In December 1980, representatives of the San Diego Unified Port District and
the City met to discuss the possibility of maintenance of two District-owned
sewer pump stations on Chula Vista tidelands by the City. That proposal has
gone through considerable evolution during the design and construction of the
facilities and documents. The facilities are now complete, however, and
documents providing for the City to accept the facilities and appropriate
easements, and an agreement setting forth the mutual responsibilities of the
City and the District have been prepared by the respective staffs and are
submitted herewith for approval by Council .
RECOMMENDATION: That Council :
a. Adopt resolutions accepting easements and Bills of Sale, and approving
agreement contingent upon execution of documents by Port District.
b. Authorize Mayor to execute in behalf of City.
BOARDS/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
_ The facilities with which this report is concerned are:
a. Three lift stations; one each in Sandpiper Way, Tidelands Avenue and West
"J" Street,
b. 8" sanitary sewers and appurtenances as follows: approximately 1 ,370 feet
in Sandpiper Way south of "G" Street; approximately 450 feet in Tidelands
Avenue south of West "J" Street and 2,220 feet north of West "J" Street;
approximately 550 feet in West "J" Street west of Tidelands Avenue; and
approximately 505 feet north of West "J" Street and just east of the small
boat basin.

Easements adequate in length and width to allow our access to all the above
facilities for operation and maintenance have been prepared for Council
approval . Plans for and construction of the facilities have been reviewed by
City staff and are acceptable.
The agreement provides for normal maintenance and operation costs for the pump
stations to be paid by the District out of deposits to be updated quarterly.
Major repairs or replacement parts for the pump stations are to be paid
directly to the vendor by the District. The District will also pay directly
all costs for electricity, water and telephone used at the pump stations.
The City will perform all maintenance on the sewers. Normal sewer service
charges as provided in Section 3.20.020 of the Municipal Code will be paid by
District to support operation and maintenance of the sewers only.
The amount of the regular sewer fees charged to other users in the City are
such that they cover our costs for 1 ) administration, 2) maintenance of lines,
and 3) San Diego Metro capacity and treatment costs. Most of our pump
stations are funded by developers or as a special charge on the sewer bill and
not by the standard sewer service charge. It is believed that there will be
no negative financial impact to us for this agreement.
The agreement also provides for its modification or' termination by either
party. •
It is recommended that the Agreement be approved and that the easements and
Bills of Sale be accepted by Council , all contingent upon approval and
execution of all documents by the Port District. The District staff has
indicated willingness to recommend approval by the Board of Port
Cormnissioners. The basic control on finalizing this project appears to lie
with the City. It is our belief that the action of accepting the easements
prior to execution of the documents by the District, but concurrently with
approving the agreement, is both appropriate and expeditious.

Enclosed are the following documents :
1. Revised triplicate originals of an Easement
coverir.g sewer iacilities and a sewage lift
station located on Sandpiper Way.
2. Revised triplicate originals of an Easement
covering sewer facilities and two sewage
lift stations located on West "J" Street
and Tidelands Avenue.
These Easements have been revised in accordance with most of
your suggestions. Clause 11 in each document provides that
the facilities will vest in the District at the terr,iination
of the Easements. P�ith this change , I believe the Bills of
Sa1e that were previously sent to the City should now be ac-
ceptable.
Please have all three cooies of both Easements, as well as
all three copies oi the two Bills of Sale signed and re-
turned. The si,nature of the person signing for the City
must be acknowledged by a public notary. Following approval
by the Board of ?ort Commissioners, a full}+ executed copy of
each Easement atid each Bill o£ Sale c�ill be sent to you.
