THS CITY COUNCZL OF THE CITY OF CHULA VISTA, DO�,S HEREBY RESOLVE _
AS FOLLOWS:
SECTION 1. That certain agreement bet�reen WARREN F. THOMAS
and ESTHER C. THOP+IAS, husband and wi£e, and the CITY OF CHULA
VISTA , a municipal corporation, dated January 9th, 1951, a copy
' of which is attached hereto, and incorporated herein, the same
as though fully set forth herein, be, and the same is, hereby I
approved..
SECTION 2. That Z. D'dIGHT KIDDER, A7ayor of the City o£
Chula Vista, be and he is hereby, authorized and directed to
execute the same for and upon behalf of the said City upon the
posting of the bonds by WARREN F. THOI+IAS and ESTHER C. THOMAS,
as provided for in said agreement .

of said above-described property, to be known as BAY V"ISTA N0. 2,
and to eifect the same has heretofore filed with Lhe proper autnori-
ties o�' the said City of Chula Vista the necesssry maps and im-
proveme.t plans and other data in conformity with the laws of the
State of California and the ordinances oi the City of Chula �ista
applicable thereto, and
WN��EAS the said proper authorities of said City have found
the proposed subdivision plan to be acceptab�e and in accord wiih
the best interests o£ said City, and

tbe Secend Party, and does requrre from Second Party, as a con-
dition precedent to Lhe acceptance of any and all streets and

sents in said subdivision as is provided there:or in said plans
and attendant specificstions as have heretofore been approved as
aforesaid, and

1. Said Second Party agrees to undertake and complete,
and to pay for all labor and materials in cormection therewith,
within a period of 365 days from the date hereoi, all the necessary
work and instailation of iaprovements in the hereinabove described
_ subdivision �n full con_'ormi�y Hith the Ordinznces of the City of
Chula Vista, the laws of the State of California and the direct_ons
o£ prooer ofiicials of the City of Cc:ula Vista, Cali£ornia as may
be applicable thereto. Said imarovenenis are more particularly

The Second Party further agrees to inde�ni£y, protect and
hold harmless the said City o£ Chula 4ista fro� any and all claims �
of liaoility for personal injury, nronerty damage, labor or
aaterial claims which may be made against said City by reason of
sai3 work and installation of improvements as herein provided.
2. As a guarantee and as securi� y for its full and faith-
£u1 oerformance in co�plying wiLh a11 the require�ents for the com-
ple�ion of s2id subdivision as aforesaid, tne' said Second Party
shall deliver t o the' said City o£ Chula Vista, upon the execution
oi this agree�ent, a good and suf:icient bond executed by an
autnorized surecy comoany satisfactory to the said Cit y oi Chula
Vista in the sum of �13,000.00.
- 3. As a guarantee aad as security for ;.he pay9ent o� all
labor and material clair,s for the complation of all .said imorove-
men�s, the second party shall deliver to the said City of Chula
Vista a bond in the su.� o_` �y6,500.00, by its ter�s �de to inurz

4• UDOR the execution by Second ?a:ty of this contract
