VISTA. COUI�'TY OF SAN DIEGO. STATE OF CALIFORI�'IA
The Cit�� Council of the Cirv of Chula Vista does ordain as follo���s:
Section 1. Pursuant to Califomia Go��emment Code section �3328.1(b) and
Resolution I�'o. 2013-2�7 (the "Resolution of Formation '). adopted b}� the Cit}� Council (the
"City Council") of the City of Chula Vista (the "City') on December ]0, 2013. and relating to
`Community Facilities District No. 20li-1 (Clean Energy Proeram), Cit�� of Chula Vista.
County of San Dieeo, State of Califomia` (the "DistricC'), a special ta.i is hereby levied on each
taxable pazcel ���ithin the District for the 20li-2014 fiscal }�ear and for each subsequent fiscal
year, in each case in the amount of the special tat specified for the fiscal year in the Unanimous
Approval Agreement (the "Agreemenr') pertaining to the parcel.
Section 2. The City n4anager oF the City or such officer's desienee (the "Ciri�
Manager`), 276 Fourth Avenue. Chula Vista, Califomia 91910 (telephone 619/691-�031) or an}�
officer or staff inember of the Cirv succeedine to the duties of the Cih� Manaeer. is authorized
and directed, ���ith the aid of the appropriate officers and agents of the Cit}�, to do the following:
(a) determine or cause to be determined each year. ���ithout further action of the Cit�•
Council, the appropriate amount of special tas to be levied on each parcel in the
District:
(b) prepare or cause to be prepared the annual special-ta� roll For the parcels in the
District in accordance ���ith the Resolution of Formation and this ordinance: and
(c) pro��ide or cause to be pro��ided all necessar}� and appropriate information to the
County of San DieQo Audiror-Convoller, in proper form and in proper time, to
effect the correct and timelv billing and collection of the special tas on the
secured property-ta� roll of the County of San Diego, except that: as stated in the
Resolution of Formation and in California Go��emment Code section 53340(e),
the Cit}� Council hereb}� reserves the rieht to enforce the collectio� of delinquent
special taxes throueh judicial foreclosure, including through the assignment of the
abilih to pursue judicial foreclosure as provided in the Act.
Section 3. The appropriate officers and agents of the City are authorized, if needed to
match the special-tax levy ���ith the assessor's parcel numbers the County of San Die�o uses in
sending out property-ta� bills, to make adjustments to the special-ta� roll before the final posting
of the special taxes to the ta� roll each fiscal vear.

Section 4. If a court with jurisdiction finds, for any reason, that any portion of this
ordinance is im�alid or that the special tax does not apply to any particular parcel. the balance of
this ordinance, and the application of the special tas to all other parcels, will not be affected.
Sectio� 5. Upon completion of the payment of the entire special-tax obligation for a
parcel within the District, as specified in the Agreement pertainin� to that parcel, the appropriate
officers of the City are authorized and directed, with the aid of the appropriate a�ents of the Cit��
and without further action of this City Council, to record or cause to be recorded a Notice of
Cessation of Special Tas for such parcel in accordance with Califomia Govemment Code section
�3330.�.
This ordinance was introduced at the rebular meeting of the City Council on
December 10, 20li. At the regular meeting of the City Council on December ]7, 2013; the title
of this ordinance was read and further reading was waived by the unanimous consent of the Cit}�
Council members present.
This ordinance shall take effect and be in full force on the date of its final passage and
before the expiration of fifreen (15) days from the date of its passage, it shall be published once
with the names of the members of the City Council voting for and against the same, said
publication to be made in a ne�vspaper of general circulation published in the City of Chula
Vista.
