The Political Reform Act requues every local aeency to amend iu Conflict of lnterest Code

positions. The proposed resolution adopu an amended appendix to the Cin�-s Conflict of
Interest Code to account for recently added and remo<<ed positions to tt�e Cin`s
classification plan, and remo�e reference to the recentl�� dissolved Desi� Re��iew Boazd.
The resolution desi�ates the ne�rlv added posirions that aze required to file periodic
statements of economic interest; as �i�ell as the disclosure categories under Hhich each such
desi�ated employee is required to file. Additionally: the resolution requires tbose
desi�ated emplo��ees to complete biennial ethics trainin�; pursuant to AB 1234.

The Environmental Revie�� Coordinator has reviewed the proposed activin for
compliance ��ith the Califomia Environmental Qualiri� Act (CEQA) and has deternuned
that the activity is not a "Projecr' as defined under §15378 of the State CEQA Guidelines
because it does not involve physical changes to the environment therefore, pursuant to
§15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus,
no environmental review is necessary.
RECOMIVIENDATION
Council adopt the resolution.

DISCUSSION
On March 21, 2000, the Counci] adopted Ordinance No. 2807, adopting by reference the
standardized conflict of interest code contained in Title 2 of the Califomia Code of
Regulations, §18730; and any amendments thereto that aze adopted by the Fair Political
Practices Commission. The ordinance requires that the Council set for[h by resolution
the officials and designated employees who are required to file statements of economic
interests and the disclosure categories under which each such official and designated
employee shall file.
The adoption of the Fiscal Yeaz 20li-2014 budget made changes to positions that are
required to disclose certain economic interesfs due to the incumbents making or
participating in makin� governmental decisions on behalf of the Cify. The Animal Care
Facility Administrator, Director of Library, Director of Recreation, and Housing Manager
were added to the City's classifcation plan and tkie Director of Librazy and Recreation
position was removed. It ���as also determined fhat incumbents in the Senior Recreation
A4anager position should also be designated filers. Each departrnent director provided
input regarding the level of decision-making authority employees in these respective
roles have. Additionall}�, the Design Review Boazd was dissolved with the adoption of
Ordinance No. 3268. In light of these changes, it has been determined that the appendix
to the Conflict of Interest Code requires amendment.
Several positions that are currently vacant and unfunded were not deleted from the
appendix since they remain on the City`s classification plan, and should be designated in
the appendix to the Conflict of Interest Code. Adoption of the proposed resolution
an�ends tbe appendix to the ]ocal Conflict of Interest Code accordingly.
The resolution also specifies that all employees designated as filers under the City's
Conflict of lnterest Code are "designated employees" for purposes of AB 1234 and, as
such, are required to participate in mandatory ethics training.

WHEREAS, the Political Reform Act (California Government Code §§87100 through
91014), requires certain officials and candidates to file Statements of Economic Interests (Form
700) and requires local government agencies to adopt and promulgate conflict of interest codes;
and
WHEREAS, the City Council adopted Ordinance No. 2807, adopting by reference the
standardized conflict of i�terest code contained in TiUe 2 of the California Code of Regulations;
§18730, and an}� amendments thereto that are adopted by the Fair Political Practices
Commission; aod
WHEREAS, the ordinance requires that the City Council set forth by resolution the
officials and designated employees who are required to file statements of economic interests and
the disclosure categories under which eacl� such official and designated employee shall file; and
WHEREAS, pursuant to Government Code §87306(a), every local agency must amend
its Conflict of Interest Code when change is necessitat�ed by changed circumstances, including
the creation of new positions ���hich involve the making or participating in making of
govemmental decisions: and
WHEREAS, the City Attorney and the City Clerk have reviewed the Code and its
Appendix folloN�ing changes to positions ��ith the adoption of the Fiscal Year 2013-2014 budget
and the dissolution of the Design Review Board, consulted with Department Directors, and
determined that amendments to the Appendix of the Code are necessary; and
WHEREAS, the City Council desires that all City employees who are required to file
Form 700 under the City's Conflict of Interest Code be designated as "Local Agency Officials;`
as defined in Government Code §53234(c)(2), thereby requiring them to participate in the ethics
training mandated by AB 1234; and

NO\4'. THEREFORE. BE IT RESOLVED bv the Citv Council of the Cin� of Chula
Vista; that it hereb�� modifies the appendix to the local Conflict of Interest Code to amend the list
of officials, candidates and desienated emplo��ees wfio aze required to file periodic statements of
economic interests; and the disdosure categories for said filers; a copy of���hich shall be kept on
file in the Office of the Cin- Clerk.
BE IT FURTHER RESOLVED bv the Citv Council of the Citv of Chula Vista. that it
desienates those filers as "Local Aeency Officials" for the purposes of AB1234, therebv
requirine them to participate in mandated ethics trainin�.
