THE CITY COUNCIL OF THE CITY OF CH ULA VISTA, DOES HEREBY RESOLVE AS FOLLOWS: SECTZON 1. That certain agreement between the MIGUEL COMPANY, a co-partnership, composed of R. E. TYSON, A. L. LYNDS and H. H. JOHNSON CON3TRUCTION CO. , a corporation, and the CITY OF CHULA VISTA, a municipal corporation, dated September 12th, 1950, a copy of which is attached hereto, and incorporated here- in, the same as though fully set forth herein, be, and the same is, hereby approved. • SECTION 2. As a guarantee and as security for its full and faithful performance in complying with all Lhe recuirements for the com- pletion of said subdivision as a£oresaid, the said Second Party shall deliver to the said City o£ Chula Vista, upon the execution of this agree�uent, a good and sufiicient bond executed by an authorized surety company satisfactory to the said City o£ Chula Vista in the svm of $42,437.75• 3• As a guarantee and as security £or the payment of all labor and material claima £or the completion of all said im- nroveaents, the second party shall deliver to the said City of Chula Vista a bond in the sum of $21�21$.BS, by its terms made to inure to the benefit o£ laborers and materialmen for labor and material performed or furnished in the performance of this ag^ee- ment. 4. Upon the execution by Second Party o£ this contract and the posting of the bonds as herein provided, the City agrees to approve the Final Diap o£ said subdivision and accept the same ior recordation.
