RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
ACCEPTING GRANT OF EASEMENT FOR SEWER PURPOSES
The City Council of the City of Chula Vista does hereby
resolve as follows :
That certain grant of easement for sewer purposes
executed by J. R. SHATTUCK and DEBORAH SHATTUCK, dated the 6th day
of April, 1965 , a copy of which is attached hereto and by this
reference made a part hereof , the same as though fully set forth
herein be, and the same is hereby accepted for sewer purposes by
the said City of Chula Vista.

GRANT OF EASEMENT FOR SEWER PURPOSES
FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
the undersigned do hereby grant to the City of Chula Vista, in the County of San
Diego, State of California, an easement and right-of-way for, and the right to
construct, maintain, operate, replace, remove, or enlarge a sanitary sewer and
appurtenant structures in, upon, over and across that certain real property
situated in the County of San Diego, State of California, and More particularly
described as follows:
Over a portion of the Southwest one-quarter, of one-quarter Section
87 of the Rancho de la Nacion, in the City of Chula Vista, County of San Diego,
State of California, according to Map thereof No. 166 filed May 11, 1869, in
the Office of the County Recorder of San Diego County, being five feet on either
side of the following described centerline:
Beginning at the Northwesterly corner of Lot 22 of Weatherstone South,
Unit No. 1, according to Map No. 5397 filed May 29, 1964 in the Office of the
County Recorder of San Diego County; thence North 21'28'00" West along the
Northerly prolongation of the Westerly boundary of said Weatherstone South Unit
No. 1 a distance of 273.49 feet; thence leaving said Northerly prolongation, North
27°57'53" West a distance of 37.98 feet; thence North 84°50'00°' East a distance of
111.53 feet; thence South 80°30'40" East a distance of 37.92 feet to the True Point
of Beginning: thence North 13°10'00" West a distance of 39.57 feet, to a point
on a non-tangent 150 foot radius curve concave Southwesterly, the center of which
bears South 55°50'00" West; thence Northwesterly along the arc of said curve through
a central angle of 20°00'00" a distance of 52.36 feet; thence North 54°10'00" West
tangent to said curve a distance of 106.45 feet, lengthening and/or shortening the
side lines of the herein described easement to intersect with the Easterly line of
existing ten (10) foot sewer easement.
Together with the right to enter upon and to pass and repass over and
along said easement and right-of-way and to deposit tools, implements and other
materials thereon by said City of Chula Vista, its officers, agents, and employees
and by any contractor, his agents and employees engaged by said City, whenever and
wherever necessary for the purposes above set forth.
It is understood and agreed by the parties hereto that the Grantee shall
indemnify and hold the Grantor harmless against all claims for damage or suits for
loss, including costs and attorney's fees, arising from injury to any person(s)
or Arty or life, caused by or resulting from acts, or emissions by the Grantee,
its successors or assigns, arising from the construction, operation or maintenance
of the aforementioned sanitary sewer or in using operating, or traveling over the
land within the hereinbefore described grant of Easement.
It is further understood and agreed by the parties hereto that the afore-
mentioned sanitary sewer and appurtenances thereto shall be constructed, placed
or laid below the grade of natural ground.
