This project, funded under Federal Project No. PLHL10 �203(036); consists of the removal and replacement of failed asphalt concrete pavement (die-outs) and application of asphalt rubber overlay. \�'ork on this project also includes the replacement and under2roundine of the temporary above eround PVC ���aterline servicine the Nature Center and San Dieeo National Wildlife Refuge Complex (Fish and �6'ildlife facilities). ENVIROi�NIENTAL REVIE�i' The Director of De��elopment Services has revie�red the proposed project for compliance �vith the Califomia Em�ironmental Qualirv Act (CEQA) and has determined that the project qualifies for a Class 1(c) categorical ezemption pursuant to Section 1�SO1; Eaistine Facilities, of tl�e State CEQ.A Guidelines because the project consists of maintenance or repair ��ork to existing public street facilities involving neglieible or no expansion of an existin� use. Thus, no further CEQA environmental revie��� is required. 19-1 11/5/13, Item� Page 2 of 4 In addition, the Development Services Director has reviewed the proposed project for compliance with the I�'ational Environmental Policy Act (NEPA) in conjunction ti�ith the Califomia Department of Transportation (Caltrans), the state department designated as Lead Environmental Agency by the U.S. Department of Transportation, Federal Highway Administration (FHWA) for federally funded street projecta It was determined that the project qualifies for a categorical exclusion pursuant to Title 23 Code of Federal Regulations (CFR) � Section 771.117(d); activit}�:(d)(l) [Modernization of a Street by resurfacing, restoration, � rehabilitation or reconstruction]. Thus, no further NGPA environmental review is required. In addition, the City received a Coastal Development Permit Waiver from the Coastal Commission dated August 1, 2013 based on the project plans and information submitted by the City. RECOMMENDATION Council adopt the resolution. " BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION This project was included in the FY2010/FY2011 Capital Improvement Program budget to construct the pavement rehabilitation and undergrounding of the waterline service to the Fish and Wildlife facilities. This project was approved under the FY2010 Public Lands Highways Discretionar}' (PLHD) Program and is being administered by Caltrans. Caltrans authorized funding for Preliminary Engineering on June 22, 2012, and for Construction (E-76) on July 9, 2013. This project would extend the life and serviceability of the roadway through the removal and replacement of deteriorated sections of pavement (dig-outs) and the application of asphalt overlay surface treatment. The application of the asphalt overlay surface treatment will complete the overall maintenance strategy on this roadway. In addition to applying the asphalt overlay, and replacing the existing water facilities; the work also includes weed removal and treatment with herbicide, crack filling, pavement striping and marking, traffic control, protection and restoration of existing improvements and other miscellaneous ���ork necessary to successfully complete tlie project. On October 2, 2013, the Director of Public Works received three (3) bids far the "Gunpo��der Point Drive Pavement Rehabilitation and Water Improvement (STL365)" project. The Contractor has satisfactorily performed construction projects of similar scope for the City in the past and staff has determined their work to be satisfactory. The Contractors License \ro. 680144 is current and active. Staff revie���ed the low bid and determined the bid packase is complete, �vith no errors or omissions. Therefore, staff recommends a«�ardine a contract in the amount of 5296;833.00 to Portillo Concrete Incorporated. The City customarih� uses a contineency amount of 15 percent of the contract amount; or $�4;�24.9�. Due to the unusuall}� strict environmental constraints associated �ith this project, staff recommends increasine the total contingency amount by �0 percent; ���hich ���ould result in a contingeucy of$66,787.43. Under Ciri- Council Polic}� No. �74-01, the Director of Public �'�'orks; under this contract can only authorize a maximum cumulati��e chanee order(s) of $10;000 plus 7% of the orieinal contract over $100;000.00 or approximately S23,778.31 total �i=ithout Council approval. If approved, the proposed resolution ���ould increase the Director of Public �Vorks' cumulative Chanee Order authorin� to approve chan2e orders, as necessarv, up to the contingenc�� amount of �66.787.43. which is an increase of 543.009.12 over Policv \io. �74-01. Increasina the contingency funds �i�ill allow staff to continue the project without delay should unforeseen circumstances resulting in increased project costs arise during the course of construction, as well as make adjustments to bid item quantities. Unforeseen conditions include such items as utility conflicts; hazardous materials; unespected underground conflicts; etc. If the contineency funds are not used; the�� �rill be retumed to the project fund balance. Disclosure Statement Attachment 2 is a copy of the contractor's Disclosure Statement. \'�'a�e Statement The sources of fundine for this project are from the Public Lands High���a��s Discretionary (PLHD) Proeram. DECISIO\� �1AKER CONFLICT Staff has revie���ed the property holdines of the City Council and has found no propem holdines within �00 feet of the boundaries of the properties which are the subject of this action. Staff is not independently a»�are, nor has staff been informed b}� any City Council member; of any other fact that mav constitute a basis for a decision maker conflict of interest in this matter. 19-3 11/�/13, Item /� Page 4 of 4 CURRENT YEAR FISCAL IMPACT There is no direct fiscal impact to the General Fund associated with this action. Sufficient funds are available for construction costs associated with this project, which will be funded by Federal funds from the Public Lands Highti�ays Discretionary Program. The project is under strict environmental construction period constraints and work must be completed prior to January 31, 2014 in order to avoid bird nesting seasons. Additionally, work is required to be conducted between 5:00 pm and 8:00 am to minimize disruption to U.S. Fish and A�ildlife Service facilities and the Living Coast Discovery Center.
