The Cirv of Chula Vista «�as approached by the Eastlake Business Center O��mers Association to
revise the "No Pazkine" restrictions throuehout the business center. There is no pazking allo�ved
on any public streets �vithin the Eastlake Business Center (EBC). On behalfof the EBC Owmers
Association, it is requested to allow parking tUroughout most of tbe EBC with restrictive pazkine
hours.
EN�'IRON1i ZENTAL REVIE�Y
The Director of Development Services has re�riewed the proposed project for compliance �vith
the Califomia En�ironmental Quality Act (CEQA) and has determined that the project, which
consists of allo«�ng restricti��e pazldne throughout most of the EBC; qualifies for a Class 1 (c)
CateQorical Esemption pursuant to 3ection 1�301 [Existine Facilities] of the State CEQA
Guidelines because the proposal involves neglieible or no expansion of an existine use. Thus, no
fiu-ther envirorunental revie��� is required.

DISCUSSION
The EBC Owners Association oversees the parking restrictions within the EBC as part of theic
Covenants, Conditions, & Restrictions (CC&R s). Since the opening of the EBC approximately
2�-years ago, the "I�TO Parking" restriction has been in effect for all public streets within the
EBC.
The follo��ing table lists the typical street sections for all streets within the EBC:

The EBC Owners Association is requesting that the "No Pazking" restrictions be revised in
accordance with the attached exhibit in order to allow parking on most of the public streets to
accommodate their tenants' need. However, no parking will remain on some of the streets in the
EBC. In accordance with Chula Vista Municipal Code Section 10.52.270, upon approval of the
proposed `'No Parking" restrictions by City Council, Schedule III (Parking Prohibited at All
Times) of the register maintained in the office of the City Engineer would be revised to include
the following:
Schedule III—Parking Prohibited at All Times
1. Lane A��enue and Eastlake Parkway within the EBC.
2. Fenton Street - east of 2461 Fenton Street
3. Fenton Street - Between Kulm Drive and Lane Avenue, no parking will be allowed on the
south side of Fenton Street.
4. Fenton Street - Between Eastlake Parkway and Scobee Park Entrance.
5. Miller Avenue - Between Eastlake Parkway and Kuhn Drive.
In order to prevent commercial vehicles and unwanted vehicles from parking in the EBC
overnight, parking �i�ill not be allo���ed during the evening hours between 10:00 PM and 6:00
AM. Ho��ever, on Boswell Road, east of Lane Avenue, parking will be allowed at all times.
The EBC Owners Association will be working with the tenant, US Department of Immigration
and Naturalization Services (INS), to allow overnight parking for their employees on this cul-de-
sac section of Bos���ell Road east of Lane Avenue. This segment of Boswell Road will be
available fo the public, but the employees of the INS most likely will occupy these parking
spaces.

In accordance ���ith Chula Vista Municipal Code Section lOS2.290; upon approval of the

Based on the above information; and to address EBC Owners Association request and need; staff
recommends that some of the streets ���ill have time prohibition pazking restrictions (as listed
abo��e). Also, the "No Parkin�' restriction ���Il remain on all the other streets, except for
Bos���ell Road east of Lane Avenue (as listed above). Parking «�ill be allowed on this seement of
Bos���ell Road all hours of the day, 7 days a �veek. The attached eshibit sho��s the Eastlal:e
Association Parl:ine Proposal including parking desienation.
DECISION i1'LAKER CONFLICT
Staff has reviewed the propem� holdines of the Cin� Council and has found no property holdings
��ithin �00 feet of the boundaries of the property which is the subject of this action. Staff is not
independentiv a�vare; nor has staff been informed by any City Councilmember, of any other fact
that mav constitute a basis for a decision maker conflict of interest in this matter.
CUItRENT YEAR FISCAL I�4PACT
The proposed ne�v parking desienation modification would require the replacement and posting
of new signs and red curb stripine at intersections to improve sight distance. The cost estimate to
perform this work, in accordance �ith the Ciri�'s Master Fee Schedule; is approximately
�10,000. The proposed modification will be installed once the Ordinance is in effect. Sudberry
Properties; ��-ho manage the EBC; ��Il provide pa��ment for the cost of the removal; replacement,
and installation of all required signs and stripin�. Therefore; there is no direct impact to the
General Fund.

WHEREAS, the Cit}' of Chula Vista was approached.by tl�e Eastlake Business Center
(EBC) Otimers Association to revise the "No Parking" restrictions throughout the business
cei�ter; and
WHEREAS, the EBC Owners Association oversees the parking restrictions ���ithin the
EBC as part of their Covenants, Conditions; & Restrictions (CC&R's). Since the opening of the
EBC approximately 25-ti�ears ago, the "No Parking' restriction has been in effect for all public
streets within the EBC; and
WHEREAS, the EBC O���ners Association is requesting that the "No Parking"
restrictions be revised in accordance with tl�e attached exhibit and allow parking on most of the
public streets to accommodate their tenants need; and
WHEREAS, based on the above information, and to address EBC Owners Association
request and need; staff recommends tliat some of tl�e streets will have time prohibition parking
restrictions. Also, the "No Parking" restriction will remain on all the other streets, except for the
Boswell Road cul-de-sac locafed east of Lane Avenue; and
WHEREAS, on June 5; 2013, the City of Chula Vista Safety Commission concurred �aith
staff s recommendation to re��ise Schedule III (Parking Prohibited at All Times) and Schedule IV
(Parking Prohibited During Certain Hours) to specify parking designations throughout the EBC; and
WHEREAS, this recommendation and other ivfom�ation in the City Engineer s report has
been fully considered by the City Council.
NOR', THEREFORE, the City Council of tl�e City of Chula Vista does hereby ordain as
follo�vs: � �
I. ENVIRONMENTAL REVIEW
That the proposed project has been reviewed for compliance with the Califomia
Environmental Quality Act (CEQA) and that the City Couucil on its independent judgment after
fully considering all information presented hereby detem�ines tl�at flle project, which consists of
allowing restrictive parking throughout most of the �BC, qualifies for a Class 1 (c) Categorical

Ordinance, or its application to any other person or circumstance. The CiYy Council of the City of
Chula Vista hereb}� declares that it ��ould have adopted each section, sentence, clause or phrase
of this Ordinance. irrespective of the fact that any one or more oiller sections, sentences; clauses
or phrases of the Ordinance be declared invalid, unenforceable or unconstitutional.
IV. CONSTRUCTION
� The City Council of the City of Chula Vista intends Yhis Ordinance to supplement; not to
duplicate or contradict; applicable state and federal law and this Ordinance shall be construed in
light of that intent.
V. EFFECTIVE DATE
This ordinance shall take effect and be in full force on the thirtieth day from and after its
final adoption.
VI. PUBLICATION
The City Clerk shal] certify to the passage and adoption of this Ordinance and shall cause
the same to be published or posted according to law.
