As part of the overall chanee to the City of Chula Vista's Security Alarm program, the
security alarm permit fees and fines are being updated.

This proposed activity has been reviewed for compliance �vith the Califomia
Em-ironmental Quality Act (CEQA). Staff has determined that the activity is not a
"Project" as defined under Section 1�378 of the State CEQA Guidelines because it will
not result in a physical chanee in the environment. Therefore; pursuant to Section
1�060(c)(3) oFthe State CEQA Guidelines; the activity is not subject to the CEQA, and
no environmental revie�v is necessary.

DISCUSSION
On May 28`h, 2013, the Police Department brought forward a change to the City's
Municipal Code in order to update and modernize the City's Security Alarm Ordinance.
This update was driven by the Departmenf s need to recapture lost productivity by
officers responding to false alarms. In the past three fiscal years (7/1/09-6/30/12,) 99J%
of all residential alarms were false, and 98.6% of commercial alarms were false. Each
year the Department loses the equivalent of more than two Peace Officers' worth of time
responding to false security alann activations. False alarm responses were partially
responsible for the Department's extremely low ratio ofproactive time availability (22%
of the 40% goal) as determined by the Matrix Consulting Group's study published in
May of 2012.
Since that time, the Department has been taking various steps to increase the amount of
proactive patrol tune. Besides revising the Security Alarm ordinance, the Department has
also reassigned a lieutenant to Patrol Operations, implemented a hybrid 3/12.5 staffing
plan, hired Coirununity Service Officers, created a subject matter expert group to address
report writing issues, and reprioritized some types of calls-for-service. These changes are
all efforts at increasing the amount of tune patrol officers have available to attend to
quality of life issues, to do problem-solving and to decrease response times.
The City Council approved the first reading of the new Security Alarm Ordinance on
May 28`h, 2013. The City Council then approved a contract for service to the PMAM
Corporation to administer the security alarm program on October 15, 2013. The final
components are to set the permit fees and penalty amounts and to approve the second
reading of the Security Alann Ordinance (separate item).

The following table details the proposed changes to the pennit fees for security alarms:

Police Department examined fees as part of a City-wide effort led by the Finance
Department to ensure that the City recovers the estimated reasonable cost of providing
security alarm permitting and administration services. In reviewing the permitting fees
for both residential and commercial users, the Department determined that it would be
more efficient to change the permitting tune period (renewal) from once every two-}�ears
to once every year. This will make tracking and administration ofthe permits much
easier. Also; as part ofthe analysis ofthe permit fees, the Department determined that the
stafftime required to process commercial permits was equivalent to residential permits,
therefore the Department is recommending reducing the commercial permit fee to equal
that of residential permits. Therefore the Department recommends that alarm permits for
residential users be increased to �28.75 per 12-month period for an operating permit (a

15%or �3.7� per year increase). The permit fees for commercial permits shouid be
decreased to S28.7� per 12-month period for an operatine permit (a decrease of SZ 1.25
per year or a -42.�% reduction).
False Securitv Alarm Penalties
Meaningful and escalating penalties are considered a best practice to deter false alarms
according to the Security Industry Alarm Coalition (SIAC) and the Department of
Justice's Community Oriented Policing Ser��ices. In order to encourase compliance �vith
the revised security alarm ordinance, the penalties need to be able to affect user behavior
by being a si�nificant enoueh deterrent that securirv alarm users take proactive measures
to ensure that false alazms don't occur; as well as take corrective action when a false
alarm does occur. Hieher false alann penalties were recommended by alarm users �vho
attended an Aueust 201 Z Public Safety Subcommittee meetine to increase the
accountabilitv of alann users ��°ho incw false alazms and to deter faise alarms. This
recommendation from the users who attended the meeting was in response to the Police
Department's proposal to adopt a strict "��erified response' proeram.

Per the updated security alarm ordinance, those users who experience their very first false
security alarm���ill be eligible to have the S 100 penalty waived upon successful
completion of a false security alarm class ���hich will be available on the alazm vendors
website. Should the user receive another false alarm outside ofthe first 12-month period,
they�vould then need to remit the penalty amount of S 100. Those alarm users �vho have a
fourth alarm in a 12-month period also ���ould be subject to `��erified response" until they
can demonstrate compliance with the securitv alarm ordinance.
The proposed higher fines are consistent �vith the City Council's actions in 2012 and
2013 to increase fines for violations of the Municipal Code, Title 6; Animals, and Title 9;
Truancy. Those fines aze �100 for a first violation, �Z00 for a second violation in one
vear; and �500 for a third violation in one year (Chula Vista Municipal Code section
6.24.180 and 9.09.060). Further, the proposed false alarm fines are identical to California
Government Code section 36900(b); �ahich provide that the fine for an infraction
violation shall be no more than S 100 for a fvst violation, no more than �200 for a second
violation of the same ordinance ���ithin one year, and no more than 5�00 for each

additional violation ofthe same ordinance within one year. This provides a consistent
fine platform throughout our Municipal Code.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is
not site specific and consequently, the 500-foot rule found in California Code of
Regulations section 19704.2(a)(1) is not applicable to this decision. Staff is not
independently aware, nor has staff been informed by any City Councilmember, of any
fact that may constitute a basis for a decision maker conflict of interest in this matter.
LINK TO STRATEGIC GOALS
The City's Strategic Plan has five major goals: Operational Excellence, Economic
Vitality, Healthy Coirununity, Strong and SecureNeighborhoods and a Connected
Community. The Security Alarm Ordinance will support the Strong and Secure
Neighborhoods goal of providing additional proactive patrol time to Peace Officers.
CURRENT YEAR FISCAL IMPACT
The Department does not expect any negative impacts to the General Fund as a result of
implementing the new ordinance for fiscal year 2013. Because of the uncertainty of the
number of actual residents and businesses with security alarm systems, and the overall
net effect of the new Security Alarm Ordinance on the number of false security alarms,
staff is unable to mal:e a reasonable estimate on the amount of revenue which would be
generated from permit fees and penalties.
ONGOING FISCAL IMPACT
It is difficult to project what the final fiscal impact of implementing this ordinance will be
with any certainty. The Department expects that with the cooperation of the Alarm
Industry, we���ill be able to increase the number of permits issued annually, as industry
experts believe cunently only about half the alann systems in the City are permitted. lt is
unknown how many more permits will be requested at this time. Additionally, although
there will be an increase in our alarm penalty amounts, the goal of this ordinance is to
significantly reduce the number of false alann activations, so there is a potential that the
amount ofalarm fines collected in the future will actually go down.

WHEREAS, the proposed fees do not exceed the estimated reasonable cost of providine
the associated sen�ices: and
�b%HEREAS, Article XIII C of the Califomia Constitution requires a vote of the electorate
to increase any levy, char�e; or eaaction imposed by a local government, unless specificall}�

WHEREAS, pursuant to the provisions of Article XTII C, the proposed fees aze exempt

\i0���. THEREFORE. BE IT RESOLVED bv the Cit�� Couricil of the Citv of Chula
Vista, that it hereb� amends Chapter VI, Police Fees, Alarms, of the Cit}� of Chula Vista Master
Fee Schedule.
BE IT FURTHER RESOLVED; that the residential alann permit fee be chanaed from
$�0.00 per 24-month permit to 525.7� per 12-month permit; and
BE IT FURTHER RESOLVED, that the commercial alarm permit fee be chaneed from
S]00.00 per 24-month permit to 528.7> per 12-month permit; and
BE IT FliTHER RESOLVED. that the fine for a first false alarm be increased from S0.00
to S 100.00, �rhich mav be �vaived once if the alarm permit holder successfull�� completes a false-
alarm a«�azeness class: and
BE IT FliRTHER RESOLVED. that ttie fine fo; a second false alarni ���ithin a ]2-month
period be increased from 50.00 to S200.00; and
BE IT FURTHER RESOLVED; that the penalty fine for a third false alarm within a 12-
month period be increased from S�0.00 to ��00.00; and
BE IT FURTHER RESOLVED; that the penalty fine for a founh and subsequent false
alarm in a 12-month period be increased from 5100.00 per occurrence to ��00.00.
