The adoption of California building codes is a routine action undertaken by the Ciry in response to State adopted building codes. This action allo�vs the City to incorporate appropriate local amendments into the enforcement program. ENVIRONMENTAL REVIEW The Director of Development Services has revie��ed the proposed activity for compliance with the Califomia Environmenta] Quality Act (CEQA) and has determined that the activity falls �vithin the Class 8 Categorical Exemption pursuant to Califomia Code of Regulations Title 14; Chapter 3, Article 19 (the "State CEQA Guidelines") section 15308 and therefore is exempt from environmental review; and not��ithstanding the Class 8 Categorical Exemption, the Director of Development Services has further determined that there is also no possibility that the activity may have a significant effect on the environment; therefore, pursuant to section 15061(b)(3) of the State CEQA Guidelines the activity is eaempt from the provisions of CEQA. Thus; no em�ironmental revie��� is required. RECOMMENDATION That the City Council place the ordinances of the various 2013 Editions of the Califomia building codes on first reading. BOARDS/COD'IMISSION RECOMMENDATION The Boazd of Appeals and Advisors at their Monday, October 21, 2013 meeting unanimously recommended adoption of the various 2013 Editions of the California building codes. DISCUSSION As mandated by the California Building Standards Commission (CBSC), jurisdictions �vithin the State shall begin enforcin� the 2013 Editions of the Califomia building codes on January 1, 2014. E��ery three yeazs, the State adopts and amends the newest model codes published by the vazious independent code-developing bodies. New State building codes take effect one-hundred and eighty (180) days afrer they are published to allow local jurisdictions time to adopt local amendments to the State building codes before they take effect. Local amendments cannot be less restrictive than the State building codes and must be based on findings that the amendments 13-2 Item No.: �3 �4eeting Date: 11/19/2013 Page 3 of 6 aze necessary because of local climatic; geoloeical or topographical conditions. Local amendments are not effecti��e until the amendments have been filed «�ith the CBSC. The majorin� of the proposed local amendments currenth� exist in our Municipal Code; as amendments to the current buildins codes adopted b}� the Cin� and aze being proposed for re- adoption as the Ciri� adopts the 2013 codes. The 20li Califomia codes aze updated editions to tbe current codes that aze enforced locallv and throuehout the state and therefore it should not be difficult for staff and the industry to incorporate into their current practices. The follo«�ng aze brief discussions on the various ordinances adoptine the 2013 buildine codes: Proposed Ordinance "A" —Administrati�e Provisions for the Technical Codes This ordinance proposes minor cleanup amendments to A4unicipal Code Chapter 1�.06; Admuustrative Pro��isions for the Technical Codes. removine a reference to a section that was repealed in 2010 �r•hen the current building codes ���ere adopted and replacine it nith the correct reference. In addition; currently small detached patio covers that are located at least six feet from anti� buildine or structure on the same propem� are exempt from a buildine permit. The ordinance proposes deleting the condition of six foot separation from buildines or structures so that small detached patio covers that aze less than sis feet from the main buildine can be exempt from a building permit; and adding a condition for two or more patio co��ers to be at least six feet apart from each other to be considered separate patio covers to qualify for the exemption. Proposed Ordinance "B" —20li Califomia Buildine Code The proposed ordinance adopts the 2013 Califomia Building Code and proposes the re-adoption of existine local amendments to the current Building Code adopted by the City. Pr000sed Ordinance "C' — 2013 California Residential Code The proposed ordinance adopts the 2013 Califomia Residential Code. Staff is not proposine any local amendments to the code. � Pronosed Ordinance "D" — 20li California Referenced Standazds Code The proposed ordinance adopts the 20li Califomia Referenced Standards Code. Staff is not proposing any locai amendments to the code. Proposed Ordinance "E" — 2013 California Green Buildine Standards Code Staff is proposine the adoption of the 20li Califomia Green Building Standards Code (2013 CGBSC) and readopt only one of the current local amendments. �'��hen the City adopted the cunent code back in 2010, the code applied only to new buildines and the Citti� amended the code to espand the scope to include additions and alterations to existina buildings. The 2013 CGBSC addresses additions and alterations to esistine buildines, and therefore, there is no need to cam� for�i=ard the amendments that aze related to additions and alterations. In addition and pursuant to SB 407 (2009), effecti��e Januar}� 1; 2014; before the City can sien-off on a buildin2 permit for an alteration or impro��ement to residential and non-residential real propert�� that �;�as built and a��ailable for use on or before Januar�� 1; 1994, plumbinQ fixtures not meetine certain ��ater consemation standards must be replaced b}� the property o��mer ���ith ���ater-conserving fixtures. 13-3 Item No.• �3 Meeting Date: 11/19/2013 Page 4 of 6 Furthermore, the City recently amended the current code by adopting mandatory cool roof regulations. Pursuant to California law, local amendments expire when current codes are no longer in effect. In order to readopt the mandatory cool roof regulations, the local adoption process must meet the requirements and follow the process established by Section 10-106 of the CA Code of Regulations, Title 24, Part 1; Locally Adopted Energy Standards (Section 10-106). Even though staff is not proposing amending the Califomia Energy Code to require cool roofs, it is the California Energy Commission's (CEC) opinion that because cool roofing is one of the options available to builders under the performance method of compliance with the Energy Code and it pla}�s a role in the energy efficiency of buildings, the City's continued mandating of cool roofs will need to go through the process outlined in Section 10-106. The process is similar to the process the City had to follo«���hen it adopted increased energy efficiency standazds. It invoh�es a cost-effectiveness analysis, a City Council determination that the proposed requirements aze cost-effective, and submittal of the proposed requirements to the CEC after the ordinance's first reading by City Council. Per Section 10-106; before local energ}� efficiency standazds can take effect, the CEC must mal:e the finding "that the standards will require buildings to be desiened to consume no more enere}�than permitted by Part 6 [Califomia Energy Code]." The application to the CEC must include 1) the proposed ordinance (after a public hearing and first reading), 2) a study/analysis showing ho��� the City determined energy savings, 3) a statement that the standazds will require buildings to be designed to consume no more energy than permitted by the California Energy Code, and 4) the basis of the City's determination that the standards aze cost effective. The CEC revie�v can take up to three months. Staff and SDG&E initiated discussions with an energy consultant to start the process of developing a cost-effectiveness analysis that is required for proposing local cool roof standards and/or increased ener�y efficiency standards (above 2013 Energy Code) and were informed that the sofrti�are required to perform the analysis just recently become available and is going through the CEC certification process. The consultant stated that the industry still needs to evaluate and become familiar H�ith the soft���are and the new energy code before they can perform the required analysis. It will be several months before such an analysis can be made available. Staff will continue to follow up N�ith the consultant on the required study and wil] bring fornazd recommendations to Council based on the results of the stud}�. Pr000sed Ordinance "F"—2013 Califomia Mechanical Code The proposed ordinance adopts the 2013 California Mechanical Code. Staff is not proposing any local amendments to the code. Proqosed Ordinance "G"—2013 California Electrical Code The proposed ordinance adopts the 2013 California Electrical Code and proposes the re-adoption of existing local amendments to the current Electrical Code adopted by the City. Proposed Ordinance "H"—20li Califomia Ener�v Code The proposed ordinance adopts the 2013 California Energy Code. Current locally adopted increased energy efficiency standards will eapue when the current energy code espires on January 1, 2014 and similaz to locally adopted cool roof standards, in order to readopt increased energy efficiency standards, the local adoption process must meet the requirements and follow the process established by Section ]0-]06 of the CA Code of Regulations, Title 24, Part 1; 13-4 Item No.: 13 D4eering Date: 11/19/2013 Page 5 of 6 Locall� Adopted Ener�� Standazds (Section ]0-106). Based on a CEC presentation on the new code, the 20li Energ} Code is about 2�% above the current base code for single famil��. 14% for multi-famil} and 30% for non-residential. Pronosed Ordinance "I" —20li Califomia Plumbine Code The proposed ordinance adopts the 2013 Califomia Plumbing Code and proposes the re-adoption of existine local amendments to the current Plumbing Code adopted b}� the Cit�•. Proposed Ordinance "J"—2013 Califomia Fire Code The proposed ordinance adopts the 2013 California Fire Code and proposes the re-adoption of etistine local amendments to the current Fire Code adopted by the Ciri-. Previous California State Fire A4arshal Photovoltaic Guidelines have been repealed from the Ordinance, as the requuements are no"� set forth in the 2013 basic code lanauaee. Additionally, t���o ne��� amendments ha��e been set forth therein. The first ne�v amendment requires electronic maps be pro�ided to the Fire Deparunent as part of the pemut process. This provision will create a si�nificant leeel of efficacy for the Department`s mapping and buildine pre-plannin� proeram; «hereas. the electronic maps ���ill become the foundation for the response maps used b}� the Department. The second ne��� amendment memorializes the minimum meter size for National Fire Protection Association 13-D fire spriril:ler svstems�nsuring that ���ater volume is adequate to support the life safet�� s��stem. DECISION A'IAKER CONFLICT Staff has determined that the recommendations requiring Council action aze not site specific and consequentlti� the �00 foot rule found in Califomia Code of Resulations Section 1870�.2(a)(1) is not applicable to this decision. CtiRRENT 1'EAR FISCAL IAIPACT There are no increases in fees proposed in this adoption. The cost of new code bools and related training is included in the current ��eaz's budget. Building permit fees ma}� need to be adjusted to reco�er the cost of an}� additional staff time associated ���th plan re��ie�v and inspection. As used herein, the term "electric fence" includes all fences which in any way use electrical energy as an additional deterrent or have wires charged with electricity which are not covered with adequate insulation to protect persons and animals coming in contact therewith. B.I��o electric fence may be constructed; maintained or operafed within the City. 15.24.060 Phase arrangement—Amended. Section 4083(E) of the California Electrical Code is hereby ainended to read: Phase Arrangement. The phase arrangement on three-phase buses shall be A, B, C from front to back, top to bottom, or left to right, as viewed from the front of the switchboard or panelboazd. The C phase shall be that phase having the higher voltage ground on three- phase, four-wire delta-connected systems. Other busbaz arrangements may be permitted for additions to existing installations and shall be mazked. 15.24.065 Photovoltaic Pre-wiring Requirements. All new residential units shall include electrical conduit specifically designed to allow the later installation of a photovoltaic (PV) system which utilizes solaz energy as a means to provide electricity. No building pemut shall be issued unless the requirements of this section and the Chula Vista Photovoltaic Pre-Wiring Installation Requirements are incorporated into the approved building plans. The provisio�s of tt�is chapter can be modified or waived when it can be satisfactorily demonstrated to the building official that the requirements of this section aze impractical due to shading, 6uilding orientation, construction constraints or coufiguration of the parcel. SECTION II FINDINGS AND DECLARATION The City Council of the Ciry of Chula Vista specifically and expressly finds and declazes that each of the aznendments noted above to the 2013 Edition of the California Elech�ical Code is necessary due to local climatic, geological and topographical conditions. These impacts could limit imported ��ater availability, lead to tugher demand for local water sources and increase utility costs. "F've Service Fearures" is a general term inclusive of all other terms such as driveway, fire lane, public street,private street pazkin�lot, ]ane and access roadway. This Section 1�.36.01� amends Section 202 of the Fire Code Portion of the Califomia Building Standazds Code only by adding those definitions specifically identified in herein. No other changes to Section 202 of the Fire Code Portion of the Califomia Building Standards Code are contemplated or intended, and the balance of the definitions therein shall remain unchanged and continue in full force and effect. 15.36.020 Violation penalties. Chapter I Scope and Administration - Subsection 109.4 Violation penalties of the Fire Code portion of the California Buildin2 Standazds Code is hereby revised-to read as follo��s: Subsection ]09.4 Violation penalties. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the fire code official, or of a permit or certificate used under provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not more than the greater of�1,000 dollars or as established by the City of Chula Vista Policy and Procedures Manual for Civil Penalties or by imprisonment not exceeding six(6)months, or both such fine azid imprisonment. Each day that a violation continues after due nohce has been served shall be deemed a separate offense. 15.36.025 Failure to comply. Chapter 1 Scope and Administration - Subsection 111.4 Failure to comply of the Fire Code portion of the California Building Standards Code is hereby revised to read as follows: � 1]1.4 Failure to comply. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform ro remove a violation or unsafe condition, shall be subject to a fine of not less than �250.00 dollars or more than $1,000 dollazs. 15.36.030 Response map updates.
