THE SECTIONAL PLANNII�'G AREA (SPA) PLAI�TI`TED
COMMUI�'ITI' DISTRICT (FORM BASED CODE)
REGULATIONS FOR OTAY RAI`'CH VILLAGE EIGHT WEST
V�'HEREAS. the propem� "�hich is the subject matter of this Ordinance is identified as
E�:hibit"A"attached hereto and incorporated herein b}�this reference and commonl��l:nowm as Otav
Ranch V"illaee Eight West.N�hich consists of approximately 3003 acres generall}�located south ofthe
esistine terminus of La Media Road, and southw�est of the intersection of Maedalena Avenue and
Main Street (Propem�); and
VdHEREAS, an application(PCM-09-18) to consider a new Sectional Planning Area(SPA)
Plan. includine Planned Community District Rewlations/Development Code (Form Based Code)
for Village Eight l�'est (Project) ���as filed �1th the City of Chula Vista Development Services
Department on Jul}� 30, 2009, bv Ota� Land Compam�, LLC ('`Applicant` and "O��mer`): and
R'HEREAS: the Project is intended to ensure that the Otay Ranch Villaee Eight R'est SPA
Plan is prepared in accordance with the Ota��Ranch General Development Plan(GDP)to implement
the Cin� of Chula Vista General Plan for Eastem Chula Vista to promote the orderly planning and
long term phased development of the Otay Ranch GDP and to establish conditions which w�ll enable
Otay Ranch Village Eight V✓est to exist in harmony ���ithin the communit}; and
WHEREAS, the development of the Propem�has been the subject matter of a General Plan
Amendment GPA-09-01, and Ota�� Ranch General De��elopment Plan Amendment GDPA 09-ll,
pre��iously appro��ed bv the Cin� Council on Februan� 26, 2013. by Resolution No. 20li-029
(GPA/GDPA Resolution); and
«'HEREAS. the de��elopment of the Propem� relied on the Ota�� Ranch General Plan
Amendment and General Development Plan Amendment Supplemental Environmental Impact
Report I�'o. 09-01; SCH #2004081066 (SEIR 09-01); and the Findings of Fact and Mitigation
Monitorine and Reporting Proeram. previously adopted on Februan� 26. 2013; and
WHEREAS; the Project is established pursuant to Title 19 of the Chula Vista Municipal
Code. specifically Chapter 19.48 (PC) Planned Communit��Zone, which is applicable to the Ota��
Ranch Villaee Eight West SPA Land Use Plan; and
V��I-IEREAS, the Project estabiishes a Form Based Code applicable to the Open Space
Preserve District;Open Space District.I�eiehborhood Edee District,Neighborhood General Disu-ict;
I�'eiehborhood Center District, To���n Center District, Park District Communin� Purpose Facilih�
District, and Basin District, located in the Otay Ranch Village Eight W'est SPA Land Use Plan; and

VdHEREAS, the Citv's Development Services Director has reviewed the Project for
compliance ti�ith the California Environmental Quality Act(CEQA)and determined that the Project
would result in a sienificant impact to the environment, and therefore,the Village 8 West Sectional
Plannine Area and Tentative Map Environmental Impact Report (EIR ]0-03) was prepazed; and
WHEREAS, the Planning Commission set the time and place for a hearing on said Project
and notice of said hearing, together��ith its purpose,was given by its publication in a newspaper of
general circulation in the Ciry and its mailing to property owners within 500 feet of the exterior
boundazies of the Project site at least ten days prior to the hearing; and
WHEREAS, the hearing was held at the time and place as advertised, namely 6:00 p.m.
November 20,2013 in the Human Resources Training Room located in Building C.Rooms B-111 R
B-112; 276 Fourth Avenue, and the Planning Commission voted 4-2-0-1 to approve Planning
Commission Resolution PCM-09-18 recommending to the City Council approval ofthe Project;and
WHEREAS,a duly noticed public hearing was scheduled before the City Council ofthe Cit}�
of Chula Vista to approve the Project; and
Whereas, the proceedings and any documents submitted to the City Council as the decision-
makers shall comprise the entire record of the proceedings.
NOW, THEREFORE, THE CITY CO[JNCIL ofthe City of Chula Vista does hereby order
and ordain as folloN�s:
I. PLANNING COMMISSION RECORD
The proceedings and all evidence introduced before the Planning Commission at their public
hearing held on November 20,2013 and the Minutes and Resolutions resulting therefrom,are
hereby incorporated into the record of this proceeding. These documents, along with any
documents submitted to the decision-makers. shall comprise the entire record of the
proceedings for any CEQA claims.
II. COMPL[ANCE WITH CEQA
Immediately prior to this action, the Ciry Council reviewed and certified EIR-]0-03 and
adopted the Findings of Fact, Statement of Overriding Considerations, and Mitigation
Monitoring and Reporting Program; pursuant to Resolution No. 2013-269.
III. ACTION
The City Council hereby adopts an Ordinance approving the Otay Ranch V illage Eight West
SPA Planned Communitp District Regulations (Form Based Code), finding that they are
consistent�vith the Cit}�of Chula Vista General Plan,the Otay Ranch General Development
Plan and all other applicable Plans, as set forih in Resolution No. 2013-270 adopting the
Village Eight West SPA Plan,and that the public necessity,convenience,general welfare and
good planning and zoning practice support their approval and implementation.

IV. SEVERABILITY
If an}�ponion of this Ordinance. or its application to anv person or circumstance, is for any
reason held to be im�alid, unenforceable or unconstitutional. by a court of competent
jwisdiction. that portion shall be deemed se��erable. and such invalidin�,unenforceabilin�or
unconstitutionalin shali not affect the��alidity or enforceabilitv of the remainin�portions of
the Ordinance.or its application to an��other person or cucumstance.The Cin�Council ofthe
Cin•of Chula Vista hereb��declazes that it would ha�-e adopted each section,sentence,clause
or phrase of this Ordinance: irrespecti��e of the faci that any one or more other sections,
sentences, clauses or phrases of the Ordinance be declazed im�alid, unenforceable or
unconstitutional.
V. CONSTRUCTIO\'
The Ciri� Council of the Cin� of Chula Vista intends this Ordinance to supplement, not to
duplicate or contradict,applicable state and federal law and this Ordinance shall be construed
in lieht of that intent.
VI. EFFECTI\'E DATE
This Ordinance shall tal:e effect and be in full force on the thinieth dav from and afrer its
adoption.
VII. PUBLICATION
The Ciq�Clerk shall certifi�to the passage and adoption oFthis Ordinance and shall cause the
same to be published or posted accordine to IaH�.
