HomeMy WebLinkAboutReso 1965-3701 RESOLUTION NO. 3701 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA URGING SUPPORT OF ASSEMBLY BILL NO. 87 The City Council of the City of Chula Vista does hereby resolve as follows : WHEREAS , the City Council of the City of Chula Vista has heretofore on several occasions expressed its support of the growing community concern over the real and devastating effects of the free availability of obscene and pornographic literature, and has urged a concerted effort to curb the dissemination of such literature, and WHEREAS , the Supreme Court of the United States has recognized the legitimate and vital interests of the states and localities to prevent such dissemination of material being harmful to children and has urged said governmental agencies to direct their laws to the prevention of the distribution of objectional material to children rather than attempting to quarantine the general reading public against such materials , and WHEREAS , the City Attorney of the City of San Diego, speaking on behalf of the League of California Cities and the City Attorneys ° Department of the League, has recently cautioned the Assembly Committee on Criminal Procedure to carefully consider legislation which, by virtue of its blanket restrictions on reading materials deemed objectionable , would be subject to rejection by the Courts as an infringement of free speech and as a result thereof said Committee failed to recommend such legislation to the Assembly, and WHEREAS , Assemblyman Richard Donovan has introduced Assembly Bill No. 87 , which defines as its objective the denial to children of access to materials which would tend to corrupt minors . NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of Chula Vista, on behalf of itself and in concurrence with the opinion of the City Attorney of the City of Chula Vista, that -1- in the interests of protecting the minors of this community and forwarding the total objective of curbing the distribution of obscene and erotic materials , does hereby join with the representatives and the City Attorneys of the League of California Cities in their carefully considered opinion of the methods of control of obscene and pornographic literature, and urges the passage of Assembly Bill No. 87 to prohibit the distribution of said harmful materials to children. BE IT FURTHER RESOLVED that the City Clerk be, and he is hereby directed to forward a certified copy of this resolution to the City Attorney of the City of San Diego, and to Assemblyman Richard Donovan.
