HomeMy WebLinkAbout2013/10/21 Board of Appeals & Advisors Agenda PacketBOARD OF APPEALS AND ADVISORS Meeting Date: 10/1412013 Subject: Ordinances adopting the various 2013 California building codes Submitted By: Building Official Fire Marshal/Deputy Fire Chief SUMMARY: The California Building Standards Commission has mandated that jurisdictions within the State start enforcing the 2013 Editions of the California building codes on January 1, 2014. The adoption of California building codes is a routine action undertaken by the City in response to State adopted building codes. This action allows the City to incorporate appropriate local amendments into the enforcement program. RECOMMENDATION: Recommend to City Council the adoption of the various 2013 Editions of the California building codes. DISCUSSION: As mandated by the California Building Standards Commission (CBSC), jurisdictions within the State shall begin enforcing the 2013 Editions of the California building codes on January 1, 2014. Every three years, the State adopts and amends the newest model codes published by the various independent code- developing bodies. New State building codes take effect one - hundred and eighty (180) days after they are published to allow local jurisdictions time to adopt local amendments to the State building codes before they take effect. Local amendments cannot be less restrictive than the State building codes and must be based on findings that the amendments are necessary because of local climatic, geological or topographical conditions. Local amendments are not effective until the amendments have been filed with the CBSC. The majority of the proposed local amendments currently exist in our Municipal Code as amendments to the current building codes adopted by the City and are being proposed for re- adoption as the City adopts the 2013 codes. The 2013 California codes are updated editions to the current codes that are enforced locally and throughout the state and therefore it should not be difficult for staff and the industry to incorporate into their current practices. The following are brief discussions on the various ordinances adopting the 2013 building codes: Proposed Ordinance "A" — Administrative Provisions for the Technical Codes This ordinance proposes minor cleanup amendments to Municipal Code Chapter 15.06, Administrative Provisions for the Technical Codes, removing a reference to a section that was repealed in 2010 when the current building codes were adopted and replacing it with the correct reference. Proposed Ordinance `B" — 2013 California Building Code The proposed ordinance simply adopts the 2013 California Building Code and proposes the re- H: \BLD— HSG\2013 building codes adoption\BOA &A \BOAA 2013 Codes Adoption.doc Board of Appeals and Advisors Meeting Date 10/14/2013 Page 2 of 4 adoption of existing local amendments to the current Building Code adopted by the City. Proposed Ordinance "C" — 2013 California Residential Code The proposed ordinance simply adopts the 2013 California Residential Code. Staff is not proposing any local amendments to the code. Proposed Ordinance "D" — 2013 California Referenced Standards Code The proposed ordinance simply adopts the 2013 California Referenced Standards Code. Staff is not proposing any local amendments to the code. Proposed Ordinance "E" — 2013 California Green Building Standards Code Staff is proposing the adoption of the 2013 California Green Building Standards Code (2013 CGBSC) and not readopt all but one of the current local amendments. When the City adopted the current code back in 2010, the code applied only to new buildings and the City amended the code to expand the scope to include additions and alterations to existing buildings. The 2013 CGBSC addresses additions and alterations to existing buildings, and therefore, there is no need to carry forward the amendments that are related to additions and alterations. In addition and pursuant to SB 407 (2009), effective January 1, 2014, before the City can sign -off on a building permit for an alteration or improvement to residential and non - residential real property built and was available for use on or before January 1, 1994, plumbing fixtures not meeting certain water conservation standards must be replaced by the property owner with water - conserving fixtures. Furthermore, the City recently amended the current code by adopting mandatory cool roof regulations. Pursuant to California law, local amendments expire when current codes are no longer in effect. In order to readopt the mandatory cool roof regulations, the local adoption process must meet the requirements and follow the process established by Section 10 -106 of the CA Code of Regulations, Title 24, Part l; Locally Adopted Energy Standards (Section 10 -106). Even though staff is not proposing amending the California Energy Code to require cool roofs, it is the California Energy Commission's (CEC) opinion that because cool roofing is one of the options available to builders under the performance method of compliance with the Energy Code and it plays a role in the energy efficiency of buildings, mandating cool roofs will need to go through the process outlined in Section 10 -106. The process is similar to the process the City had to follow when it adopted increased energy efficiency standards. It involves a cost - effectiveness analysis, a City Council determination that the proposed requirements are cost - effective, and submittal of the proposed requirements to the CEC after the ordinance's first reading by City Council. Per Section 10 -106, before local energy efficiency standards can take effect, the CEC must make the finding "that the standards will require buildings to be designed to consume no more energy than permitted by Part 6 [California Energy Code]." The application to the CEC must include 1) the proposed ordinance (after a public hearing and first reading), 2) a study /analysis showing how the City determined energy savings, 3) a statement that the standards will require buildings to be designed to consume no more energy than permitted by the California Energy Code, and 4) the basis of the City's determination that the standards are cost effective. The CEC review can take up to three months. Staff and SDG &E initiated discussions with an energy consultant to start the process of Board of Appeals and Advisors Meeting Date 10/14/2013 Page 3 of 4 developing a cost - effectiveness analysis that is required for proposing local cool roof standards and/or increased energy efficiency standards (above 2013 Energy Code) and were informed that the software required to perform the analysis just recently become available and is going through the CEC certification process. The consultant stated that the industry still needs to evaluate and become familiar with the software and the new energy code before they can perform the required analysis. It will be several months before such an analysis can be made available. Staff will continue to follow up with the consultant on the required study and will bring forward recommendations to Council based on the results of the study. Proposed Ordinance "F" — 2013 California Mechanical Code The proposed ordinance simply adopts the 2013 California Mechanical Code. Staff is not proposing any local amendments to the code. Proposed Ordinance "G" — 2013 California Electrical Code The proposed ordinance simply adopts the 2013 California Electrical Code and proposes the re- adoption of existing local amendments to the current Electrical Code adopted by the City. Proposed Ordinance "H" — 2013 California Energy Code The proposed ordinance adopts the 2013 California Energy Code. Current locally adopted increased energy efficiency standards will expire when the current energy code expires on January 1, 2014 and similar to locally adopted cool roof standards, in order to readopt increased energy efficiency standards, the local adoption process must meet the requirements and follow the process established by Section 10 -106 of the CA Code of Regulations, Title 24, Part 1; Locally Adopted Energy Standards (Section 10 -106). The specifics of the process and requirements were outlined above under "Proposed Ordinance "E" — 2013 California Green Building Standards Code." Similar to locally adopting mandatory cool roof standards, and based on discussions with an energy consultant, it will be several months before a cost - effectiveness analysis can be made available to staff. Staff will continue to follow up with the consultant on the required study and will bring forward recommendations to Council based on the results of the study. Based on a CEC presentation on the new code, the 2013 Energy Code is about 25% above the current base code for single family, 14% for multi - family and 30% for non - residential. Proposed Ordinance "I" — 2013 California Plumbing Code The proposed ordinance simply adopts the 2013 California Plumbing Code and proposes the re- adoption of existing local amendments to the current Plumbing Code adopted by the City. Proposed Ordinance "J" — 2013 California Fire Code The proposed ordinance adopts the 2013 California Fire Code and proposes the re- adoption of existing local amendments to the current Fire Code adopted by the City. Previous California State Fire Marshal Photovoltaic Guidelines have been repealed from the Ordinance, as the requirements are now set forth in the 2013 basic code language. Additionally, two new amendments have been set forth therein. The first new amendment requires electronic maps be provided to the Fire Department as part of the permit process. This provision will create a Board of Appeals and Advisors Meeting Date 10/14/2013 Page 4 of 4 significant level of efficacy for the Department's mapping and building pre - planning program; whereas, the electronic maps will become the foundation for the response maps used by the Department. The second new amendment memorializes the minimum meter size for National Fire Protection Association 13 -D fire sprinlder systems -- ensuring that water volume is adequate to support the life safety system. AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHAPTER 15.06 OF THE CHULA VISTA MUNICIPAL CODE, ADMINISTRATIVE PROVISIONS FOR THE TECHNICAL BUILDING CODE The City Council of the City of Chula Vista does ordain as follows: SECTION I That certain Sections of Chapter 15.06, Administrative Provisions for the Technical Building Codes, are amended to read as follows: Section 15.06.005 Scope Section 15.06.005, Scope, is hereby amended and shall read as follows: The provisions of this chapter shall serve as the administrative, organizational and enforcement rules and regulations for the technical codes listed under rwr aG , c 06 010 identified in and adopted in the manner indicated in Chapters 15.08, 15.09, 15.10, 15 12 15.16 15.24, 15.26 and 15.28, and which regulate site preparation and construction, location, alteration, moving, demolition, repair, use and occupancy of buildings, structures and building service equipment. Provisions contained in the appendices of the technical codes shall not apply unless specifically adopted by the City of Chula Vista. Section 15.06.015 Definitions The definition of Technical codes in Section 15.06.015 is hereby amended and shall read as follows: "Technical code" means those codes listed in GNINIG , c.06 n1 n identified in and adopted in the manner indicated in Chapters 15.08, 15.09, 15.10, 15.12, 15.16, 15.24, 15.26 and 15.28. SECTION II. SCOPE OF AMENDMENT This Amendment changes only those Sections specifically identified in Section I, above. No other changes to Chapter 15.06 are contemplated or intended by this Ordinance. The balance of Chapter 15.06 shall remain unchanged and continue in full force and effect. SECTION III. EFFECTIVE DATE. This ordinance will take effect and be in force thirty days after final passage but not before January 1, 2014. Section 408.3(E) of the California Electrical Code is hereby amended to read: Phase Arrangement. The phase arrangement on three -phase buses shall be A, B, C from front to back, top to bottom, or left to right, as viewed from the front of the switchboard or panelboard. The C phase shall be that phase having the higher voltage ground on three - phase, four -wire delta- connected systems. Other bulbar arrangements may be permitted for additions to existing installations and shall be marked. 15.24.065 Photovoltaic Pre - wiring Requirements. All new residential units shall include electrical conduit specifically designed to allow the later installation of a photovoltaic (PV) system which utilizes solar energy as a means to provide electricity. No building permit shall be issued unless the requirements of this section and the Chula Vista Photovoltaic Pre- Wiring Installation Requirements are incorporated into the approved building plans. The provisions of this chapter can be modified or waived when it can be satisfactorily demonstrated to the building official that the requirements of this section are impractical due to shading, building orientation, construction constraints or configuration of the parcel. ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHAPTER 15.28 OF THE CHULA VISTA MUNICIPAL CODE ADOPTING THE CALIFORNIA PLUMBING CODE, 2013 EDITION The City Council of the City of Chula Vista does ordain as follows: SECTION I That Chapter 15.28 of the Chula Vista Municipal Code is hereby amended to read as follows: Chapter 15.28 PLUMBING CODE* Sections: 15.28.010 California Plumbing Code, 2010 Edition, adopted by reference. 15.28.015 Solar Water Heater Pre - Plumbing. 15.28.020 Residential Graywater Stub -out. * Prior legislation: Prior code §§ 23.3 and 23.9; Ords. 779, 1332, 1748, 1917, 2156, 2343, 2506, 2508, 2639 and 2646. 15.28.010 California Plumbing Code, 2013 Edition, adopted by reference. There is hereby adopted by reference the California Plumbing Code, 2013 Edition, known as the California Code of Regulations, Title 24, Part 5, including Appendices A, B, D, H, I, and J, and excluding Chapter 1, Division II of that document as copyrighted by the International Association of Plumbing and Mechanical Officials and the California Building Standards Commission. Said document is hereby adopted as the Plumbing Code of the City of Chula Vista for regulating the complete installation, maintenance and repair of plumbing, drainage systems, water systems, gas systems, and private sewage disposal systems on all properties and within all buildings and structures in the City. Chapter 15.06 CVMC shall serve as the administrative, organizational and enforcement rules and regulations for this chapter. 15.28.015 Solar Water Heater Pre - Plumbing. All new residential units shall include plumbing specifically designed to allow the later installation of a system which utilizes solar energy as the primary means of heating domestic potable water. No building permit shall be issued unless the requirements of this section and the Chula Vista Solar Water Heater Pre - Plumbing Installation Requirements are incorporated into the approved building plans. The provisions of this chapter can be modified or waived when it can be satisfactorily demonstrated to the building official that the requirements of this section are impractical due to shading, building orientation, construction constraints or configuration of the parcel. Ordinance No. Page 2 15.28.020 Residential Graywater Stub -out. All new detached single - family dwellings and duplexes shall include a single- source clothes washer graywater outlet and an outside stub -out to allow the later installation of a clothes washer graywater irrigation system that complies with the requirements of Section 1602. 1.1 of the 2013 California Plumbing Code. The outlet and stub -out shall be installed in accordance with the Chula Vista Clothes Washer Graywater Pre - Plumbing and Stub -Out for New Residential Construction or an equivalent alternate method and /or material approved by the Building Official. The provisions of this Section may be modified or waived when it can be satisfactorily demonstrated to the Building Official that compliance with these regulations is impractical due to construction or physical constraints, or due to site and /or soil conditions. SECTION II FINDINGS AND DECLARATION The City Council of the City of Chula Vista specifically and expressly finds and declares that each of the amendments noted above to the 2013 Edition of the California Plumbing Code is necessary due to local climatic, geological and topographical conditions. SECTION III EFFECTIVE DATE This ordinance will take effect and be in force thirty days after final passage but not before January 1, 2014.
