\�"I-IERE.4S, as response to the economic do���ntum and in an anempt to promote
development, the Cit�• Council. on Januan� 6; 2009; appro�ed a pa��ment plan pro�ra.�n for cenain
development fees (`Deferral ProQram`-); and
��Z-IERE.45; on September l�, 2010, Council ezpanded the Deferral Proeram to incb.ld2
Pazk .4cquisition and De��elopment fees: and
W7-IERE�+S; on September 14, 2010_ throuQh the appro��a] and adoption of Ciz�� of Chula
Vista Ordinance 3163. Cit�� Council altered the nazure of the Deferral Pro¢ram and eatended its
effecti��eness throush December 31. 201 l: and
\V'I-IERE.AS; the ne��� Deferral Proeram, rather t6an requirin2 developers to pay fees at
permit issuance or enter into an a�reement secured by a lien placed on the propem� to be
de�eloped; allo��ed for the pa��ment of fees at fina] inspection; and
\\�"I-IERE.AS; on Dece�nber 6, 201 1 through the appro��al and adoption of ordinance 3220:
Citv Council further extended the Deferral Proeram throueh December 31: 2012; and
\VHERE.AS: on December 1 ]; 2012 throueh the approval and adoption of ordinance
3242; Cin� Council funher extended the Deferral Program throueh December 31, 2013; and
\i"HEREAS. �he current economic climate is linle better than it ���as at the time the
Deferra! Proeram �ras implemented; and
\VZ-IERE.4S. the need io promote de��elopment in the Cit�• still remains; and
�1�-IEREAS; in lioht of the abo�e; staff is proposine an amendment to Ordinance 3i63 in
order to extend the DzPerral Prosram for an additional one ��ear, until December 31, 2014; and
\V}-{EREAS: on Januan� 1; 2014, unless funher extended b.� approval of the Cin Council;
the time for the pa�'ment of fees ��ill re��ert back to their traditional trieeers: building permit
issuance or final map appro�al. y

NO��� THEREFORE, the Citp Council of the City of Chu1a Vista does ordain that:
1. Ordinance 3163 to be amended to read as follows:
Section 8. E�piratinn of this Ordinance
This Ordinance shall take effect thirty days afier fina] passaee and shall automatically
expire on December 31, 2014; and as of that date, is deemed repealed. Not�+�ithstanding
the fore�oing; am� buildin� perniit issued prior to expiration of this Ordina�ce shall �ot
be required to pa}� fees until Fina1 inspection or CerUficaLe of Occupane}�; provided none
of the e��ents identified in Section 6($) have occurred.
IL All other pro��isions of Ordinance 3163 shall remain in full force and effect
III. This amendment of Ordinance 3163 shall take effect 30 days after its second readin� and
appro��ai.
