RECITALS A. Project Site �VHEREAS; the subject matter of this Ordinance is the Zoning Map established by Chapter 19.18.O10 of the Chu1a Vista Municipal Code; and the area of the Zoning Map to be used as the project area is identified in Exhibit "A" (Project); attached hereto; and B. Project; Discretionary .4pproval WHEREAS; the Project Site, ���hich is the subject matter of this Resolution; and is depicied in Exhibit "A," attached hereto and incorporated herein by this reference, consists of t�vo (Z) parcels located on Alvarado Street (AP\s �68-�11-]8 and 19); and WHEREAS, the proposed rezone of the t���o residentially zoned parcels to UG1 �till mal:e them consistent «�ith the UC-1 zone already e�istin�on the contiguous pazcels; and �'�'HEREAS; the De��elopment Ser��ices Director recorrimends approval of an amendment to the adopted zonine map established bv Section 19.18.010 of ihe Chula Vista �viunicipal Code in order to rezone the Project Site from R-3 to UC-]; and �\%HEREAS: the Plannine Commission, by Resolution PCZ-12-03; recommends that the City Council amend the Zonin� Map established by CVMC Section 19.1 S.O10; to rezone tN�o (2) parcels located on Alvarado Street from an existing \•lulti-Family Residential Zone (R-3) to a 1�4ixed-Use Zone (UC-1); and C. Compliance ��ith the Califomia Environmental QuaLty Act (CEQA) �VHEREAS, The De��elopment Sen�ices Director has completed Secondar�- Study (IS-12- 002), in order to determine project consistenc}• N�iih the lirban Corz Specific Ptan E1R (PEIR-06- O]). Based on the em�ironmental analysis contained ��ithin this Secondar}' Study, the proposed action �3'ill not have any sienificant effect on the environment other than as identified in the PEIR. In addition, the rezoninc of the parcels to an Urban Core density of up to CO dulacre ���as anal}zed in the 200� General Plan lipdate EIR (EIR-0�-01) as part of the 200� General Plan Update. CERTIFlCATION OF COD�IPLIA\�CE 4111TH CEQA That a Secondan� Study (IS-12-002) has been completed in order to determine project consistencv ���ith the Urban Core Specific Plan EIR (PEIR-06-01) and based on the em�ironmental analpsis contained �;�ithin this Secondan� Smdy, the proposed action will not ha��e an�� si�ificant effect on the em�ironment other than as identified in the PEIR. In addition. the rezoning of the parcels to an Urban Core density of up to 60 du/acre ���as anal�•zed in the 200� General Plan Update EIR (EIR-0�-01) as part of the 200� Genera] Plan Update. The proposal is consistent �ti�ith the anal��sis and conclusions of EIR-O�-OI. No additional impacts or mitieation measures be�rond those identified in EIR-0�-01 �+�ill result from this rezone request.� The proposed rezone is, therefore,- also co��ered under EIR-0�-01. The subject properties are currently zoned R-3. Pursuant to the General Plan desisnation; a high density R-3 zoning has a densit}� range of 18 to 27 d�velling units per acre. 2. The General Plan Update (GPU) designates the H Street Office Focus Area as a Transit Focus Area (TFA) ���ithin the Urban Core, ���ith transit-focused mixed uses on the east and ���est sides of Third .Avenue. Mi�ed-use development is encouraged within ii�alkine distance of a planned future transit station near Third Avenue and H Street. According to GPU policy for the H Street Office Focus .4rea, residential densities �vithin the Mised Use Transit Focus .4rea desienation are intended to have a Focus Area wide gross density of 60 dwelling units per acre (LliT 53.2). This density is consistent �vith adjacent properties that ha��e alread�� been rezoned. 3. 7�he General Plan Density for Urban Core Residential is 28-60 units per acre. The proposed change in zoning from R3 to UC1 is consistent ���ith the above pro��ision ofthe Cummings ]nitiati<<e; since the chan�e ���ould be to the nest highest residential densin� cateeoq� as identified in General Plan Land Use Designation and Zonin� Table �-4. 4. Hieh densit;� multi-familv residential already exists «�ichin the Urban Core: (1) Con�regational To���ers (an affordable senior facilih�); located at 288 F Street, is zoned ELiH and has a density of 248 units per acre; and (2) Park�voods (markzt-rate condominiums), ]ocated at 376 Center Street is zor,zd R3HP and has a density of 31 units per acre. APPRO�'AL OF .�4E\'D?�4ENT TO ZO\'R�'G ARAP That the Ciq� Council does hereby approve the amendment to the Chula Vista Zoning ?�4ap, established by Section 19.18A10 of the CVMC. The rezone is depicted in Exhibit ��B. ' III. SEVERABILITY If any portion of this Ordinance, or its application to any person or circumstance; is for am� reason held to be im�alid, unenforceable or unconstitutional, b�� a coun of competent jurisdiction; that ponion shall be deemed se��erable; and such in��aliditv. unenforceabilit�� or unconstitutionalit�� shall not affect the validirv or enforceabilit}� of the remainins portions of the Ordinance, or its application to anv other person or circumstance. The Citv Counci] of the Ci�� of Chula \'ista hereby declares that it would have adopted each section: sentence, dause or phrase of this Ordinance, irzespec[i��e of the fact that ane one or more other �ections, sentences; clauses or phrases of the Ordinance be declared im�alid, unenforceable or unconstitutional. N. CONSTRUCTIO\i The City Council of the City of Chula Vista intends this Qrdinance to supplement, not to duplicate or contradict, applicable state and federa] law and this Ordinance shall be construed in lieht of that intent. V. EFFECTIVE DATE This ordinance shall take effect and be in full force on the chinieth da�� from and afier its adoption. VI.
