE SECTION 66020(d)(1), NOTICE
Pursuant to Government Code Section 66020(d)(1), NOTICE IS HEREBY GIVEN that
the 90 day period to protest the imposition of any impact fee, dedication, reservation, or
other exaction described in this resolution begins on the effective date of this resolution
and any such protest must be in a manner that complies with Section 66020(a) and failure
to follow timely this procedure will bar any subsequent legal action to attack, review, set
aside, void or annul imposition. The right to protest the fees, dedications, reservations, or
other exactions does not apply to planning, zoning, grading, or other similar application
processing fees or service fees in connection with this Project; and it does not apply to
any fees, dedication, reservations, or other exactions which have been given notice
similar to this, nor does it revive challenges to any fees for which the statute of
limitations has previously expired.
V. CONSEQUENCE OF FAILURE OF CONDITIONS
If any of the foregoing conditions fail to occur, or if they are, by their tenns, to be
implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to
revoke or modify all approvals herein granted, deny, or further condition issuance of all
future building permits, deny, revoke, or further condition all certificates of occupancy
issued under the authority of approvals herein granted, institute and prosecute litigation to

compel their compliance with said conditions or seek damages for their violation. Failure
to satisfy the conditions of this permit may also result in the imposition of civil or
criminal penalties.
VI. INVALIDITY; AUTOMATIC REVOCATION
It is the intention of the Planning Commission that its adoption of this Resolution is
dependent upon the enforceability of each and every term, provision and condition herein
stated; and that in the event that any one or more terms, provisions or conditions are
determined by a Court of competent jurisdiction to be invalid, illegal or unenforceable, this
resolution and the permit shall be deemed to be automatically revoked and of no further
force and effect.

To Whom This May Concern:
The following letter and accompanying graph pertains to the Daktronics GalaxyPre Digital Display Center
proposed for installation at Chula Vista Center at 555 Broadway Ave in Chula Vista.
The accompanying graph depicts illumination levels that the proposed display will produce based on nighttime
running levels. These levels are based on a worst -case scenario of an all -white display. Actual levels will be much
lower than what is represented on the graph, as typical content runs at 25 to 35 percent of the brightness of an
all -white display. Illumination levels at 35 percent of the brightness would be the following at 400 feet:

The display is located 400 feet away from the nearest property line. Per the above chart, at 400 feet, the highest
illumination level produced would be only 0.05 foot candles. Most foot candle measuring devices are unable to
even record a level that low. Levels at distances and angles beyond are either nonexistent or so low a foot candle
meter wouldn't be able to record a level.
It is important to note that the accompanying graph assumes absolute darkness with regard to surrounding
ambient light. In other words, the presence of ambient light producing elements at night including but not limited to
roadway lighting, residential lighting, commercial lighting, the moon, etc. will further diminish the measured light
output from the display in question. Any ambient lighting elements that produce a lighting level higher than the
levels from the display will likely prevent any illumination from being measured from the sign itself.
Assuming Broadway Ave and H Street follow the Illuminating Engineering Society of North America standards for
outdoor major roadway lighting, (please see the accompanying document titled, "Dark Sky Recommended
Lighting Levels for Exterior Lighting ") the roadway lighting its elf would be producing 1.3 foot candles. Additionally,
existing street lights along the roadways further diminishes the amount of measurable light from the display. As a
result, the lighting from Broadway Ave and H Street will likely absorb the light from the display; preventing nearby
properties from viewing a measurable illumination level.
Additionally, the display in question is equipped so as not to exceed 0.3 foot candles above ambient light as
measured from the appropriate distance. This standard is based on the acceptable standards for outdoor

Finally, the graph's brightness levels are calculations of nighttime brightness levels. During daytime hours,
ambient light will almost always exceed the sign's brightness
