The Califomia Buildine Standards Commission has mandated that jurisdictions w�ithin.the State
start enforcing the 2013 Editions of the California building codes on January 1; 2014. The adoption
of California building codes is a routine action undertaken by the City in response to State adopted
building codes. This action allo���s the City to incorporate appropriate local amendments into tl�e
enforcement program.
ENVIRONMENTAL REVIEVV
The Director of Development Services has reviewed the proposed activity for compliance �vith
the California Environmental Quality Act (CEQA) and has determined that the activity falls
within the Class 8 Categorical Exemption pursuant to California Code of Regulations Title 14,
Chapter 3, Article 19 (the "State CEQA Guidelines") section 15308 and therefore is exempt from
environmental review; and notwithstanding the Class 8 Categorica] Exemption, the Director of
Development Services has further detennined that there is also no possibility that the activity
may have a significant effecY on the environment; therefore, parsuant to section 15061(b)(3) of
the State CEQA Guidelines the activity is exempt from the provisions of CEQA. Thus; no
environmental review is required.
RECOMA'IENDATION
That the City Council place the ordinances of the various 20li Editions of the California buildine
codes on first reading.
BOARDS/COMMISSION RECOD'IMENDATION
The Boazd of Appeals and Advisors at their Monday, October 21, 2013 meeting unanimously
recommended adoption of the various 2013 Editions of the California building codes.
DISCUSSION
As mandated by the Califomia Building Standazds Commission (CBSC),jurisdictions���ithin the
State shall be�in enforcing the 2013 Editions of the Califomia building codes on January l, 2014.
Every three yeazs; the State adopts and amends the newest model codes published by the various
independent code-developing bodies. New State building codes take effect one-hundred and
eighty (180) days after they are published to allow local jurisdictions time to adopt local
amendments to the State building codes before tl�ey take effect. Local amendments cannot be
less restrictive than the State building codes and must be based on findings that the amendments

aze necessary because of local climatic, geologicai or topographical conditions. Local
amendmenu aze not effective until the amendments have been filed H�th the CBSC.
The majorih of the proposed local amendments currenth� exist in our Municipal Code, as
amendments to the current building codes adopted by the City and are beine proposed for re-
adoption as the Ciri� adopts the 2013 codes. The 2013 Califomia codes aze updated editions to
the current codes that are enforced locally and throuehout the state and therefore it should not be
difficult for staff and the industr}� to incorporate into their current practices.
The followin� are brief discussions on the various ordinances adoptine the 2013 building codes:
Proposed Ordinance ".A" —Administrative Pror'isions for the Technical Codes
This ordinance proposes minor cleanup amendments to A4unicipal Code Chapter 1�.06;
Administrati��e Pro��isions for the Technical Codes. removine a reference to a section that���as
_ repealed in 2010 when the current building codes �vere adopted and replacing it �tiith the correct
reference. In addition, curzently small detached patio covers that are located at least six feet
from any building or strucmre on the same propem� are exempt from a building pemut The
ordinance proposes deletine the condition of six foot separation from buildings or structures so
that small detached patio covers that are less than six feet from the main building can be eaempt
from a buildine permit and adding a condition for rivo or more patio covers to be at least siz feet
apart from each other to be considered sepazate patio covers to qualify for the exemption.
Proposed Ordinance "B"—20li California Buildine Code
The proposed ordinance adopts the 2013 Califomia Building Code and proposes the re-adoption
of existins local amendments to the current Buildins Code adopted b�� the City.
Proposed Ordinance "C'- — 20li Califomia Residential Code
The proposed ordinance adopts the 2013 California Residential Code. Staff is not proposine any
local ameodments to the code.
Proposed Ordinance "D-`—2013 Califomia Referenced Standards Code
The proposed ordinance adopts the 20li Califomia Referenced Standazds Code. Staff is not
proposing an}� local amendments to the code.
Proposed Ordinance "E"—2013 Califomia Green Buildins Standards Code
Staff is proposina the adoption of the 2013 Califomia Green Buildine Standazds Code (2013
CGBSC) and readopt only one of the current local amendments. �'�7hen the Cih� adopted the
current code back in 2010, the code applied onh°to ne��� buildinss and the Cit�� amended the code
to expand the scope to include additions and alterations to existing buildinos. The 2013 CGBSC
addresses additions and alterations to existine buildings, and therefore, there is no need to carry
I fon��azd the amendments that are related to additions and alterations. In addition and pursuant to
SB 407 (2009); effective Januan� ]; 2014, before the City can sien-off on a building permit for
an alteration or improvement to residential and non-residential real property that was built and
available for use on or before Januar�� 1; 1994, plumbin� fixtures not meetina certain��ater
consen=ation standazds must be replaced b}�the propem� owner with ���ater-consemin� fiatures.

Furthermore, the City recently amended the current code by adopting mandator}� cool roof
regulations. Pursuant to Califomia law, local amendments expire when current codes are no
lonser in effect. In order to readopt the mandatory cool roof regulations,tbe local adoption
process must meet the requirements and follow the process established by Section 10-106 of the
CA Code of Regulations, Title 24, Part 1; Locally Adopted Energy Standards (Section 10-]06).
Eeen though staff is not proposing amending the Califomia Energy Code to require cool roofs, it
is the California Energy Commission's (CEC) opinion that because cool roofing is one of the
options available to builders under the performance method of compliance with the Energy Code
and it plays a role in the energy efficiency of buildings, the City's continued mandating of cool
roofs will need to go through the process outlined in Section 10-106. The process is similar to the
process the City had to follow when it adopted increased energy efficiency standazds. It involves
a cost-effectiveness analysis, a City Council determination that the proposed requirements are
cost-effecti��e; and submittal of the proposed requirements to the CEC afrer the ordinance's first
reading by City CounciL Per Section 10-106; before local energy efficiency standards can take
effect, the CEC must make the finding "that the standazds will require buildings to be designed
to consume no more enerey than permitted by Part 6 [California Energy Code]." The application
to the CEC must include 1) the proposed ordinance (after a public hearing and first reading), 2) a
study/analysis showing how the City determined energy savings, 3) a statement that the
standards ��ill require buildines to be designed to consume no more energy than permitted by the
Califomia Energy Code, and 4) tl�e basis of the City's deteniiination that the standards are cost
effective. The CEC review can take up to three months.
Staff and SDG&E initiated discussions �n�ith an energy consultant to start the process of
de��elopine a cost-effectiveness analysis that is required for proposing local cool roof standazds
and/or increased energy efficiency standards (above 2013 Energy Code) and were informed that
the sofr���are required to perform the analysis just recenUy become available and is going through
the CEC certification process. The consultant stated that tl�e industry still needs to evaluate and
become familiar with the software and the new energy code before tl�ey can perform the required
analysis. It will be several months before such an analysis can be made available. Staff will
continue to follow up with the consultant on the required study and will bring forward
recommendations to Council based on the results of the study.
Proposed Ordinance "F" —2013 California Mechanical Code
The proposed ordinance adopts the 2013 Califomia Mechanical Code. Staff is not proposing any
local amendments to fhe code.
Proposed Ordinance "G" — 2013 Califomia Electrica] Code
The proposed ordinance adopts the 2013 Califomia Electrical Code and proposes the re-adoption
of existing local amendments to the current Electrical Code adopted by the City. �
Proposed Ordinance "H" —2013 California Eneray Code
The proposed ordinance adopts the 2013 Califomia Energy Code. Current locally adopted
increased energy efficiene}� standazds ti�ill expire when the current energy code expires on
January 1, 2014 and similaz to ]ocally adopted cool roof standards, in order to readopt increased
energy efficiency standards, the ]ocal adoption process must meet the requirements and follow
the process established by Section ]0-106 of the CA Code of Regulations, Title 24, Part ];

Locally Adopted Enerey Standazds (Section 10-]06). The specifics of the process and
requirements ��ere outlined above under "Proposed Ordinance "E" — 20li California Green
Buildins Standards Code."
Similaz to localh� adopting mandatory cool roof standazds, and based on discussions with an
enerey consultant, it«�ill be several months before a cost-effecti�eness analysis can be made
available to staff. Staff N�ill continue to follo��up �i�ith the consultant on the required smd�� and
will brina for��azd recommendations to Council based on the results of the studv.
Based on a CEC presentation on the new code, the 2013 Enere�� Code is about 2�% abo��e the
current base code for sinele famih�. 14% for multi-familv and 30% for non-residential.
Proposed Ordinance "I" —20li Califomia Plumbins Code
The proposed ordinance adopts the 2013 California Plumbins Code and proposes the re-adoption
of existine local amendments to the current Plumbino Code adopted b}� the Citv.
Proposed Ordinance "J"—20li Califomia Fire Code
The proposed ordinance adopts the 2013 California Fue Code and proposes the re-adoption of
ezisting local amendments to the current Fire Code adopted by the Cin�. Previous California
State Fue n4arshal Photo��oltaic Guidelines ha��e been repealed from the Ordinance, as the
requirements are no���set forth in the 2013 basic code laneuaee. Additionall}�, n��o ne���
amendments ha��e been set forth therein. The first ne�r amendment requires electronic maps be
provided to the Fue Department as part of the permit process. This provision ���ill create a
sienificant le��el of efficacy for the Department's mapping and buildine pre-plannina pro�ram;
�vhereas, the electronic maps �vill become the foundation for the response maps used by the
Department. The second ne�v amendment memorializes the minunum meter size for National
Fue Protection Association 13-D fire sprinkler s��stems�nsurine that ���ater volume is adequate
to support the life safen� s��stem.
DECISION AIAKER CONF'LICT
Staff has determined that the recommendations requirin� Council action aze not site specific and
consequentl}� the �00 foot rule found in California Code of Reeulations Section 18704.2(a)(1) is
not appiicable to this decision.
CURRE\T 1'EAR FISCAL I�IPACT
There are no increases in fees proposed in this adoption. The cost of new code bools and related
trauune is included in the current ��ear`s budget. Building permit fees ma}� need to be adjusted to.
reco��er the cost of anv additional staff time associated ���ith plan revie�i� and inspection. Am�
additional stafftime �vill be accounted for in updates to buildi�g permit fees.

1. SIAFF CO?v1MENTS
Building Of£icial El-Khazen mentioned a tcainin�session given by the City Cleik's office for the
liaisons and sectetaiies of'ihe Boazd/Conunissions. The training covered standacd practices and
procedures with the emphasis of staudazdizing the way agendas, noricing, and minutes are done.
One of the things leacned from that training, which is �ot being practiced in iYs entuety by this
boacd, is the excuse absenteeism procedure. Staff stated the infotmation is in the municipal code
under 225 110 Attendance requirements- Excused absences- Removal for cause. Copies were
disnibuted to the boazd and Building Official El-Khazen said the boaz'd should follow tlzese
guidelines in the future. He also stated that absentee infoimation would be noted under the
Consent Calendar foi any upcoming meerings.

Chau Sanfilippo thanked tbe board membeis for their participation in reviewing and
recommending the ordinance to city council. He asked the building official if'this board was able

SECTION II FINDII�'GS AND DECLARATION
The City Council specifically and expressly finds and declares tl�at adding sections 1�.08.020
and 15.08.030 to Chapter 15.08 is necessazy due to local topographical conditions. As a result of
the geographical layout of the City the City Council deems it aesthetically important to shield
roof equipment enclosures from public view. Also, exeinpting conversion of eaisting Group R
occupancies to offices from Subsection 705.1 l of the California Building Code is an important
historical exemption contained in the City Code from years past and the City Council deems this
exemption necessary to preserve local topographical conditions.
SECTION III EFFECTNE DATE
This ordinance will take effect and be in force thirty days afrer final passage but not before
January 1, 2014.

Chula Vista Photovoltaic Pre-\�'irine Installation Requirements are incorporated into the

All new detached single-family dwellings and duplexes shall include a single-source clothes
�vasher gra}���ater outlet and an outside stub-out to allow the later installation of a clothes N�asher
graywater irrigation system that complies with the requirements of Section 1602.1.] of the 2013
Califomia Plumbing Code. The outlet and stub-out shall be installed in accordance with the
Chula Vista Clothes Washer Graywater Pre-Plumbing and Stub-Out for New Residential
Construction or an equivalent altemate method and/or material approved by the Building
Official.
The provisions of this Section may be modified or waived when it can be satisfactorily
demonstrated to Yhe Building Official that compliance with these regulations is impractical due
to construction or physical constraints, or due to site and/or soil conditions.
SECTION II FINDII�'GS AND DECLARATION
The City Council of the City of Chula Vista specifically and expressly finds and declares that
adding section 15.28.01� to Chapter ]5.28 is necessary due to local climatic conditions. As a
result of high sturuner ambient temperatures and periods of heat waves, average load demand and
peak load demand of energy used in Chula Vista is an important factor conceming public safety
and adverse economic impacts of power outages or power reductions. Facilitating the installation
of solar water heating systems wil] have ]ocal and regional benefits in the reduction of total and
peak energy use and greenhouse gas emissions.
The City Council specifically and expressly finds and declares that adding section 1�.28.020 to
Chapter 15.28 is necessary due to ]ocal climatic conditions. As a result of prolonged droughts
exacerbated by climate change, it is anticipated that water supplies from imporied sources are
reduced, and furthermore, as a result of population and economic growth, demand for water is
expected to increase. These impacts could limit imported water availability, lead to higher demand
for local ���ater sources and increase utility costs. Requiring single-source gray��ater stub-out in
new residential development facilitates the use of grayv✓ater for irrigation which in tum helps
address these water-related climate change impacts.

This Section 1536.015 amends Section 202 of the Fire Code Portion of the California
