That Chapter 1�.36 of the Chula Vista Municipal Code is herebv amended to read as follo���s: Chapter 15.36 FIRE CODE Sections: 1�.36.010 Califomia Fire Code, 2013 Edition, adopted b}� reference. 1�..i6.01� Definitions. 1�.36.020 Violation penalties. 1�.36.02� Failure to comply. 1�..i6.030 Response map updates. 15.36.03� Amvork. 1�.36.040 NFPA 13-D meter size. 1�.36.010 California Fire Code, 2013 Edition, adopted b�� reference. There is herebv adopted and incorporated by reference as if fully set forth herein; the California Fire Code, 2013 Edition; l:no�ti�n as the Califomia Code of Rewlations. Titie 24 part 9, including Appendix Chapter 4 and Appendix A throu_h K as cop}�righted by the Intemational Code Council, and the Califomia Buildina Standards Commission. ��fiich code and associated appendices prescribe the regulations governing conditions hazardous to life and property from fire or explosion, as the Fire Code of the Ciri�of Chula Vista, ezcepting such portions as are hereinafrer deleted, modified or amended as set forth in this chapter for the purpose of reeulation and enforcement ti�ithin the Cin� of Chula Vista. 1�.36.01� Detinitions. Chapter 2 Definitions - Section 202 of the Fire Code Portion of the Califomia Buildine Standazds Code is hereb�� revised to include the follo���ne definitions: "Chief of the Bureau of Fire Prevention" means Fire Mazshal. `Fire Department" means an�� regulazl�� organized fire department, fire protection district, a legall�� formed ��olunteer fire department recorded with the County of San Diego, or Fire Company re�ularl}� chareed ���ith the responsibilit}� of pro��iding fire protection to the jurisdiction. Ordinance No. 3291 , Paae 2 '`Fire Authority Having Jurisdiction (FAH.I)" means the designated entity providing enforcement of fire regulations as they relate to planning, construction and development. "Fire Hazard" means an��thing that increases or could cause an increase of the hazard or menace of fire to a greater degree than customarily recognized as normal by persons in the public service regularly engaged in preventing, suppressing or eztinguishing fire or any thing or act which could obstruct, delay, hinder or interfere ��ith the operations of the fire department or egress of occupants in the event of fire. "Fire Service Features" is a general tenn inclusive of all other terms such as driveway; fire lane, public street, private street, parking lot, lane and access roadwav. This Section 15.36.01� amends Section 202 of the Fire Code Portion of the Califomia Building Standards Code only by adding those definitions specifically identified in herein. I�'o other changes to Section 202 of the Fire Code Portion of the California Building Standards Code are contemplated or intended, and the ba]ance of the definitions therein shall remain unchanged and continue in full force and effect. 15.36.020 Violation penalties. Chapter 1 Scope and Administration - Subsection 109.4 Violation penalties of the Fire Code portion of the California Building Standards Code is hereby revised to read as follows: Subsection ]09.4 Violation penalties. Persons who shall violate a provision of this code or shall fail to comply «�ith any of the requirements thereof or who shall erect, install, alter, repair or do �vork in violation of the approved construction documents or directive of the fire codc ofticial, or of a permit or certiticate used under provisions of this code, shall be guilty of a misdemeanor; punishable by a fine of not more than the greater of$1,000 dollazs or as established by the City of Chula Vista Policy and Procedures Manual for Civil Penalties or by imprisonment not e�ceeding six (6) months, or both such fine and imprisonment. Each day that a violation continues afrer due notice has been served shall be deemed a separate offense. 15.36.025 Failure to compl��. Chapter 1 Scope and Administration - Subsection 11 ].4 Failure to compl}� of the Fire Code portion of the California Building Standards Code is hereby revised to read as follows: 111.4 Failure to compl}�. Any person who shall continue any �vork afrer having been served with a stop �vork order, e�cept such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to a fine of not less than $250.00 dollars or more than $I,000 dollars. • Ordinance No. 3291 Paae 3 15.36.030 Response map updates. Chapter 8 Interior Fuush, Decorative Materials. and Fumishing - Subsection 807.4.3? Amvork of the Fire Code portion of the California Buildine Standards Code is hereb}� revised to read as follo���s: Subsection 807.4.3.2. Art�vork. Art���ork and teachina materials shall be limited on the �valls of corridors and classrooms to not more than 20 percent of the ���all azea in non- sprinklered buildings and �0 percent in sprinl:lered buildings. 1�.36.040 1VFPA 13-D meter size. Chapter 9 Fire Protection Systems - Subsection 903.2.8.2 NFPA li-D meter size is hereby added to the Fire Code portion of the Califomia Building Standazds Code to read as follo�+�s: Subsection 903.2.8.2 NFPA li-D meter size. The minimum water meter size servine NFPA li-D (d�+�elling) fire sprinl:ler s��stems shall be no less than one (1) inch in diameter. SECTION II. FII�TDII�'GS A\D DECLARATION The City Council of the City of Chula Vista specificall�� and expressly finds and declazes that each of the additions and amendments noted abo��e to the 2013 Edition of the Califomia Fire Code is necessarv due to local climatic, eeoloeical and topoeraphical conditions.
