HomeMy WebLinkAboutReso 1965-3677 , • • ♦ . .A ' • RESOLUTION NO. 3677 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT FOR THE COMPLETION OF IMPROVEMENTS IN WEATHERSTONE SOUTH UNIT NO. 2 The City Council of the City of Chula Vista does hereby resolve as follows : That that certain agreement between the City of Chula Vista, a municipal corporation, and J. R. SHATTUCK and DEBORAH SHATTUCK, dated the 13th day of April , 1965 , for the completion of improvements in the subdivision known as WEATHERSTONE SOUTH UNIT NO. 2 , a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute same for and on behalf of said City. DATED: _ City Clerk CC 652 CONTRACT FOR COMPLETION OF IMPROVEMENTS IN Weatherstone South Unit No. 2 IT IS HEREBY AGREED by and between the CITY OF CHULA VISTA, a Municipal Corporation, and J. R. Shattuck & Deborah Shattuck, husband and wife, here- inafter called the Second Party, as follows: WITNESSETH: WHEREAS, the Second Party is the owner of real property in the City of Chula Vista, County of San Diego, State of California, described as follows: A portion of the Southwest Quarter of Quarter Section 87 and the Northwest Quarter of Quarter Section 88 of Rancho de la Nacion, in the City of Chula Vista, County of San Diego, State of California, per recorded map there- of No. 166 WHEREAS, the Second Party proposes to create a subdivision of the prop- erty above described, to be known as Weatherstone South Unit No. 2 and to effect the same as heretofore filed with the proper authorities of the said City of Chula Vista, the necessary maps and improvement plans and other data in conformity with the laws of the State of Calif- ornia and the ordinances of the City of Chula Vista applicable thereto, and WHEREAS, the said proper authorities of said City have found the pro- posed subdivision plan to be acceptable and in accord with the best interests of said City, and WHEREAS, the City of Chula Vista is entitled to require from the Second Party, and does require from the Second Party, as a condition precedent to the acceptance of any and all streets and easements and other improve- ments, assurances for the completion of the public improvements in said subdivision as is provided therefore in said plans and attendant speci- fications as have heretofore been approved as aforesaid, and - 3G77 SUB-Q-8 -1- � (7;, ` - (fit Y WHEREAS, the Second Party is desirous of supplying such assurances, NOW, THEREFORE, IT IS HEREBY AGREED BY and between the City of Chula Vista, and the Second Party as follows: 1. Said Second Party agrees to undertake and complete, and to pay for all labor and materials in connection therewith, within a period of 365 days from the date hereof, all the necessary work and installation of improvements in the hereinabove described subdivision in full conform- ity with the ordinances of the City of Chula Vista, the laws of the State of California, the directions of proper officials of the City of Chula Vista, California, as may be applicable thereto, and the plans for such improvements on file in the office of the City Engineer of the City of Chula Vista, bearing the file numbers: Chula Vista Drawing No. 65-5L and 65-6L The engineers estimate of cost of said improvements is 20.478.00 10% contingencies 2,048. 00 Total Bond Amount 22,526.00 The execution of this contract automatically acknowledges by the Party of the Second Part, the responsiblity to guarantee all public improvements for a period of one (1) year from the date of final acceptance. The Second Party further agrees to indemnify, protect and hold harmless the said City of Chula Vista from any and all claims of liability for personal injury, property damage, labor or material claims which may be made against the said City by reason of said work and installation of improvements as herein provided. 2. As a guarantee and as security for its full and faithful perform= ance in complying with all the requirements for the completion of said subdivision as aforesaid, the said Second Party shall deliver to the City of Chula Vista upon the execution of this agreement, a good and sufficient bond executed by an authorized surety company satisfactory to the said City of Chula Vista in the sum of $ 22,526.00 SUB-Q-8 _7_ 3. As a guarantee and as security for the payment of all material and labor claims for the completion of all said improvements, the Second Party, shall deliver to the said City of Chula Vista a bond in the sum of $ 11, 263.00 by its terms made to inure to the benefit of laborers and materialmen, for labor and material performed or fur- nished in the performance of this agreement. 4. Upon the execution by Second Party of this contract and the posting of bonds as herein provided, the City agrees to approve the final map of said subdivision and accept the same for recordation.
