ANAGERI�/k� C�� 4/�THS VOTE: YES � NO ❑ SU��I4ARY On il4azch 13; 2012; Cii}� Council approved Resolution No. 2012-04� a�vardine a contract to 3-D Enterprises, Inc. for the Third Avenue Streetscape Improvement Project; Phase I, CIP \�o. STL362. Due to a combination of unanticipated field conditions, a number of desired enhancement change orders and a lo���er than normal contingency percentaee; overall contract expenditures exceeded the Council approved contract amount and contineencies by $90;000. The proposed action �i�ould reduce the STL388; Pavement Minor Rehabilitation FY 2012-li CIP budeet by $90;000 in Gas Tax Funds and appropriate the equivalent amount to STL-362 to co�er the final report of expenditures. E\�'IRO\�'IENTr1L REVIEN The Development Sen�ices Director has revie�ved the proposed action for compliance ���ith the Califomia Environmental Quality Act (CEQA) and has determined that the related project ���as co��ered in previouslv adopted Final En��ironmental Impact.Report for the Chula Vista Urban Core Specific Plan (UCSP), Final En��ironmental Impact Report-O6-01 ("FEIR-06-01"). Pursuant to the Califomia Environmental Quality Act (CEQA) on Aprii 26; 2007 the Citv; actine as Lead .Aeenc}�, certified FEIR-06-01 for the UCSP. On Januar}� 2�, 201 I the Cih; actine as Lead Aeency; having found and determined that cenain amendments to the UCSP, including the referenced Third Avenue Streetscape improvements, �vould not result in significant unmiti2ated impacts and that only minor technical changes or additions to FEIR-06-01_��ere necessan� and that none of the conditions described in Section 1�162 of the State CEQA Guidelines calling for the preparation of a subsequent environmental document had occurred; adopted an Addendum to FEIR-06-01. Therefore, no further CEQA actions or determinations aze necessary. 6-1 12/17/13, Item � Page 2 of 3 Additionally, because the project proposes to utilize federal Community Development Block Grant (CDBG) monies, the Development Services Director has also reviewed the proposal for compliance with the National Environmental Policy Act (NEPA) as implemented by the U.S. Department of Housing and Urban Development (HCJD) Environmental Guidelines. The Development Services Director has determined that the project proposal qualifies for a previously certified Categorical Exclusion (subject to 58.5) pursuant to Code of Federal Regulations (CFR) Title 24, Section 58.35(a). Thus, no further NEPA em�ironmental review or determination is necessar}�. RECOMMENDATION Council adopt the resolution. BOARDS/CODZMISSION RECOMMENDATION Not applicable. - - DISCUSSION 3-D Enterprises, Inc. recently completed Phase I of the Third Avenue Streetscape Iinprovement Project from STA 28+50 South of Center Street to "H" Street. The project included 248 contract bid items and 55 change orders. Final accounting revealed that the project budget �vas overrun by $90,000. This complex streetscape improvement project included unique features and challenging field conditions such as decorative pavers in pedestrian and vehicular areas and extensive electrical and landscape improvements. All work had to be done with minimal impact to businesses on either side of the road and to the traveling public along Third Avenue. Several unanticipated field conditions were encountered that added extra costs to the project such as contaminated railroad ballast in the center of the road that required special hazazdous waste disposal and unmarked underground utilities that required realignment of proposed improvements. Storm drainage improvements and additional street reconstruction along the perimeters of the project �i�ere also added in order to better transition to surrounding existing improvements. Several community meetings held with TAVA and local business owners contributed in staff incorporating improvement enhancements such as replacing standazd landscaping lighting to more energy efficient and longer lasting LED lamps, utilizing higher quality digitally printed directory maps, changing co]or of the park benches and adding concrete planter boxes. All these design changes added significant cost to the project. Typical contingency rates for City CIP projects range beriveen 10 and 15 percent. Ho�vever, due to limited project funding, this project only had a contingency rate of 6.6% which contributed in the project cost overrun. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the Cit}� Council and has found no property holdings within 500 feet of the boundaries of the properties, which are the subject of this action. Staff is not independently aware, and has not been informed by any City Council member, of any other fact that mav constitute a basis for a decision maker conflict of interest in this matter. 6-2 12117/13, Item to Page 3 of 3 RELATIONSHIP TO THE CITI"S STATEGIC PLAN The Cit}�'s Strategic Plan has five major goals: Operational Excellence, Economic Vitaliri�, Healthy Communin�; Strong and Secure I�iei2hborhoods and a Connected Communin�. The Third .Avenue Streeucape Project addresses all fi��e eoals; Operational Excellence — the project included the latest technoloey in street liehting; electrical and irrieation sti�stems and decorative paver construction intended on reducine future maintenance and lo�rerine energy costs. Economic Vitalit}� — the project enhances the «�aikabilit�� and aesthetics of the Do��mto��m azea and includes ne�v directory siens encouraeine shoppine and dinin2 in the surroundine businesses. Health}� Community — the project includes ne�v multi-modal transportation impro�ements such as bicvcle "sharrow" stripine; bike racks, bus priorirv vaffic sienals; and scooter pazking. Strone and Secure \'eighborhoods — the project indudes «�ider enhanced decorative side�+�alks; modern streetside landscapin2 and efficient and brieht LED pedestrian liehting to create a safe and appealing neighborhood. Connected Communin� — the project improvements closely followed the Third Avenue Streetscape Master Plan which �vas appro��ed throueh a collaborative effort invol��ine the communih� and stakeholders. CURRENT YEAR FISCAL INIPACT There is no impact to the General Fund associated �;�ith this action because sufficient Gas Ta.� Funds aze available via inter-project transfer from the recently a���azded STL388 D4inor Pavement Rehabilitation contract �i�hich resulted in a sienificantiv lower than anticipated bid. O\'GOING FISCAL IA�IPACT: The Third Avenue Villaee Association (TAVA) ��Rll assume responsibilin� for a majority of the streetscape's maintenance in accordance �vith an aereement approved by City Council on December li, Z011, by Resolution No. 2011-2»; the City will maintain the streets; street palm trees, and street pavers (for line and grade onlv) at a cost to the City not more than similaz streets that do not have such streetscape enhancements. STL362; REDUCING THE STL388 CIP BUDGET BY $90,000 IN GAS TAX FUNDS; AND APPROPRIATING THE EQUIVALENT AMOUNT TO STL362 WHEREAS, on March 13, 2012, City Council approved Resolution No. 2012-045 awarding a contract to 3-D Enterprises, Inc. for the Third Avenue Streetscape lmprovement Project, Phase I, CIP No. STL362; and WHEREAS, 3-D Enterprises, Inc. recently completed Phase I of the Third Avenue Streetscape Improvement Project from STA 28+50 south of Center Street to "H' Street; and WHEREAS, due to a combination of unanticipated field conditions, a number of desired enhancement change orders and a lower than normal contingency percentage, overall expenditures exceeded the Council approved contract amount and contingencies by $90,000; and WHEREAS, sufficient Gas Tax Funds are available via inter-project transfer from the recently awarded STL388 Minor Pavement Rehabilitation contract which resulted in a significantly lower than anticipated bid. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept the final report of expenditures for the Third Avenue Streetscape Improvement Project, Phase I, CIP No. STL362; reducing the STL388 CIP budget by $90,000 in Gas Tax Funds; and appropriating the equivalent amount to STL362.
