The subject reorganization proposal was approved by - LAFCA on December 3,
1984. Pursuant to the Government Code and LAFCO 's resolution, the City
Council , at their meeting of December 18, 1984, adopted Resolution No. 11882
initiating reorganization proceedings and setting a public hearing for January
8, 1985, to consider the proposed "Lower Sweetwater Reorganization."
The proposal involves annexation of 88 acres of unincorporated territory to
the City of Chula Vista; annexation- of 46 acres of unincorporated territory to
the City of National City and; concurrent detachments from the San Diego
County Flood Control District-Zone 3, the Lower Sweetwater Fire Protection
District, and the Bonita-Sunnyside Fire Protection District.

unincorporated territory to the City of National City and; concurrent
detachments from the San Diego County Flood Control District-Zone 3, the Lower
Sweetwater Fire Protection District, and the Bonita-Sunnyside fire Protection
Di strict.
DISCUSSION:
General Description of the Proposal Area ( Please see Exhibit A)
The proposal area is located primarily in the southwest quadrant of the
intersections of the I-54 and I-805 freeways. Exhibit A of this report
depicts the several unincorporated areas constituent to the overall proposal .
On August 28, 1984, the City received an application from Harriet F. Acton,
chief petitioner of the subject reorganization which involves several
jurisdictional changes including annexation of 88 acres of unincorporated

territory to the City of Chula Vista and concurrent special district
. detachments. LAFCA staff, after a thorough analysis of the submitted
- application, recommended to their Commission that the proposed reorganization
be modified to include an additional 46 acres of unincorporated territory (to
be annexed to the City of National City) and one additional special district
detachment. The chief petitioner of the proposal and representatives of the
affected agencies concur with the recortunended modifications.
- - . Original Proposal Area
Areas 1B and 2 shown on the attached exhibit constitute the 88 acre proposal
area which was the subject of the original application submitted to LAFCA on
August 29, 1984. The exi sti ng Ci ty boundary, the centerl i ne of the future
Sweetwater River Flood Control Channel , and the easterly right-of-way line of
I-805 represent the boundaries of the original proposal . The area in question
� is inhabited territory (more than 12 registered voters residing therein) and
. contains approximately 100 registered voters. It should be noted that the
majority of landowners and registered voters within the area have signed
petitions in support of annexation to Chula Vista. Area 18 contains two
residences and the right-of-way of I-54. Existing land uses within Area 2
consist of a single-family residential neighborhood west of N. Second Avenue,
the K.O.A. Campground facility to the irtunediate east of N. Second Avenue,
several vacant parcels within the flood plain of the Sweetwater River, and the
rights-of-way of I-54 and I-805. Areas 1B and 2 are within the City's Draft
Sphere-of-Influence Plan and, in accordance with LAF(� 's recortunendation, will
- become part of Chula Vista once the proposed reorganization is effective.
Reconenended Modifications
LAFCA staff concurred that the original proposal , as submitted (Areas 1B and
2) would establish more logical city boundaries, but that it would not
eliminate several existing corridors and islands of unincorporated territory
- - ° between Chula Vista and tdational City. Therefore, LAFCO staff recommended
that the proposal be modified to include three additional areas of
unincorporated territory, and that the said areas be annexed to the City of
National City. The subject areas, which total approximately 46 acres, are
depicted on the attached exhibit and discussed below. It should be noted that
� the inclusion of the following areas has been sanctioned by representatives of
_ National City and Chula Vista (City Manager's office) , as well as the chief
proponent of the original proposal . LAFCD, at their public hearing of
December 3, 1984, adopted a resolution approving the subject reorganization
with the recortunended modifications.
Area lA - This area contains approximately 10 acres, is situated north of
the centerline of the future Sweetwater River Flood Control Channel , and
is within the right-of-way of I-54. The inclusion of the area, and its
subsequent annexation to National City, would eliminate the existing
- County island associated with areas lA and 1B. The subject 10 acre area
i s wi thi n the National Ci ty sphere-of-i nfl uence and that ci ty i ntends to
- zone the territory for open space use after annexation.

Area 3 - This area is County-owned and contains approximately 16 acres of
unincorporated territory located east of I-805 adjacent to the National
.. City boundary (Plaza Bonita Shopping Center) . The territory in question
is currently undeveloped (it lies within the flood plain of the Sweetwater
River) and is part of the County's Sweetwater Regional Park. Inclusion of
this area within the proposed reorganization, and its subsequent
annexation to National City, would eliminate an existing corridor of

unincorporated land between National City and Chula Vista. This area is
also included in National City 's sphere plan and that city inten s to zone
it for open space use after annexation.
- Area 4 - Thi s uni ncorporated area consi sts of approximately 20 acres of
vacant County-owned land (also within the Sweetwater Regional Park)
located east of I-805, south of Plaza Bonita Shopping Center and �re st of
Plaza Bonita Road. The area in question is substantially surrounded by
the Cities of National City and Chula Vista. The area contains the bridge
structure which serves Plaza Bonita and is within the course of the
Sweetwater River. Pursuant to LAFCO 's approved modification, the �
annexation of this area to National City and its detachment fron the
Bonita-Sunnyside Fire Protection District would serve to eliminate a
potential County island and avoid duplication of responsibility for fire
protection service. The City of National City intends to zone the subject
area for open space use after annexation.
General Plan/Preioning
The 88 acre territory proposed for annexation to Chula Vista is designated on
the County General Plan "Residential 5 (7. 3 du/acre) and flood plain (1 du/4-8
acresl . County zoning is R-V-15 (14. 5 du/acre) .
- The Land Use Element of the Chula Vista General Plan designates the subject
_ � territory "Medium Density Residential (13-26 du/ac)" and "Parks and Public
� Open Space." The City Council , in 1978, partially prezoned Area 2 of the
annexation territory R-1 (Single Family Residential ) and A (Agriculture) . The
balance of Area 2 and all of Area 1B have not been City-prezoned. On May 29,
- 1984 LAFCO, at the City's request, waived the prezoning requirement for the
areas. The City intends to zone these areas in accordance with the General
- Plan after annexation.
- Environmental Review
LAFCO , as lead agency, conducted an Initial Study for the proposed
reorganization and determined that approval of the proposal would have no
significant effects on the envirorment and thereby issued a negative
declaration.
Municipal Services Delivery
The City's Public Works, Police, and fire Departments concur that the
provision of municipal services to the proposal area after annexation can be
accomplished without an increase of manpower and/or equipment.

FISCAL IMPACT: The City of Chula Vista, under a contract with the Lower
Sweetwater Fire Protection District, is currently providing fire service to
the annexing area. The subject contract has a termination clause which allows
Chula Vista to terminate the fire service agreement should a reorganization of
- the area occur.
By terminating the contract, the City will not receive approximately
$30-g35,000 annually now given to the City by the District for the cost of one
District firefighter now being utilized by the City. Upon annexation, the
said firefighter will remain as a permanent firefighter in the Chula Vista
Fi re Department. A1 though the revenue from the Di strict wi 11 not be received
after annexation, the net revenue from the area received pursuant to the
negotiated tax exchange is estimated to slightly exceed the amount currently
received.
On September 25, 1984, Council adopted Resolution No. 11772 agreeing with the
County of San Diego to the methodology for the negotiated property tax
exchange (outside the bounds of the PAaster Agreementl relating to the subject
- _ reorganization proposal .
- Pursuant to the said agreement, all of the base and all of the annual tax
increment from the detaching special districts (Lower Sweetwater Fire
Protection District, County Library, and County Flood Control District-Zone 3)
shall be transferred to the City of Chula Vista. Resultantly, the City will
receive between 55,000 and $6,000 of revenue from all revenue sources
including base year property taxes from the annexing area. In addition, in
future years the City would receive 41% of tne area's growth in value (annual
tax increment) .

� ' The Lower Sweetwatez FPD serves the unincorporated area of Lincoln
Acres and Lower Sweetwatei , both of which are surrounded by Chula
Vista and National City. The "LOwer Sweetwater Reorganization, "
approved by this Commission at the December 3rd meeting , reduced
the Lower Sweetwater FPD ' s territory by 88 acres or 25$ . The
Cities of Chula Vista and National City and the District have
been working together since 1977 to develop ways of providing
fire service protection to the area , and , in 1991 , a division
of the service area and staff of the Lower Sweetwater FPD between
the cities was agreed upon. When the "LOwer Sweetwater Reorgani-
zation" is finalized , the District ' s contract with Chula Vista
will be terminated . The contract with National City to provide
fire services in Lincoln Acres will continue until the area is
annexed to the city. Residents in the Lincoln Acres area have
indicated their intention to file a reorganization proposal within
the next yeat . The City Council recently offered to support a
reorganization by paying the filing fees ; however , they stated
' that they would not initiate reorganization proceedings . The
sphere of influence for the Lower Sweetwater FPD will be considered
with the sphere proposals for the Cities of Chula Vista and National
City.
In the case of both districts , a reorganization proposal could
be very controversial and none of the affected governmental agencies
have expressed a serious interest in initiating the process .
Therefore, the initiation of a reorganization would have to be
by petition of the landowners or voters. The citizens of Lincoln
Acres and Bostonia have, in the past, expressed strong opposition
to a reorganization and it is not certain that such a proposal
would be successful .

REORGANIZATION INCLUDING ANNEXATIONS TO THE
CITY OF CHULA VISTA AND THE CITY OF NATIONAL CITY
AND DETACHMENTS FROM THE
LOWER SWEETWATER FIRE PROTECTION DISTRICT,
THE SAN DIEGO COUNTY FLOOD CONTROL DISTRICT - ZONE 3 AND
- THE BONITA-SUNNYSIDE FIRE PROTECTION DISTRICT
"Lower Sweetwater Reorganization"
� On motion of Commissioner Fordem, seconded by Commissioner
Mahr , the following tesolution is adopted :
L4HEREAS , a petition was submitted to this Commission fot
__- _ . the reorganization of territoiy including annexation to the
City of Chula Viste and detachment from the Lower Sweetwater
Fire Protection pistrict and the San Diego County Flood Contiol
District - Zone 3 which petition was certified sufficient by
_ the Executive Officer on November 14 , 1984 ; and
wHEREAS , the territoty proposed for reocganization is as
described in the application on file with the Local Agency Formation
Commission; and
WHEREAS , pursuant to Government Code Section 56262 , the
_ . Executive Officer of this Commission set a public hearing on
the proposed reorganization for December 3 , 1984 , and gave notice
. of the date, time, and place of said tiearing in accordance with
Government Code Sections 56264 and 56265; and
WHEREAS , the Executive Officer of the Commission has filed
: her report on said reorganization , which report was received
and considered by the Commission;
NOW THEREFORE, BE IT RESOLVED , that this Commission hereby
_ finds, determines, and ordeLS as follows :
(1) The hearing was held on the date set therefor , and
due notice of said hearing was given in the manner required
by law.
(2) At that hearing the Commission called for , heard ,
and consideied all intecested narties and read and considered
_ _ the report of the Executive Officer .
(3 ) The Commission finds , in accordance with the Negative
" Declaration dated November 1 , 1984 , that this pioposal will
have no significant effect on the environment.

(4) The Commission certifies, pursuant to Government Code
Section 54774 . 3 , that this proposal would have no effect on
any agricultural oreserves as defined in Government Code Section
512m1 (a) and would not result in the conversion of prime agricultural
- . land to nonagricultural use.
(5) The Commission hereby approves the reorganization
with modified boundaries, as described in Exhibit "A" attached
heZeto , and to include the following actions :
a) Annexation of 88 acres to the City of Chula Vista;
b)� Annexation of 46 acres to the City of National
City;
c) Detachment of 134 . 19 acres from the Lower Sweetwater
Fire Protection District;
d) Detachment of 134 . 1H acres from the San Diego
County Elood Control District - Zone 3; and
e) Detachment of H. 85 acre from . the Bonita-Sunnyside
Fire Protection District.
(6) The boundaries of the territory as described in Exhibit
"A" are definite and certain .
(7) The boundaries of the territory do conform to lines
of assessment and ownership.
(8) The tezritory includes 134 . 10 acres and is inhabited .
(9) The territozy proposed to be reorganized is hereby
designated the "LOwer Sweetwater Reorganization" (City of Chula
Vista) .
(10) The Commission hereby designates the City of Chula
Vista as the conducting authority and authorize� the City Council
to initiate oroceedings in compliance with this resolution .
(11) The Executive Officer of this Commission is directed
to file and mail certified copies of this resolution as required
by law.
