This action covers rn�o sections of East Palomar Sueet that �rere offered for dedication to the
City but were rejected at the time the maps that created the Streets were recorded. Pursuant to
the provisions of the Subdivision Map Act these offers of dedication remain open and can be
accepted at an}Kime by the City Council. These sections of East Palomaz Street are no�v readv to
be accepted.
E\T�'IROI�`1�4ENTr1L REVIE�V
The D'uector of Development Services has revie�ved the proposed activity for compliance �+�ith
the California Em�ironmental Quality Act (CEQA) and has determined that the proposed action
consisting of accepting offers of street dedication; �vhich do not result in any changes in land use
or densin�; qualify for a Class � cateeorical exemption pursuant to Section 1�30� [A4inor
Alterations in Land Use Limitations]of the State CEQA Guidelines. Thus, no further
environmental review is required.

DISCUSSION
As the eastern section of the City was developed the various streets �vere mapped; offered for
dedication to the City, accepted and ultimately built and operated. There aze some street sections
that were never accepted by the City. This action covers two sections of East Palomar Street that
were offered for dedication to the City but were rejected at the time the maps recorded. They
were rejected at the time because the street improvements had not been constructed and accepted
as complete. The £irst section of East Palomar Street travels west from Heritage Road to the
original tract boundary one half mile to the west. Upon completion, construction defects became
appazent that precluded the City from accepting the street. After prolonged litigation with the
contractor(s), all issues have been settled and the street sections can no�v be accepted.
The second area of East Palomar Street to be accepted by this action lies immediately
northwesterly of Olympic Parkway. Approximately 7�0 feet of East Palomar was offered for
dedication to the City on Map No. li962. This offer was rejected on the Map because at the
time the street improvements had not been constructed and accepted as complete. The
improvements have been constructed and accepted as complete so this section of East Palomar
Street should be accepted at this time.
Pursuant to the provisions of the Subdivision Map Act these offers of dedication remain open
afrer they were rejected on the Maps and can be accepted at anytime by the City Council.
DECISION-MAKER CONFLICTS
Staff has reviewed the property holdings of the City Council and has found no property holdings
within �00 feet of the boundaries of the property ��hich is the subject of this action. Staff is not
independently aware, nor has staff been informed by any City Council member, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.
RELATIONSHIP TO THE CITY'S STATEGIC PLAN
The City's Strategic Plan has five major goals: Operational Excellence, Economic Vitaliry,
Healthy Communit}�, Strong and Secure Neighborhoods and a Connected Community. The
acceptance of right of�vay addresses the Strong and Secure Neighborhood Goal by allo���ing the
City to maintain our roadway assets.
CURRENT YEAR FISCAL IMPACT
There is no direct impact to the General Fund associated �i�ith this action.

RESOLUTION OF THE CITY COUI�'CIL RESCIIvDNG
THE REJECTIO\' OF OFFERS OF DEDICATION FOR
PORTIONS OF EAST PALOD4AR STREET AND
ACCEPTING THOSE OFFERS PURSUANT TO SECTION
66477.2 OF THE SUBDIVISOI�� MAP ACT
, WHEREAS a portion of East Palomar Street ��as offered for dedication to the
Ciri� of Chula Vista on Map No. 14029 recorded August 30; 2000; and
�'HEREAS said Offer of Dedication was rejected on said Map; and
V��HEREAS a portion of East Palomaz Street ���as offered_for dedication to the
City of Chula Vista on Map No. 13962 recorded Apri128; 2000; and
WHEREAS said Offer of Dedication ���as rejected on said I�4ap; and
WHEREAS said portions of East Palomaz Street are necessary and now needed
for the purposes set forth in the Offers of Dedication; and
\�'HEREAS pursuant to Section 66477.2 of the Subdivision Map Act both Offers
of Dedication remain open and can be accepted by the Cin� Council at any time.
NOV�'. THEREFORE. BE IT RESOLVED bv the Ciri' Council of the Citv of
Chula Vista that the City does hereby rescind the rejection of the herein described Offers
of Dedication, that it now accepts such offers of dedication for Public Use and directs the
Cit�� Clerk to record a certified copy of this resolution with the San Dieeo Count��
' Recorder; evidencine this acceptance.
