RESOLUTION OF THE CITY COiJNCIL OF THE CITY OF

R'IIEREAS. on Februarv 5. 2008. the Ciri� Council. throueh Resolution No. 2008-04.i.
adopted the first three }�eazs of a five-}�eaz rate plan for Fiscal I'ear 2007/2008 to Fiscal Yeaz
2011/2012: and
WHEREAS, on June 8, 2010, the Citv Council adopted Ordinance No. 31» statine that
se���er service rates for Fiscal Yeaz 2009/2010 ���ould remain in effect until the Cit�� Council tal:es
action to increase, or othenvise adjust the rates; and
WHEREAS. staff e��aluated the sewer rates for Fiscal Year 2010/2011 and Fiscal Yeaz
2011/ZO12 and recommended no rate increases: and
��'HEREAS, in December of 2011, the City retained FCS Group to prepaze the sewer rate
study completed in November 2013 (Study); and
V�'HEREAS, the purpose of the review H�as to ensure that se���er rates will continue to
provide adequate fundine for (1) the cost of���aste�+�ater treatment services outsourced to the Cim
of San Diego's Point Loma Waste«�ater Treatment Plant (PLWTP); (2) the cost of operatine and
maintaining the Cit��`s se�ver collection s}�stem; and (3) im�estment in the infrastructure needed
to pro�ide sen�ice consistent with applicable federal, state, and local laws; and
WHEREAS. the Studv established the annual revenue needed to meet the utilin�`s
existins and projected obligations for the next fi��e ��eazs (Fiscal Yeaz 2014/201� to Fiscal Yeaz
2018/2019) and de��eloped a plan to provide for the continued fiscal health of the utility; and
WHEREAS; California Government Code section �37�6 permits agencies that provide
sew�er services to adopt a schedule of fees or charges authorizing automatic adjustments for a
five-}�eaz period that "passes throuah" inflationarv adjustments and/or increases in wholesale
charees: and
VdHEREAS, the Environmental Revie��� Coordinator has reviewed the proposed activit}�
(se�rer rate update) for compliance ���th the Califomia Environmental Qualit�� Act (CEQA) and
has determined that the activit�� does not constitute a "Project ' as defined under Section 1�378 of
the state's CEQA Guidelines; and_
V�'HEREAS; the adoption of the proposed se���er rate structure; as presented ro the Citv
Council and reflected in the attached Exhibit A, �vill ensure that the City recovers the revenues
necessan� to meet projected e�:penditures for the maintenance and operation of the City's se�ver
collection and treatment s��stem for Fiscal 1'ear 2013/2014 throuah 2018/2019: and

V�'HEREAS, the Citp Council finds that the Cih� has complied with the requirements of
California Constitution Article 13D; Section 6 (Proposition 218); and
WHEREAS, the Cih� Council finds that the City provided �ritten notice by mail of the
proposed increase in sewer service charges to the record owners of each identified parcel upon
which the increased charge is proposed for imposition and that the notice included the amount of
the charge increase, the basis upon which the amount of the proposed chazge increase was
calculated, the reason for the proposed chazge increase, together with the date, time, and location
of the public hearing on the proposed charge increase; and
WHEREAS, the Cit}- Council held a public hearing on December 17, ZOli to consider
the proposed increase in sewer ser��ice char�es; and
WHEREAS, the City Council considered all protests to the proposed increase in sewer
service char�es: and
WHEREAS, the City Council finds that the revenues derived from the increased se��er
service charges ���ill not exceed the funds required to provide the property related service; and
WHEREAS. the City Council finds that the revenues derived from the increased sewer
service charges shall not be used for any purpose other than that for which the charge was
imposed; and
WHEREAS, the City Council finds the amount of the sewer service charges imposed
upon any parcel as an incident of property ownership shall not exceed the proportional cost of
the service attributable to the parcel; and
WHEREAS, the City Council finds that the sewer service charges imposed are for a
service actuall}� used by; or immediately available to, the ow�ner of the property; and
WHEREAS, the Cit}� Counci] finds that written protests against the proposed sewer
service charge increases have not been presented by the o�vners or rate payers of a majority of
the identified parcels; and
WHEREAS, the City's existing sewer service charges are set forth in the Cit}� s Master
Fee Schedule, in Chapter 12, "Sewer Fees '; and
WHEREAS, the Master Fee Schedule shall be amended as necessary to reflect the
adopted sewer rates for Fiscal Years 2014/2015 through 2018/2019, as presented to the City
Council and contained on the attached Eshibit A, and effective as of.Iuly 1, 2014.
NOW, THEREFORE; BE IT RGSOLV[D by the Cit}' Council of the City of Chula
Vista, that it approves an increase in sewer service rates in the amounts reflected in the attached
Bxhibit A for Fiscal Years 2014/2015 through 2018/2019.

BE IT FliRTHER RESOL\%ED, that it appro��es the amendment of Chapter ]2 of the
A4aster Fee Schedule, as necessarv. to reflect the neH�l}� adopted se��er rates for Fiscal 1'eazs
2014/201� throuah 2018/2019, effective Julv l, 201�. as presented to the Cim Council and as
contained on Exhibit A. and directs the Finance Director to amend the A4aster Fee Schedule
accordinelv.
