RESOLUTION OF THE CITY COUNCIL OF THE

CITY OF CI"iULA YI69'A ADOPTING BUDGET AND APPnOVING
MEMORANDUM OF AGREEMENT FOR EXPENDITLTRE OF
GAS TAX ALLOCATION FOR MAJOR CITY STREETB.
WHEREA3, a memorandum of agreement ,has been presented
to be entered into with the State of Cali:ornia in accord-
ance with a pro�ect atatement eubmit,ted by the City of
Ctuila Y16La for expenditure of the gae tax al-
location to cities for the Plscal year 19j2 , and
WHEREAB, the city council has heard read said agree-
ment in full and ie familiar with the contents thereof;
THEREFORE, be it resolned by the city council of the
City of Chula Vieta that said pro�ecti etatement
be and it is hereby adopted ae the budget of proposed ex-
� pendituree of the gae tax allocation to citiee, and eaid
agreement be and the eame is hereby approved and the mayor
and the city clerk are direbted to sign the eame on behalP
of said City, eaid agreement to be binding upon the City
upon its execution by the authorized oPficials of the State.

and Fiigriwsys Code , a sum equal to five-eighths of one cent

oenditura in cities ia the proportion taat the total popu-
lation of each city be�rs to the total popul>tion of all
cities in t'r_iG State; and
WHE?EAS, Section �95 of the St^eets and Alghways Code
orovides that two-fifths of the money allocated under the
provisions o: Section 194 =ha11 be expended for the main-
t�nsnce of the systen of u�d,Jor city �treets and of the sec-
ondary city �treets within �uch city; provi3ed that , with
� t'_-�e approval of the depart�=nt, a portion of such money so
allocated for naintenance may be ezpended for construction
of streets included witnin the system of ma�or city streets
t,�ithin such city; and

ARTICLE II. MAINTEldANCE
The streets will be maintained by or under the direct
_ supervision of the city . Meint°n2nce shall be as defined
in Section 27 of the St^eets and Highkays Code which is
not in confllct with Section 195 of the Code . 2daintenance
kork shall be adequate to preserve and keep the roadway,
structures and facilities in the safe and ueable condition
to whic_^. they have been improved or constructed, snd pro-
vision shall be made fo^ constantly makin� needed repairs
to preserve a .smooth surf�ce .
Any city-owned equipment used for the maintenance
work may be charged for upon a rental basis to cover de-
preciatlon and repairs in case rental. rates already have
been establi�hed by the city; otherwiee, sllowance for 3e-
preciatlon and repairs msy be ch�rged for as approved by
the department .

ARTICLE ITI. SURVEYS AND PLANS
The city will m�ke the surveya s.nd plans Por the work
deeignated in pro'ect 19 and �ill defray the coet from the
gae tax allocation for ma�or city streete.

ARTICLE IV. CON3TRUCTION
The city will con�truct or cause to _be construeted by
or under its direct supervision, and in sccordance with
*he sparoved plans , specificat±ons and estimstes therefor,
the ±mprovements descr!bed in pro�ecte 9 and 19.
� Plans, specificatlons and a detailed estlmate of coet
shall be submitted to the department for approval_ bePore -
the work is advertised for bids or in case of work approv- _
ed to be done by day lsbor before work 1s etarted; and no
changes may be made in the approved plane or epeaifioatione
without the prior a�provsl of the department . :
The construction work described in Artiole I shall be
performed by contract unles� the per:ormanoe therOOP by
day labor shall be approved by the department.
The work shall be done to the satiefaotion of the de-
uartment and shall be sub�ect at all times to inspeotion
_ and approval by the authorized representativee of the de-
partment.
Any city-owne3 equi�ment used for _the construotion
�aork described in Article Z may be charged for upon a ren-
*al basis to cover depreciation and repairs in Caee rental
rates already have been established by the oity; otherwise,
allowance for 3epreciat±on ann repairs may be charge3 for
aG �oproved by the department .

ARTICLE p, FUNDS
F�nds to defrsy the cost of the work described in Ar-
ticle I and payable from revenue accruing_ under the oro-
visions of Section 2107 of the St^eets and Highways Code
are available as follows :
Accrued and unbudgeted to June 30, 1951 � 2,559.26
Estimated to accrue during the Yiacal �

The amount of e+,�.t+.8�82cJ, 2� is budgeted to defray the
cost of the work described in Article I .
� The annual revenue and the amount provided for the
pro�ects listed in Article I are estimated amounts . In
the event that the actual revenue or the actual cost of
the pro�ects differs from estimated amounte, the approved
budget may be amended only by supplemental agreement .
The department hereby delegates to the city the e�en-
diture of the funds provided herein to defray the cost of
the work described in Article I.
Quarterly, in the months of August, November, Febru-
ary and May, the department will pzy to the city its pro
rata share of the money allocated under the provisions of .
Section 2107 of the Streets and Aighways Code until
$ �+8,029.26 budgeted herein and delegated to the
city for expenditure has been paid, .in addition to the
amount of $ Noae previously oaid to the clty
and remaining unexpended in the ci�y ' s special gas tax
street improvement Pund.

The amount provided for the .pro�ecta listed in Arti-
cle Z must not be exceeded, and no moneys may be expended
by the city from the special gas tax sxreet improvement
fund except for the pro�ectg listed in Article I wit�out
emending the budget by supplemental agreeaent . Such suo-
plemental agreement s�all be valid only when executed by
the city and the department .
All funds allocated under the provisions of Section
2107 of the Streets and Highways Code in excess of such
fun3s budgeted herein for zxpenditure will sacuuulate for
future bu3geting and expenditure.
ARTICLE y�, FINAL :iEPORTB
The city will submit such reports as required b� law
in such detail as required by the department. The reports
shall show in full all expenditures from all other funds
" as well as expenditures from the special gas tsx street
improvement fund.
Within sixty days after the close of the fiscal year
ending June 30, 1952, the city shall submit to the depart-
ment a statement of expenditures made from the speclal gas
tax street improvement fund during the preceding yesr for
the maintenance of the streats described in Article Z .
Maintenance expendltures shall be. analyzed by func-
tions and ob�ects as follows :
Funetions :
( 1) Tranelled way, including roadside and improved
shoulders .
_ ( 2) Structures .
(3 ) Safety devices, including stop sSgns, autoraatic
signals , traffic stripes and parking stripes , ,
(4) Street cleaning, including the reaoval of snow
or sand drift.
_ Ob�ects :
( 1) Balaries and wages .
( 2) Materials and supplies .
(3 ) Service and expense ,
(4) Equipment rental.

Within sixty days after completion of any item of
the bud�et for surveys an3 plans , acquisltion of r±ght of
way or construction, the city will submit to the depart-
ment a final report of expenditures made for euch work.
The reports shall be in the following forn:
: RIG:iT OF WAY: Expenditures shall be segregated by
-. parcels and payment for each parcel analyzed as follows :
- ( 1) Value of land teken.
( 2) Severance damages l�ss beriefits .
(3) Moving improvements .
(4) Damages by change of grade, etc . •
Where removing, restoring or altering improvemente
-. is not included in the payment for the land, the expendi-
tures for such itema shall be reported for each parcel or
ownerehip. The report shall algo show expenditures for
salary of right of way agent and miscellaneous expendi-
tures �uch as title reports , agent' s ezpense account, auto-
mobile operation, eto . ; these expenditures being analyzed
by the four ob3ects :
( 1) Salaries and wages .
( 2) Materials and supplies .
(3) 3ervice and ezpenae .
(4) Equipment rental.
PRELIMINARY ENGINEERING: The reoort sha;l ehow the
work accomplished and shall be analyzed by the four ob-
�ects :
(1) Salaries and wages .
( 2) Materials and supplies .
(3) Service and expense .
(4) Equ±pment rental.
CONSTRUCTION: The report shall show payments to the
contractor detailed by contract items showing quantity,
unit, item, unit price and amount; and the amount paid
for any mat=rials , supplies , labor or equipment furnished
by the city for use on the contract. Expenditures for
work performed by day labor shall be detailed to show the
quantity for each item of work, the unit cost and amount.
