LEGISLATIVE BODY OF COMMUNITY FACILITIES
DISTRICT NO. 97-2 (PRESERVE AIAINTENANCE
DISTRICT). DECLARIi�'G THE RESULTS OF A SPECIAL
ELECT]ON II�' THAT TERRITORI' DESIG\'ATED AS
COMh4Ut�'[TY FACIL[TIES DISTRICT NO. 97-2 (PRESERVE
n9AI1�TTENAI�'CE DISTRICT), IA4PROVEn4E\'T AREA "C,"
AI�TI�iEXATION I�'O. 7 AND ADDTI�iG SUCH TERRITORY TO
SUCH IMPROVEMENT AREA
WHEREAS, the Cit�� Council of the Citti� of Chula Vista (the "Cin� Council"), has
pre��iously undertaken proceedings to anne� that territory identified as Otay Ranch Plannine
Area 12 to an existing Communit�� Facilities District and an Improvement Area desienated
therein pursuant to the terms and pro��isions of the "Mello-Roos Communin� Facilities Act of
1982," being Chapter 2.5, Part l, Di��ision 2, Title � of the Govemment Code of the State of
Califomia (the "Acr') and the Cit�� of Chula Vista Communin� Facilities District Ordinance
enacted pursuant to the po���ers reserved b}� the Cin� of Chula Vista under Sections 3, � and 7 of
Article XI of the Constimtion of the State of Califomia (the "Ordinance ') (the Act and the
Ordinance may be referred to collecti��ely as the "Communitv Facilities District La�;�'). This
Community Facilities District and the Improvement Area are referred to as COMMUi�IITY
FAC[LITIES DISTRICT NO. 97-2 (PRESERVE MAII�'TENA\'CE DISTRICT) (the "Districr`)
and IMPROVEMEI�'T AREA "C," respectively. and such temtory proposed to be annexed is
referred to as AN2�'EX:�T[ON NO. 7 (the "Annexation Area"): and
N'HEREAS. this City Council did call for and order to be held an election to submit to
the qualified electors of the Annexation Area a proposition relatin� to the le��y of special tates
H�ithin the Annexation rUea: and
l�'HEREAS, at this time said election has been held and the measure voted upon and such
measure did receive the favorable 2/3's vote of the qualified electors, and this Cin� Council
desires to declare the results of the election in accordance �ti�ith the provisions of the Elections
Code of the State of Califomia and to order that the Annexation Area be added to the District and
Improvement Area "C' thereof.
NOW. THEREFORE. THE CITY COIJNCIL OF THE CITY OF CHULA VISTA.
CALIFORNIA. ACTING AS THE LEGISLATIVE BODY OF COMMUI�'[TY FAC[LITIES
DISTRICT NO. 97-2 (PRESERVE MAINTENANCE DISTRICT). DOES HEREBY
RESOLVE. DECLARE. FII�'D. DETERI�4II�'E AND ORDER AS FOLLOV�'S:

SECTION 1. The above recitals are all true and correct.
SECTION 2. This City Council hereby receives and approves the CERTIFICATE OF
ELECTION OFFICIAL AND STATEMENT OF VOTGS CAST, as submitted by the City Clerk,
acting in her capacity as the Election ofticial, said Statement setting forth the number of votes
cast in the election; the measure voted upon, and the number of votes given for and/or against the
measure voted upon. A copy of said Certificate and Statement is attached hereto, mazked
Exhibit "A," referenced and so incorporated.
SECTIOI�� 3. The City Clerk is hereby directed, pursuant to the provisions of the
Elections Code of the State of California, to enter in the minutes the results of the election as set
forth in said STATEMENT OF VOTES CAST.
SGCTION 4. This City Council does hereby determine and declare that the Annexation
Area is now added to and becomes a part of the District and Improvement Area "C" thereo£ The
__ City Council hereby further deterniines that the City Council is now authorized to levy the
special taxes within the Annexation Area as approved and authorized by the qualified electors of
the Annexation Area.
