The Department of Resources Rec}�cline and Recovery (CalRecycle) has allocated
$LS00,000 for the Local Govemment �1Taste Tire Amnesty Grant Proeram (Proeram) for
fiscal year (F1') 20li/14. Public Resources Code Section 42889 authorizes CalRecycle to
etpend funds from the Califomia Tire Recycling n4ana2ement Fund (Tire Fund) to pati�
for the cost of cleanup; abatement; or other remedial actions related to the disposal of
Califomia waste tires. The Program provides funds for eligible applicanu to hold
amnesty events at com�enient locations for the public (indi��iduals, not businesses) to take
their „�aste tires for recycling at no chazge. Chula Vista«as a���arded �28;526 and staff is
requesting that Council accept the grant and appropriate the monev into the Was[e
A4anaeement Fund.
ENVIRONA'IENTAL REVIE�V
The Development Services Director has re�-ie��ed the proposed activity for compliance
�vith the California Environmental Qualiq- Act (CEQA) and has determined that
the activity is not a "Project" as defined under Section 1�378 of the State CEQA
Guidelines because the activiri� consists of an administrati��e/fiscal action that Hill not
result in direct or indirect physical chanees to the environment. Therefore, pursuant to
Section 1�060(c)(3) of the State CEQA Guidelines the activin� is not subject to CEQA.
Thus; no environmental revie�v is required.

DI5CUSSION
Per Resolution No. 20li-OZS approved on February 26, 2013, City Council authorized
the submittal of applications for CalRec}�cle grants for ���hich the city is eligible to apply
and authorized the Public Works Director to execute all grant documents and implement
projects funded by CalRecycle. The Environmental Services Section applied for and
received an a�vard of$28,826 for Local Government Waste Tire Amnest}�Events.
The CalRecycle Tire Amnesty Grants are reimbursement grants and aze provided to fund
the cost of cleanup, abatement, or other remedial actions related to the disposal of waste
tires collected at amnesty events. The Waste Tire Amnesty Grant is offered every t�vo
years in odd year, and each program will have a t���o year grant term. This grant term
ends: June 30, 2015.
Waste Tire Amnesty grants include funds for collection events for tl�e public and are not
intended for the disposal of ���aste tires from �vaste tire generating businesses (PRC
§42954(7)). Amnesty events 1) allow citizens to bring �vaste tires to convenient locations
for proper management up to t���ice per month per location or 2) can consist of a coupon
program that allo���s citizens to bring in waste tires on specified days.
This is the first time Chula Vista has applied for tlus grant. The award of$28,826 may be
used to advertise tire amnesty events and program specifications; staff time at the event;
�vaste tire loading and transporting; and cost of disposal/recycling.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is
not site specific and consequenUy, the 500-foot rule found in California Code of
Regulations section 18704.2(a)(1), is not applicable to this decision.
CURRENT YEAR FISCAL IMPACT
This program is in line with the Healthy Community goal in the City's strategic plan - to
protect and promote the sustainability oF natura] resources through innovative programs
and policies. If approved, $28,826 �i�ill be appropriated to the Waste Management Fund
Personnel $9;280 and Supplies and Services $19,546. The program does not require
matching funds. Therefore there is no direct impact to the General Fund.
ONGOING FISCAL IMPACT
Funds will be reimbursed to the Cit}� upon submittal of the final report due to Ca1Rec}�cle
on September 30, 201�.

DESIGNEE TO EXECUTE ALL GRANT DOCUMENTS AND
IMPLEMENT PROJECTS F'CTNDED BY CALRECYCLE
GRANTS, FOR A PERIOD OF FIVE YEARS
1� WHEREAS, Public Resources Code sections 40000 et seq. authorize the Deparm�ent of
Resources Recycling and Recovery (CalRecycle}, formerly known as the Catifomia lntegated
Waste Management Board, to adrninister various Grant Programs (grants) in furtherance of the
' state of California's (State) efforts to reduce,recycle and reuse solid waste generated in the State
thereby preserving landfill capacity and protecting public health and safety and the environment;
and
WHEREAS, in furtherance of this authority CalRecycle is required to establish
procedures goveming the application, awarding, and management of the grants; and
WHEREAS, CalRecycle grant application procedures require among other things, an
, I applicant's goveming body to dedare by resoluuon certain authorizations related to the
i administration of CalRecycle grants.
NOW, THE1tEFORE,BE IT RESOLVED by the City Council of the City of Chula Vista
that it authorizes the submittal of application(s) to CalRecycle for all grants for which Chula
Vista is eligible; and
BE TT FURTHER RESOLVED by the City Council of the City of Chula Vista, that the
Public Works Director or his/her designee is hereby authorized and cmpowered to execute in the
name of the Ciry of Chula Vista all grant documenis, including but not limited to, applications,
agreements, amendments, and requests for payment, necessary to secure grant funds and
implement the approved grant project;and
BE 1T FURTHER RESOLVED by the City Council of the City of Chula Vista that these
authorizations are effective for five yeazs from the adoption ofthis resolution.

' � The following terms used in this Grant Ageement(Agreement)have the meanings given tn them below,
i unless the conte�ct cleazly indicates otherwise:
i • "CalRecycle"means the Department of Resources Recycling and Recovery.
• "Executive D'uector"means the Executive Director of CalRecycle or his or her desienee.
:� • "Grant Agreement" and "Agreement" means all documents comprising the agreement behveen
_I CalRecycle and the Grantee for this Grant.
• "Grant Manager"means CalRecycle staff person responsible for monitoring the grant.
� • "Grantee"means the recipient of funds pursuant to this Ageement.
• "Program" meaas the Local Govemment Vdaste Tire Amnesty Grant Program.
• "State"means the State of Califomia,inc(uding,but not limited to, CalRecycle and/or its
designated officer.
1. ACKNOWLEDGEMENTS The Grantee shall ac]<nowledge CalRecycle's support each time projecu funded, . �
in whole or in par[,by this Agreement are publicized in any medium, including,
but not limited to,news media,brochures,or other h�pes of promorional
materials. The aclaowledgement of CalRecyde's support must incorpora[e
CalRecycle logo. Initials or abbreviations for CalRecycle shall not be used. The
Grant Mana�er may approve deviation from the prescn�bed language on a case-
by-case basis where such deviation is consistent with CalRecycle's
� . Communication SVategy and Outreach Plan. If,'subsequen[to this A�eement
� CalRecycle adopts updated or new logos or language(language),the Grant
.i D4anager may require the Grantee to include this language in newly printed or
,� generated materials.
- 2. ADVERTISING/PUBLIC The Grantee shall submit copies of all draft public educarion or adc�ertising
i EDVCATION materials to the Grant Manager for review and ap�roval prior to the Grantee's
production of materials. Unless omission of the following copyright designation
is pre-approved in writing by the Grant Manager,all public education and
advertising materials shall state: "� {yeaz of creation} by the Califomia
Departrnent of Resources Recycling and Recovery(CalRecycte).All rights
reserved.This publicafion,or parrs thereof, may not be reproduced without
permission from CalRecycle." .
3. p�R oR wnieR Under the State laws,the Grantee shall not lie:
POLLUTION VIOLATION a. In violation of any order or resolutio�not subject to review promulgated by
the State Air Resources Board or an air pollution control districh
b. Subject to cease and desist order not subject to review issued pursuant to
Section 13301 of the Water Code for violation of�i•aste dischazge
requirements or dischazge prohibitions;or
c. Finally determined to be in violation of provisions of federal law relatine to
air or water pollution.
4. qr�eNOmeruT No amendment or variation of the terms of this Agreement shall be valid unless

any of the parties. This Agreement may be amended,modified or augmented by
mutual consent of the parties, subject to the requuements and restricfions of this
paragraph.
5. AMERICANS WITH The Grantee assures the State that it complies with the Americans with F� ,
DISABILITIES ACT Disabilities Act(ADA)of 1990,which prohibits discrimination on the basis of ,
i disability, as well as all applicable regulations and guidelines issued pursuant to
the ADA. (42 U.S.C. § 12101 et seq.)
, 6. ASSIGNMENT, a. This Agreement may not be assigned by the Grantee, eilLer in whole or in
successoRS nNO p�{,without CalRecycle's prior written consent.
ASSIGNS
b. 'I'he provisions of this Agreement shall be binding upon and inute to the
benefit of CalRecycle,the Grantee,and their respecuve successors and
assigns.
1 7. AUDIT(RECORDS The Grantee agrees that CalRecycle,the DepartmenY of Finance,the Bureau of
i qccess State Audits,or their designated representative(s) shall haee the right to review
' and to copy any records and supporting documentation pertaining to the
i performance of this Agreement. The Grantee agrees to maintain such records for
possible audit for a minimum of three(3)years after final payment date or grant
terrn end date,whichever is later,unless a longer period of records retention is
stipulated,or until completion of any action and resolution of all issues which
- may arise as a result of any litigation, dispute,or audit,whichever is later. The
Grantee agrees to allow the designated representative(s)access to such records
during normal business hours and to allow interviews of any employees who
might reasonably have information related to such records. Further,the Grantee
: agrees to include a similar right of the State to audit records and interview staff
i in any contract or subcontract related to performance of this Agreement.

� 8. AUTHORIZED The Grantee shall con[inuously maintain a representative vested with signature
� REPRESENTATIVE authority authorized to work with CalRecycle on all grant-related issues. The
� Grantee shall,at all times,keep the Grant Manager informed as to the iden6ty
and contact information of the authorized representative.
9. AVAILABILI'fY OF FUNDS CalRecycle's oblioations under this Agreement are contingent upon and subject
to the availability of funds appropriated for this grant.
1 O. BANKRUPTCY/ If the Grantee files for protection under Chapter 9 of the U.S.Bankruptcy Code
i DECLARATION OF or declares a fiscal emergency at any tune during the Grant Performance Period,

11. CHILD SUPPORT For aoy agreement in excess of$100,000,the Grantee acknowledges that:
! COMPLIANCE ACT a. The Grantee recognizes the importance of child and family support
obligations and shall fully comply with all applicable state and fedeial laws
relating to child and family support enforcement,including, but not limited
to, disclosure of informafion and compliance with earnings assignment
orders, as provided in Chapter 8 (commencing with Section 5200)of Part S
of Division 9 of the Family Code; and

b. The Grantee,to the best of its knowledge, is fully complying with the
earnings assignment orden of all employees,and is providing the names of
all new employees to the I�ew Hire Registty maintained by ihe California
Employment Development Department.
i � �� 12. COhiMUNICATIONS All commimications from the Graatee to CalRecycle shall be directed to the
� Grant Manager.All nodces, including reports and payment requests,requ'ued by
� this Agreement shall be given in writing by E-mail, letter, ar FAX to the Grant
� Manager as identified in E�ibit B—Procedures and Requirements. If an original
j document is required, prepaid mail or personal delivery to the Grant Manager is
i required following the E-mail or FAX.
� 13. C0�IPLIANCE The Grantee shall comply fully with al1 applicable federal, state; and local laws, .
Iordinances,regulaiions,and permits. The Grantee shall provide evidence,upon
request,that all local, state,and/or federal permits;licenses,registrafions, and
; approvals have been secured for the purposes for which grant funds aze to be
� expended.The Granfee shall maintain compliance with sucb requirements
tluoughout the grant period. The Grantee shall ensure that the requirements of
the Califomia Environmental Quality Act are met for aoy approvals or other
requirements necessary to carry out the terms of this Agreement. Any deviation
from the requirements of this section shall resuh in non-payment of graot funds.
With each Payment Reques[(CalRecycle 87),the Grantee's signature authority
shall submit an updated General Checklist of Permits,Licenses,and Filings
(CalRecycle 669), if applicable. T'he General of Permits, Licenses, and Filines
(CalRecycle 669)is available at: http:/hvww.calrecycle.ca.eov/Grants/Forms.
" 14. CONDRION After the Grant Agreement has been executed by both parties,the Grant will be
_, SUBSEQUENT subject to the following condition: The Grantee agrees not to file for protecfion
under Chapter 9 of the U.S Bankruptcy Code or to dedare a fiscal emergency
any time witbin the Graut Performance Period.
� 'I5. CONFLICT OF INTEREST The Grantee needs to be awaze of tl�e following provisions regarding current or
former state employees. If the Grantee has any questions on t6e status of any
! person rendering services or involved with this Agreement, CalRecycle must be
contacted immediately for clazification. .

� a. No officer or employee shall engage in any employment,activity,or
enterprise from which the officer or employee receives compensation or has
' a fmancial interest and a•hich is sponsored or funded by any state agency,
unless the employment,acdvity,or enterprise is required as a condi6on of
regular state employment.
b. No officer or employee shall conhact on lus or her own behalf as an
independent conhactor with any state agency to provide goods or services.
Former State Employees(PCC,¢10411):
a. For the two-yeaz period from the date he or she left state employment,no
former state officer or employee may enter into a contract in which he or she
�i engaged in any of the negoriations, vansac�ions,planning,arrangemenu or
� any part of the decision-making process relevant to the conh�act while
employed in any capacity by any state agency.
b. For the tweh�e-month period from the date he or she left siate emplo}�nent,
no foimer state officer or employee may enter into a coniract with any state
agency if he or she was employed by that state agency in a policy-maldng
posirion in the same general subject area as the proposed contract within the
- tweh�e month period prior to his or her leaving state service.

: 'I fi. CONTRACTORSI The Grantee will be entitled to make use of its own stafF and such contractors .
suecoNraacroRS and subcontractors as are mutually acceptable to the Grantee and CalRecycle.
Any change in contractors or subcontractors must be mutually acceptable to the
parties. Immediately upon temtination of any such confract or subcontract,the
Grantee shall notify the Grant Manager.
' Nothing contained in this Agreement or otherwise,shall create any contractual
' relation behveen CalRecycle and any contractors or subcontractors of Grantee,
, and no agreement with contractors or subcontractors shal]relieve the Grantee of
its responsibilities and obligations hereundec The Grantee agrees to be as fully
responsible to CalRecycle for the acts and omissions of its conhactors and
subcontractors and of persons either directly or indirectly employed by any of
� them as it is for the acts and omissions of persons directly employed by the
Grantee. The Grantee's obligation to pay its contractors and subcontractors is an
independent obligarion from CalRecycle's obligation to make payments to the
Grantee. As a result,CalRecycle shall have no obligafion to pay or to enforce
the payment of any mo�eys to any contractor or subcontractor.
97. COPYRIGHTS AND a. To the extent the Grantee shall have the lega]right to do so,Grantee shall -
TRADEMARKS assign to CalRecycle any and all righis,title, and interests to any �
copyrightable material or trademarkable material created or developed in
whole or in any part as a result of this Agreement,but which originated from
previously copyrighted or trademarked material. With respect to all other
copyrigk�table and trademazkable materials, CalRecycle shall retain any and
all rights,title and interests to any copyrightable material or trademarkable
, material created or developed in wbole or in any part as a result of this
i Agreement. These rights,both assigned and retained, shalI include the right
to register for copyright or trademark of such materials.Grantee shall require
i that its confractors and subcontractors agree ihat all such materials shall be
' [he property of CalRecycle. The Grantee is respoosible for obtaining auy
necessary licenses,permissions,releases or authoriutions to use text, images
j or other materials ow�ed,copyrighted or trademarked by third parties and for
assigning such licenses,pertnissions,releases,or anthorizations to
' CalRecycle pursuant to this section. Copies of any licenses,pernussions,
releases or authoriTations obtained pursuant for the use of teact,images or
other maferials owned,copyrighted or trademarked by third parties shall be
provided to the Grant Manager. Under unusual and very limited
cireumstances,where to do so would not conflict with the rights of
CalRecycle and would serve the public interest,upon written request by the
Grantee,CalRecycle may give, at the Executive Duector's sole discretion,

caused by an act of God, weather,accident,labor strike,fire, explosion,rio�war,

Agreement,the granting of such consent by CalRecycle in any instance shall not

i approved Budget prior to performing the changed work or incurring the

induding a proportionate shaze of any benefits to which the employee is

. 45. REAL AND PERSONAL a. All real and personal property,including equipment and supplies, acquired

required to execute all documents required to provide CalRecycle with a
security interest in any real or personal property, including equipment and
supplies,and it shall be a condition of receiving this grant that CalRecycle
shall be in fust prioriTy position with respect to the security interest on any �
such proper[y acquired with the grant funds, unless pre-approved in writing
by the Grant Manager that CalRecycle will accept a lower priority position
; with respect to the security interest on the property. Grantee shall inform anV
lender(s)from whom it is acquiring additional funding to complete the
properiy purchase of this grant condition.
' c. The Grantee may not transfer Title to any real or personal property,including
; equipment and supplies,acquired with grant funds to any other enfity without
; the express authorization of CalRecycle.
d. CalRecycle will not reimburse the Grantee for the acquisition of equipment
' that was previously purchased with CalRecycle grant funds,unless the
I acquisition of such equipment with grant funds is pre-approved in aTiting by
� the Grant Manager.In the event of a question concerning the eligibility of
equipment for grant funding,the burden will be on the Grantee to establisb
the pedigree of the equipment.
46. RECYCLED-CONTENT All documents submitted by the Grantee must be printed double-sided on
PAPER recyciedcontent paper containing one bundred percent(]00%)post-consumer
(PC)fiber. Specific pages containing full color photographs or other ink-
intensive graphics may be printed on photographic paper.
47. REDUCTION OF WASTE In tt�e performance of this Agreement, grantee shafl take all reasonable steps to
ensure that materials purchased or utilized in tt�e course of the project aze not
'I wasted. Steps should include,bul not be limited to: the use of used,reusable, or
i recyclable products; discretion in the atnount of materials used; altematives to ,
disposal of materials consumed;and the practice of other waste reduction
; measures where feasible and appropriate.
' 48. REDUCTION OF WASTE Unless otherwise provided for in this Agreement, in the perfortnance of this
� TIRES pgreement,for all purchases made with grant fuuds, including,but not lunited to -

equipment and rire-derived feedstock,the Grantee,shall purchase and/or process
only Califomia waste tires and California waste tire-derived producu. As a

performance of this Agreement to the Grant Manager.
49. REMEDIES Unless otherwise expressly provided herein,the rights and remedies hereunder .

Agreement, at law or in equity,and exercise of one right or remedy shall not be
deemed a waiver of any other right or remedy.
, 50. SEVERABILITY If any provisions of this Agreement are found to bc unlawfiil or unenforceable,
i such provisions will be voided and severed from this Agreement without
affecting any othcr provision of this Agreement. To the full e#ent,however,that
� the provisions of such applicable law may be waived,they aze hereby waived to
the end that this Agreement be deemed to be a valid and binding agreement

The Local Government Waste Tire Amnesty Grant Program(Program) is administered ihrough the Department

Before Work Begins
After the Agreement is signed by CalRecycle, the Grant Manager will provide the Grantee with a copy of the
: fully executed Agreement and the Notice to Proceed. While receipt of the Notice to Proceed allows the Grantee
to begin work on the project,be awaze of the following requirements:
a) Reliable Contractor Declazafion(CalRecycle 168) If a contractor or subcontractor wi]I be utilized in the
implementation of t6e gant, prior to commencement of work by the Granlee's contractor,the
Grant Manager must receive a declaration signed under penalty of perjury by the Grantee's

Waste 8 Used Tire Hauler and End Use and Disposai Facilities
CalRecycle has specific reqviremenCS for the tracking of used and waste tires remediated with grant funds. In
order to be reimbursed for the costs of tire remediauon, Grantees and their contractors must use a waste/used
tire hauler that is registered with CalRecycle, unless it is eaempt pursuant to Public Resowces Code section
42954. Furthetmore,the tires must be transported to a facility that is.permitted,excluded,exempted or
othenvise authorized by CalRecycle,by statute, or by regulation,to accept waste and used tires,or to a facility
' that lawfully accepts waste and used Ures for reuse or disposal.
� Grant Term, Grent Performance Period, and Report Preparation Period
� • Grant Term:The Grant Term encompasses the entire life of the�ant from the date on the Notice to
� Proceed to September 3Q 2015. which is the date the Final Report and Finai Payment Request aze due to
CalRecycle. The Grant Term is divided into rivo sections—the Grant Performance Period and the Report
` Preparation Period.
• Grant Performcmce Period: Begins wiih the date on the Notice to Proceed and ends June 30,2015. All
work,with ihe exception of personnel time spent to prepaze the Final Report and Final Payment Request,
must be completed by June 30,2015.
• Report Prepmation Period.• The period between July 1, 2015,and September 30,2015. Personnel costs
incurred to prepare the Final Reporf and Final Payment Request are the only costs eligible for
reimbursement during the Report Preparation Period.
Publicity and Advertising
The cost to advertise amnesty events is allowed under the grant. My publicity or advertising for amnesry
events must cleazly state that the amnesty provided by the event is limited to 9 tires, or 20 w;th the appropriaze
,I HTitten authorization from the LEA. Each advertisement shall include:
� • Statement that tires aze accepteA at no chazge;
• Nhether tires on rims are accepted,

It is no longer necessary to have each advertisement pre-approved by the Grant Manager. However, Grantee
shall maintain a copy of each advedisement in the grant file and submit a copy of each advertisement paid for
with gant funds with the Final Payment Request. Upon review,if the advertisements do not include all of the
, above,the Payment Request may be reduced or rejected.
Amnesty evcnts allow individuals to take waste tires to a convenient location for proper management up to
' rivice per month per location(maYimum of 40 tires.per person per month per location). An amnesty event can
i be held 'ui a local parking lot or can consist of a coupon program that allows individuals to take waste tires to a
I transfer station or landfill on specified days.
' Amnesty Day Evcnts are intended to be date-specific events for the public and aze not intended for the disposal
of waste tires from waste tire generating businesses or waste tire haulers [PRC §42954(7)].Waste[ires from
vehicles used for business operarions(such as tires from a iractor used on a farm)are•eligible for collection at
amnesty events.
{ Waste Tire Hauling Limits
The Grautee must comply with the hauling and manifest requirements set forth in Title 14, Califomia Code of
Regutations,sections 18461(b)(2) and(3). For purposes of amnesty events,these regulations provide that:
• The Grantee may accept up to 9 waste tires at amnesty events from individuals who are not registered
waste tire haulers.
• The Grantee may accept 10-20 waste tires if the individual has a waiver from the Local Enforcemeot
Agency(LEA).
o If the individual does not have a waiver from the LEA to haul more than 9 tires,the Grantee may
accept the tires,but must report this informafion on the Unregistered Hauler& Comprehensive Trip
Log Substitution Form(CalRecycle 204)and submit the form to CatRecycle within 30 days of
acceptance of the tires.
o If the Grantee accepts more than 20 waste tires from individuals who are not registered waste tire
` `:� haulers,the Grantee must report this information on the Unregistered Hauler&Comprehensive
� � Trip Log Substitution Form (CalRecycle 204)and submit the form to CalRecycle within 30 days of
acceptance of the tires.
In addition, Senate Bi11230(Cogdill, Chapter 41, Statutes of 2009)sets forth the following additional
requirements:
= • Any person transporting waste or used tires that were illegally dumped onto their property to an amnesty
event, or to a]ocation that meets t6e conditions specified in PRC § 42951(b),must have written
authorization from the LEA. The LEA autborization must include speci5c information,as specified by
the LEA, dates and documentation that a police report has been filed for the illegally dumped tires. The
LEA is responsible for providing a copy of any written authorizations to CalRecycle within 30 days of
issuance.
Eligible Costs
, Eligible costs include expenses directly related to the approved project and all expenditures must be inc]uded in
the approved Budget. Eligible costs include,but are not limited to:
• The cost of loading tires into transporting vehicles at the waste tire amnesty events;
• The cost of Vansporting waste tires by a waste tire hauler,registered or exempted by CalRecycle,to a
permitted,excluded or exempted waste tire storage facility,or other solid waste facility;
• The cost of transporting waste tires for a specific end-use to a CalRecycle approved end-use facility.
Waste tires must be transported by a CalRecycle approved waste rire hauler to a CalRecycle approved
end-use facility;
• The cost of disposing of waste tires at a permitted,excluded or exempted waste tire storage facility or
disposal site;

• Any salaries and benefits for personnel who are dfrectl}•involved in the administration of amnesty events,
; including the preparation of payment requests and the final repod,organi7ation and supervision,not to
exceed fifteen percent of the total amount of the approved Budeet;
' • Any salaries and benefits for personnel directly involved at the amnest}�events; including setting up the
site,directing traffic, logging enVies and handling tires; and
• 'Ihe costs associated with the crearion o£educational materials and advertisements in support of the
amnestq events,including supplies and personnel time,not to exceed ten percent of the approved Budget.
Ineligible Costs
� Ineligble costs include,but aze not limited to:
' • Costs incurred prior to the date on the A'orice to Proceed letter,or after June 30,2015 (with the exception
i of costs incutred between July 1,2015, and September 30,201 S,to prepare t6e Final Payment Request
j and Final Report);
� • Personnel time for the preparation of a Waste Tire Amnesty Grant AppGcation;
• Any costs thai are not consistent with,docal, state, and federal laws, guidelines and regulations;
• Personnel costs incurred while an employee assigned to the�ant project is not working on the grant(e.g.,
use of accrued time such as sick leave,vacation,etc.)
• Costs currently covered by,or incurred under, another CalRecycle-fimded loan,gant, grant cycle or
contract;
• . Overhead(costs for accounting/budgeUfinance staff;rentaUlease of space,utilities,copying,and office
supplies,etc.);
• Cosu for obtaining uecessary permits and licenses;
• Fines or penalties due to violation of federal, staYe or locat law;,ordinances or regulations;
- • Personnel travel or per diem costs,unless approved in writing by the Gran[Manager prior to the costs
being incurred;
• Cameras,cell phones, electronic personal data devices,pagers and other similar electronic devices;
- • Costs connected with contractor daims against the Grantee; ;:"•
• Overtime costs(except for local government staffing during specially scheduled evening or weekend l�^
i events that are pre-approved in writing by the Grant Manager wheu law or labor conhacu requue
� overtime compensation);
• Costs of collecting waste tires from waste tire generating businesses and/or waste tire haulers;
- • Costs of collecting waste tires from businesses that are responsible for contracting with registered waste
tire haulers for the removal of their waste t'ves.If it is determined that the Grantee has used grant funds
for ihis purpose, costs incurred a•ill be deemed ineligible and disbursed grant funds associated with these
wsLs must be returned to CalRecycle, and
• My costs that are unrelated to the giant project or unreasonable as determined by ihe Crrant�/Ianager.
Budget Changes
Changes to the approved Budget are aliowed when the change will not material]y alter the scope of the project
or include ineligible cosu.When the Budget cLange involves expendihses that total ten percent or less of the
total approved Budget,prior Graut Manager appro��al is not needed. However a revised Budget must be
� submitted to the Grant Manager as soon as possible or the Gran[ee�vill be unable to enter a payment request
' transaction in GMSWeb. Grantee will be responsble for any unilateral changes to the Budget that results in
ineligible expenditures._Contact the Grent Manager for assistance.
:� Budget change requests that involve more than ten percent of the total grant must be pre-approved in wtiting by
! the Grant b4anager prior to the ezpenditures being incurred.The request must include a proposed revised
� budget.

A Progress Report is required with each payment request. The Progress Report must be completed on the
Payment Request Checldist/Progress Report Form (CalRecycle 753).

i Approval of the Final Report by the Grant Manager is mandatory in order for the Grantee to receive final
i payment of the grant award,which includes release of the ten percent(10%)withhold. This repoR is a work
� product and as such is a condition of the Agreement. The Final Report must include a summary of the entire
� grant project, which states the gant objecrives,the number of tires that have been removed with grant funds,the
, success of the grant program in reducing the number of illegally disposed waste tires and how these objecrives
were accomplished. The Final Report must be prepared using the Final Payment Request ChecklisdFinal
� Report Porm(CalRecycle 754).
j The Final Report and Finat Payment Request must be uploadcd to GMSWeb by September 30,2015 and

� Records and Audit Requirements
i This grant is subject to a desk or field audit. For more infotmation,see the"Audit/Records Access"provision

If an audit reveals that Ca]Recycle funds are not being expended, or have not been expended in accordance
with this Agreement, in addition to any other rights of CalRecycle,the Grantee may be required to forfeit the
unexpended portion of the funds,and/or repay CalRecycle for any improperly expended monies. Additionally,
future grant awazds to the Grantee may be jeopardized.

THE �T�'ASTE A4A\'AGEMENT FUI�TD
WHEREAS; Public Resources Code sections 40000et seq. authorize the Department of
Resources Recycline and Recovery (CalRecycle) to administer various erant proerams in
furtherance of the state of Califomia's efforts to reduce, recycle, and reuse solid waste eenerated
in the State thereby preserving landfill capacih and protecting public heaith and safet�� and the
environment; and
WHEREAS; in furtherance of this authority CalRecycle is required to establish
procedures goveming the application; awardine, and manaeement of the grants; and
�VHEREAS; CalRecycle arant application procedures require; amon� other things; an
applicant's governina body to declaze by resolution certain authorizations related to the
administration of CalRecvcle grants; and
, 16'HEREAS, the City received a gant award from CalRecycle of�28,826 from the Local
Govemment Waste Tire Amnesn� Grant Program for fiscal yeaz 20li-14; and
�\'IIEREAS, the Cih� ��ill use these funds to collect and properly recycle/dispose of���aste
tires from individuals (not businesses).
NOW. THEREFORE. BE IT RESOLVED bv the Ciri� Council of the Ciri of Chula
Vista, that it accepts the gant a«�azd in the amount of 528,826 from CalRecycle and appropriates
that amount to the Personnel ($9;280), Supplies and Semices (�19.�46) budget of the Waste
Manaeement Fund.
