RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
AMENDING RESOLUTION NO. 3876 , AUTHORIZING THE FILING OF A
REVISED APPLICATION FOR FEDERAL GRANTS TO ACQUIRE OPEN-
SPACE LAND
The City Council of the City of Chula Vista does hereby
resolve as follows :
WHEREAS , Title VII of the Housing Act of 1961, as amended,
provides for the making of grants by the Housing and Home Finance
Administrator to states and local bodies to assist them in the
acquisition of permanent interests in land for open space uses where
such assistance is needed for carrying out a unified or officially
coordinated program for the provision of open space land as part of
the comprehensively planned development of the urban area; and
WHEREAS , the City of Chula Vista, herein sometimes referred
to as applicant, desired to acquire fee simple interest and has hereto-
fore acquired said interest pursuant to the letter of authorization to
proceed from the Regional Director of the Housing and Home Finance
Administrator, to certain lands known as the Bonita Valley Country
Club and Rohr Park, which land is to be held and used for permanent
open space land for park and recreational purposes; and
WHEREAS , Title VI of the Civil Rights Act of 1964 , and the
regulations of the Housing and Home Finance Agency effectuating that
Title, provide that no person shall be discriminated against because
of race, color, or national origin in the use of the land acquired
and/or developed; and
WHEREAS, it is recognized that the contract for Federal grant
will impose certain obligations and responsibilities upon the Applicant
and will require among other things , (1) assurances that families and
individuals displaced as a result of the open-space land project will
be relocated into decent, safe, and sanitary housing, (2) compliance
with Federal labor standards , and (3) compliance with Federal require-
ments relating to equal employment opportunity; and
WHEREAS , the total consideration paid for the acquisition of
said interest (inclusive of certain items ineligible for federal grant)
was $1,127, 000 (Bonita Valley Country Club, $1, 045, 000; Rohr Park
$82 , 000) .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista as follows :
1. That revised application be made to the Housing and Home
Finance Agency for grants in amounts authorized by Title VII of the
Housing Act of 1961, as amended, which amounts as presently requested
are $75, 925 for the acquisition of the Bonita Valley Country Club, and
$41, 000 for the acquisition of Rohr Park, for a total of $116 , 925; and
that the applicant will pay the balance of the cost from other funds
available.
2 . That the Mayor of the City of Chula Vista is hereby
authorized and directed to execute and file such revised applications
with the Housing and Home Finance Agency, to provide additional infor-
mation and to furnish such documents as may be required by said agency,
and to act as the authorized correspondent of the City of Chula Vista.

3 . That the proposed acquisition and development is in C
accordance with plans for the allocation of land for open-space uses , and
that, should said grants be made, the City of Chula Vista will acquire,
develop, and retain said land for the uses designated in said application
and approved by the Housing and Home Finance Agency.
4 . That the United States of America and the Housing and Home
Finance Administrator be, and they hereby are, assured of full compliance
by the Applicant with regulations of the Housing and Home Finance Agency
effectuating Title VI of the Civil Rights Act of 1964 .
5 . That there exists in the locality an adequate amount of
decent, safe, and sanitary housing which is available to persons displaced.
6 . That the proposed acquisition is in accordance with the
General Plan of the City of Chula Vista, adopted by the City Council of
said City by Resolution No. 3519 , adopted September 22 , 1964, for the
preservation of permanent open-space land, and that, should said grant
be made, the City of Chula Vista will retain the land for the uses
designated in said applications and approved by the Housing and Home
Finance Agency.
