HomeMy WebLinkAbout2011/09/27 Item 13 - EOA Contract SOUTH BAY EXCLUSIVE OPERATING AREA (EOA) Dave Hanneman Fire Chief CONTRACT BACKGROUND 1977 -South Bay Exclusive Operating Area (EOA) was ‣ created with agreement with the County and included Montgomery Fire District, Bonita/Sunnyside Fire District, and Chula Vista. 1979 -City of Imperial Beach added to the EOA ‣ 1980 –State recognized the need for a centralized EMS ‣ System 1981 -The Emergency Medical Services System and Pre- ‣ hospital Emergency Medical Care Personnel Act (EMS Act) was enacted SOUTH BAY EOA CONTRACT CA HEALTH and SAFETY CODE Section 1797.224 “ A local EMS agency may create one or more exclusive operating area in the development of a local plan, if a competitive process is utilized to select the provider or providers of the services pursuant to the plan. No competitive process is required if the local EMS agency develops or implements a local plan that continues the use of existing providers operating within a local EMS area in the manner and scope in which the services have been provided without interruption since January 1, 1981.” SOUTH BAY EOA CONTRACT EOA CONTRACT STATUS December 11, 2007 -City Council approved the Revised ‣ and Restated Agreement with American Medical Response (AMR) with expiration on May 31, 2011 Today –Agreement has been temporarily extended until ‣ Sept. 30, 2011 with pending City Council action to revise and restate agreement. SOUTH BAY EOA CONTRACT THREE STEPS TO RFP COMPLETION STEP 1: Process to create new EOA ‣ STEP 2: Apply to start RFP Process ‣ STEP 3: RFP Process ‣ SOUTH BAY EOA CONTRACT STEP 1: PROCESS to CREATE NEW EOA CV decides whether to create own EOA and split up ‣ current EOA If EOA Participants Submit for County Approval to be own EOA Disagree on ‣ need to change to Board of supervisors decides if we can proceed as our ‣ Competitive own EOA Procurement Process State agrees or rejects request to change EOA ‣ SOUTH BAY EOA CONTRACT STEP 2: APPLY to START RFP PROCESS EOA Participants notifies County of San Diego EMS of their intent to ‣ change to a competitive procurement County EMS notifies the California EMS Authority regarding the ‣ recommended change(s) in the local EMS Plan The EMS Plan is subject to EMSA approval ‣ EOA Participants develop a Request for Proposal (RFP) which ‣ sufficiently sets forth the requirements for service EMS reviews and approves RFP to ensure it complies with the State ‣ EMSA Guidelines #141 and to ensure a fair and competitive process EMSA has the authority to, and may choose to, review a proposed ‣ competitive procurement process EOA Participant conducts the advertising and selection process for ‣ the RFP SOUTH BAY EOA CONTRACT STEP 3: RFP PROCESS Formal Advertising: Invitations ‣ Responders’ Conference ‣ Proposal Contents ‣ Submission of Proposals ‣ Receipt and Evaluation of Proposals ‣ Rejection of Proposals ‣ Contract Periods ‣ Protests ‣ Canceling the Procurement Process After Opening ‣ SOUTH BAY EOA CONTRACT OPTIONS for CONSIDERATION Option 1:To Approve the original extension of the agreement for a period of 3 years with and option to extend for another 3 years at the direction of the City Manager.
