HomeMy WebLinkAboutOrd 2014-3298 ORDINANCE NO. 3298 ORDINAI�'CE OF THE CITY OF CHtiLA VISTA AMENDII�'G SECTIO\' 9.12.160 OF THE CHULA VISTA A4UI�TICIPAL CODE RELATING TO BINGO LICE?�TSE APPLICATION FEE REFLTNDS WHEREAS, Section 9.12.160 (B) of the Chula Vista Municipal Code requires the payment of an application fee N�ith each bineo license application and states that "In the event an application is denied, �0 percent of the investigation fee shall be refunded`; and WHEREAS. the Cirv entered into a contract �=ith NBS to conduct smdies necessarv to determine the direct and indirect costs associated ��arious administrative and reeulatorv acti��ities conducted by the Cin�; and � �i%HEREAS. the Cost of Service Studv of User and Reeulatorv Fees. Selected Departments — Part I, prepared by NBS does not identifi� an}� cost savings to the City resulting from denied bingo license applications; and VdHEREAS, refundine a portion of the bingo license application fees to denied applicanu reduces cost recoven� for this activitv. NOW. THEREFORE. the Cirv Council of the Ciri� of Chula Vista does ordain as follows: Section I. Chula Vista Municipai Code section 9.12.160 (B) is herebv amended to remove the partial refund requirement for denied applications, and shall read as follo��s: 9.12.160 Binso—Term of license and fees. B. For a new license application or for each change in the bingo chairpersons who �rill manage the bineo eame; there shall be a non-refundable fee for in��estieation and for processine the applicanrs fineerprints. The required fee(s) shall accompany the submission of each application. Section II. Se��erabiliri� If any portion of this Ordinance, or its application to anv person or circumstance, is for any reason held to be invalid, unenforceable or unconstitutional, by a court of competent jurisdiction, that portio❑ shall be deemed se��erable. and such im�alidity, unenforceability or unconstitutionaliri� shall not affect the validin� or enforceabilin� of the remainine portions of the Ordinance; or its application to anv other person or circumstance. The City Council of the Cin�of Chula Visia hereb}� declazes that it ���ould have adopted each section, sentence. clause or phrase of this Ordinance; irrespecti��e of the fact that an}� one or more other sections. sentences, clauses or phrases of the Ordinance be declazed im�alid. unenforceable or unconstitutional. Ordinance 3298 Page 2 Section III. Construction The Citv Council of the City of Chula Vista intends this Ordinance to supplement, not to duplicate or contradict, applicable state and federal law and this Ordinance shall be construed in light of that intent. Section IV. Effective Date This Ordinance shall take effect and be in force on the thirtieth day after its final passage. Section V. Publication The Cit}� Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published or posted according to law.
