Since the openine of the EBC approximatel�� 2�-��ears aeo, the "No Pazkine" restriction has been in effect for all public streets ���ithin the EBC: and � V�'HEREAS; the EBC O��mers Association is requesting that the "I�'o Pazkine" restrictions be revised in accordance ���ith the attached exhibit and allo��� pazkine on most of the public streets to accommodate their tenants need; and RZIEREAS. based on the above infortnation. and to address EBC Owners Association request and need; staff recommends that some of the streets will have time prohibition pazl:ine restrictions. Also; the "I�'o Parking ' restriction will remain on all the other streets, except for the Boswell Road cul-de-sac located east of Lane Avenue: and V�'HEREAS. on June �. 2013. the Citv of Chula Vista Safetv Commission concurred ��ith staffs recommendation to revise Schedule III (Parkine Prohibited at All Times) and Schedule IV (Parkin� Prohibited Durine Certain Hours) to specif�� parkine desienations throuehout the EBC; and R'HEREAS. this recommendation and other information in the Cit�� Engineer's report has been fulh� considered b�� the Cit�� Council. NOW, THEREFORE. the Cit�� Council of the Cirv of Chula Vista does hereb�� ordain as fo1loH�s: I. ENVIRONA4ENTAL REVIE��' That the proposed project has been reviewed for compliance �aith the Califomia Environmental Qualih� Act (CEQA) and tha[ the Citv Council on its independent judement afrer fully considering all information presented hereby determines that the project, ��-hich consists of allowine restrictive parking throuehout most of the EBC; qualifies for a Class 1 (c) Categorical Exemption pursuant to Section 1�301 (Existing Facilities) of the State CEQA Guidelines because the proposal in��ol��es neeligible or no espansion of an existing use. REVISED SCHEDULES That Schedule III of the register maintained in the office of the City Engineer would be revised to include the follo��ing: Schedule III—Parkin Prohibited at All Times 1. Lane Avenue and Eastlake Parkway v��ithin the EBC. 2. Fenton Street - east of 2461 Fenton Street. 3. Fenton Street - BeCween Kului Drive and Lane Avenue, no parking will be allowed on the south side of Fenton Street. 4. Fenton Street— Between Eastlake Parkway and Scobee Park Entrance. 5. Miller Avenue - BetN�een Eastlake Parkway and Kuhn Drive. SEVERABILITY If any portion of this Ordinance, or its application to any person or circumstance, is for any reason held to be invalid, unenforceable or unconstitutioi�al, by a court of competent jurisdiction, that portion shall be deemed severable, and such invalidity, unenforceability or unconstitutionality shall not affect the validity or enforceability of the remaining portions of the Ordinance; or its application to any other person or circumstance. The City Council of the City of Chula Vista hereb�- declares that it ���ould have adopted each section, sentence, dause or phrase of this Ordinance; irrespective of the fact that any one or more other sections; sentences; clauses or phrases of the Ordinance be declared in��alid, unenforceable or unconstitutional. CONSTRUCTTON The City Council of the Cirv of Chula �'ista intends this Ordinance to supplement, not to duplicate or contradict, applicable state and federal la«� and this Ordinance shall be conswed in li�ht of that intent. V. EFFECTIVE DATE This ordinance shall tal:e effect and be in ful] force on the thirtieth dav from and after its final adoption. Vl.
